Legal Reform in Indonesian Pawnshop

This study aims to examine regulations related to the development of pawning in Indonesia from time to time. Basic Rules of Pawnshops (Pandhuis Reglement) in 1928. Pawning has been known to the Indonesian people since the colonial era and its existence until now. The absence of new regulations related to pawning will harm consumers because many private pawnshops operate under their own rules. In this study the author presents the formulation of the problem: How to Arrange Pawns and Pawning Institutions in the Future? The formulation of the problem above is the Ius Constitituendumthe expected regulationrelated to the mortgage guarantee institution. This type of normative legal research is descriptive quantitatively with an analytical approach, a statutory approach, a historical approach. Analysis and construction are carried out in a quantitatively manner, emphasizing legal aspects (rechtbeginselen), especially law relating to pawning. The author applies an interdisciplinary method that combines law and economics. The results of this study showed that Indonesia does not yet have a pawn regulation at the level of the law. The urgency of the pawn regulation, in this case the Bill of Moving Materials, can fulfill the sociological basis of the community for the rule to ensure legal certainty. regulation and consumer protection. so there is a need for legal reform related to pawning.

This research was conducted with the aim of finding out how legal protection measures for customers (debtors) as consumers of bank service users and how the accountability of the bank in the event of risks related to bank credit agreements. By using the normative juridical research method, the credit agreement is a standard contract, where the contents or clauses of the credit agreement have been standardized and set forth in a form (blank), but are not bound in a particular form. Prospective debtor customers only need to sign if they are willing to accept the contents of the agreement, not giving the prospective debtor the opportunity to further discuss the contents or clauses submitted by the bank. Standard agreements are needed to meet practical and collective needs. The Principles for Islamic Debt Contract In The Sharia Pawnshop of Indonesia
Abtract This writing, basically, focuses on some Islamic principles in Sharia Pawnshop, especially Indonesia. These principles should be the basis of the legal relationship between the parties in the Sharia Pawnshop. Also these principles must integrate with the principle of mutual help (the Principle of Taawun) as its basis of the Sharia Pawnshop's contract. Because of debt contract is main key of Sharia Pawnshop. This writing is a legal research with using of analysis's conceptual approach. Using of this analysis, the author does try to formulate Islamic Principles in Sharia Pawnshop. This analysis, of course, refers to doctrines of Islamic Law. Therefore, the writer do hope to conclude which it can be justified scientifically. Legal experts agree that legal principle as the basic norm for rules of law. Legal principle contains a number of values and ethical guidelines. A legal norm, basically, has a philosophical basis which it can be the basis of establishment of such legal norm. Therefore, the rules of law which do not have a foothold of legal principle, they will be clumsy in its enforcement of the context.
Legal Aspect in the Financial Service Industry's Default in Indonesia

During the COVID-19 pandemic, the business world in Indonesia was colored by news of defaults by several leading companies in Indonesia. The problem studied in this study is the responsibility of financial services companies (State owned enterprises) and the role of the Otoritas Jasa Keuangan (OJK) as a financial services supervisory agency for the Indonesian financial services industry that has defaulted. For the normative juridical research method, the main source is secondary data. Qualitative normative data analysis. The results show that financial service companies that have failed to pay their customers because of their mistakes must be legally responsible for the legal consequences and morally responsible for their negligence in not adopting ethical principles in doing business. This responsibility assumes the form of having to pay for the losses suffered by customers when sued, and to restore the confidence of the public, which has been eroded in State owned enterprises (SOE), in addition to their disappointment with the management of State-owned enterprises, SOEs that do not heed ethical principles in doing business. In the case of defaulting SOE, OJK as the supervisor has not played its role of taking early preventive actions aimed at averting irregularities from occurring due to its inability to detect problems during its regular supervision. This shows that the periodic supervision carried out by the OJK is not yet effective.

An agreement should meet requirements regulated in Article 1320 of the Civil Code, and agreement for Sharia Pawnshop is without exception. The province of Aceh is the strongest base for Sharia pawnshop. There are two factors considered essential regarding the Sharia Pawnshop in Banda Aceh, i.e. the type of agreement between debtors and the shop and the settlement of default dispute. To examine those two factors, the author conducted an empirical study with a descriptive-analytical approach. The research results showed that the contract between the Pawnshop and the debtors was stated in the form, agreed upon and filled in by both parties.

This research aimed at determining and analyzing the implementation of profit-sharing concept in Islamic banking credit agreements based on regulations in force in Indonesia and also finding out the defaults undertaken by customers in Islamic banking credit agreements.
