It... more A model of court‐connected mediation following Western practice was adopted in Jordan in 2003. Its success has been limited. This practice insight addresses the current mediation legislation in Jordan in relation to civil and commercial disputes. The law allows the parties three options in choosing a mediator, one being a judge mediator. This raises important considerations for parties when they are choosing a mediator. The practice insight addresses these considerations with a view to improving party awareness when exercising their choice of mediator. It also takes the opportunity to suggest legislative changes to improve the uptake of mediation.

Introducing action reflection learning into a law course to instil lifelong learner skills and en... more Introducing action reflection learning into a law course to instil lifelong learner skills and enable students to adapt to a new style of lawyering is essential if 21 st Century lawyer needs are to be met. The paper describes the assessment, and the use of active reflective learning in a mediation course taught in an Australian law school. The benefits of such learning are described with specific attention to law teaching. Student reflections indicate the notable difference this teaching method had for their learning and development of a conflict resolution advocacy style.

- Health outcomes are associated with many work stressors in higher education staff. However, the... more - Health outcomes are associated with many work stressors in higher education staff. However, the professional compromise stressor, occurring when an individual’s professional standards conflict with workplace requirements, has not been studied in the higher education context. This pilot study contributes to the understanding of professional compromise among higher education employees and its impact on their well-being. Hair cortisol of university staff was measured across two time points in an academic semester. The study found that cortisol level was associated with role clarity, work demands, and perceived stress. Furthermore, after controlling for perceived stress, professional compromise at the beginning of semester was a significant predictor of hair cortisol at the end of semester. This pilot study is the first to establish an effect between professional compromise and cortisol concentrations and the first to investigate cortisol as a stress biomarker in higher education staff. The cortisol levels are discussed relative to chronic stress. The implications for higher education managers, indicate professional compromise is a factor university must understand in attending to workplace wellness. Future directions for further research are outlined

This paper describes the action reflection learning approach adopted when teaching a mediation law course in an Australian law school. The approach and outcomes are described with specific attention to how this style of teaching enriches the student experience. Student reflections describe the teaching method as having developed their skills, learning and appreciation of a new conflict resolution advocacy style.

The Nexus among Place, Conflict and Communication in a Globalising World, 2019

‘Learnings regarding the role of “place” in conflict and the communication of conflict’ draws tog... more ‘Learnings regarding the role of “place” in conflict and the communication of conflict’ draws together overarching themes, learnings and implications from the experiences relayed by the authors in the preceding chapters. These chapters demonstrate that place constitutes a central nexus with conflict and its associated communication. Creating a more harmonious world requires attention to place. The learnings provide understanding that the processes of conflict management and resolution can benefit by consideration of the nexus among place, conflict and communication. Often ignored as a ‘silent’ participant, place plays a central role in conflict and the communication of conflict. A multidisciplinary approach, drawing on scholarship from diverse areas, provides fresh insights. Collins concludes that this is an area ripe for further exploration and research.

The United Nations Charter (1945) sets forth in its preamble its raison d’être as saving ‘succeed... more The United Nations Charter (1945) sets forth in its preamble its raison d’être as saving ‘succeeding generations from the scourge of war, which twice in our lifetime has brought untold sorrow to mankind, and [...] to practice tolerance and live together in peace with one another as good neighbours’. The reality that since 1945 the world has experienced more than 250 major conflicts, with many more than 100 million casualties, shows that these aims have been largely aspirational. While the nature of conflicts has changed since the end of the Cold War, with the focus turning to internal state conflicts rather than international conflicts, there have been at least three major international wars in recent times. In addition, we see a challenge to the concept of the nation state, key to the system of containment of violence in the international arena, with the rise of non-state actors such as armed groups supporting ideologies and commercial private military and security companies (PMSC)...

Since 2003, the Australian Attorney-General’s Department has funded Family Law Pathways Network (... more Since 2003, the Australian Attorney-General’s Department has funded Family Law Pathways Network (‘FLPN’) to provide professional assistance for separating families when navigating the legal and human support network maze. The FLPN serve in providing an assured access to information and necessary services in the family justice system. Thirty-three FLPN now operate across Australia. FLPN funding relies on annual government funding approval creating a fragile funding basis for their continued work. In response the FLPN has sought evidence to determine just how important their role is in the family domain. This article reports on an evidence-based research project that provides a snapshot of FLPN activities and their value to the local community across FLPN communities in Australia
