Целью настоящей статьи является определение возможностей использования опыта Европейского Союза в применении принципа субсидиарности для регулирования и реализации законодательных прерогатив России по предметам ее совместного ведения с субъектами Федерации как главного института вертикально-властных взаимоотношений в федеративно устроенном государстве. The author studies the communitarian and conventional models of legal integration used in the Eur... more The author studies the communitarian and conventional models of legal integration used in the European Union (EU) and the Eurasian Economic Union (EAEU), respectively. The purpose of this comparative legal analysis is to determine unique features reflecting differences between these models. Particular focus is on the examination of legal acts of public bodies of the EU and the EAEU-their legal nature, place, role and the characteristics of their implementation in the national legal systems of their members. The author also analyses how the Court of the European Union and the Court of the Eurasian Economic Union control the enforcement of legislation of the EU and the EAEU, primarily in those cases where the courts assess justifications provided by supranational public bodies of these unions when they pass legal acts creating rights and obligations directly for citizens of the EU and economic entities of the EAEU. The article offers a rationale for the concept stating that the absolute priority of integration law over national legislation and the binding power of decisions of a supranational court for all participants of integration relations are the key milestones of supranational legal integration; when these milestones are achieved, it is possible to open borders not only for economic cooperation, but also for other forms of collaboration not linked tightly to the general processes of transnationalization of the economies.

In Canada, consulting with Indigenous communities over recourse projects, the Crown sometimes avo... more In Canada, consulting with Indigenous communities over recourse projects, the Crown sometimes avoids critical engagement with them, holding to the same arguments and counterarguments through regulatory and hearing stages. Such hollow moves, produced under the Crown’s rules, become embedded in the dominant argumentative discourse and pass unnoticed. To detect them, I apply Argument Continuities (ac s) – a new category of argumentative discourse analysis. ac s are a set of the same arguments and counterarguments repeatedly produced/reproduced by the dominant arguer through an adversarial reasoning process to dismiss opposing arguments. ac s have a specific life cycle – a chain of reasoning dynamics developing in a path-dependent fashion and increasing the cost of adopting a certain argument/counterargument over time. I test ac s in two institutionally diverse cases of Indigenous consultations and argue for the contingency of ac s upon the rules of consultations in reasoning exchanges....

Argumentation on some public policy issues is conjugated with disagreement and power differential... more Argumentation on some public policy issues is conjugated with disagreement and power differentials. Institutionally dominant arguers control the argumentation context through imposing authority rules which sometimes incentivize them to respond to opposing arguers in a fallacious way1 – with “the repeating tokens of the same counterarguments” and without considering the merits of opposing arguments. As produced in accordance with authority rules, such fallacies are embedded in the dominant argumentative discourse and easily pass unnoticed. To detect them, I introduce Argument Continuity (AC) – a new category of argumentative discourse analysis. This article attempts to study the inter-institutional dimension of the practical implementation ... more This article attempts to study the inter-institutional dimension of the practical implementation of the subsidiarity principle in the EU legislative process. The main research question is whether the subsidiarity principle could be a real communicative tool in the EU’s multi-level regulation policy used to seek consensus between EU institutions and national parliaments on the justification of an appropriate level for EU actions (subsidiarity justification). The short answer is ‘yes’. Through the content analysis of the published documents and with the help of the theory of deliberation, the author argues for a subsidiarity justification procedure occurring at the beginning of each instance of the EU legislative process to provide an inter-institutional setting to move away from confirming (one-way) to deliberative (two-way) reasoning over the issue of potential subsidiarity violation in the EU legislative process.

The Coase Theoreme of social costs became widely known by refuting the absolute need for prohibition of harmful activity in all instances when harm is established. It appears that fighting harmful activity is critical when it entails the costs for the entire society higher than the costs the society would face in case of termination of harmful activity. The Coase Theorem is applicable specifically to the problem of environmental pollution, in which everything is complex and interrelated, and the government regulation is fraught with the uncertainty of consequences of its implementation due to the absence of full and reliable information on all potential social costs. The role of national parliaments in advancing their subsidiarity concerns within European law-making may be strengthened through a more intensive political dialogue with the Commission, when the former acts not just as the ‘guardians’ of the subsidiarity principle (in the framework of the existing yellow and orange card schemes) but also as active contributors to the law-making process encouraging the Commission to leverage the so-called green card procedure. Предметом исследования выступают два аспекта практического применения принципа субсидиарности в Е... more Предметом исследования выступают два аспекта практического применения принципа субсидиарности в ЕС — правовой (судебный) и политический. В рамках первого аспекта автор выявляет тенденции в качественном развитии (изменении) оценки соблюдения принципа субсидиарности в законодательных актах ЕС, даваемой Судом ЕС в его решениях, принятых после вступления в силу Маастрихтского договора. В рамках второго аспекта автор исследует роль национальных парламентов государств ЕС в контроле соблюдения принципа субсидиарности в законодательном процессе ЕС. Посредством контент-анализа основных судебных и регулирующих документов ЕС автор развивает гипотезу, что межинституциональное измерение практического применения принципа субсидиарности наиболее полно отвечает динамическому характеру и смешанной политико-правовой природе данного принципа. Аргументируется, что соблюдение принципа субсидиарности должно обеспечиваться не за счет последовательного его применения правовым (Судом ЕС) и политическими (национальными парламентами, Европейским парламентом, Советом ЕС и Комиссией ЕС) институтами, а в результате их межинституционального взаимодействия. Автор формулирует практические рекомендации для национальных парламентов, которые могли бы в значительной степени добиться учета своих возражений по поводу соблюдения принципа субсидиарности в законодательных актах ЕС, но не путем возбуждения процедур «желтой» и «оранжевой» карт в отношении уже выпущенных институтами ЕС законопроектов, а через развитие с ними политического диалога на ранних этапах законодательного процесса, когда соблюдение принципа субсидиарности могло бы обеспечиваться без ущерба политическому влиянию законодательных институтов ЕС. Например, развитию диалога между национальными парламентами и Комиссией ЕС могла бы способствовать процедура «зеленой карты», возбуждаемая национальными парламентами на этапе подготовки законопроекта Комиссией ЕС, в рамках которой национальные парламенты заявляли бы о своих субсидиарных возражениях ранее вынесения законопроекта на рассмотрение законодателя, повышая свои шансы быть услышанными и принятыми всерьез. Дополняя процедуры «желтой» и «оранжевой» карт, «зеленая карта» могла бы способствовать формированию «трехуровневого» субсидиарного контрольного механизма по разрешению национальных субсидиарных возражений на всех стадиях законодательного процесса ЕС, трансформируя национальные парламенты из «надзирателей» субсидиарности в партнеров, работающих вместе с Комиссией ЕС по регулированию интеграционных отношений.
