Paolo Emilio Bensa: un civilista italiano di formazione (anche) pandettistica

Paolo Emilio Bensa's figure is representative of the peculiar dichotomy, which distinguishes Italian juridical culture in general and, very especially, Genoese one, between the 19 th and 20 th centuries. The typical attention paid to legal practice, mostly influenced by Napoleonic Codes and French methodology, is now associated with the latest influence of German Pandectist doctrine, providing an original approach. This paper presents a new perspective on Bensa's multi-faceted educational path, which led him from Genoa to Leipzig to follow Bernhard Windscheid's courses and paved the way for his peculiar scientific and didactic production, culminated in the translation of Windscheid's Lehrbuch. RÉSUMÉ: Le portrait critique de Paolo Emilio Bensa est représentatif de la dichotomie particulière caractérisant la culture juridique italienne, et génoise en particulier, entre le XIX e et le XX e siècle. L'intérêt typique pour la pratique, généralement influencée par la méthodologie et le code français, est à présent associé aux plus récentes suggestions de la doctrine du Pandectisme allemand et donne vie à une approche innovante et originale. L'article se propose de présenter une reconstitution nouvelle de la formation hétérogène de Bensa, qui le conduisit de sa natale Gênes jusqu'à Leipzig, pour suivre les cours dispensés par Bernhard Windscheid, en posant les prémisses d'une tradition didactique et scientifique spécifique.

The polyptych made by Agostino De Marchi and Marco Zoppo for the Bolognese church of San Clemente in the Collegio di Spagna is a very early expression of the new Renaissance style in Bologna. The intention here – backed up by a re-examination of partly unpublished documents and stylistic analysis of the piece as a whole – is to sustain that the work of the woodcarver and the work of the painter were planned concurrently, and this determined a substantial continuity in terms of execution. The completion of the retable, including the painted part, can therefore be dated to no later than the spring of 1459, corresponding therefore with the final payments received by Agostino De Marchi. The study also focus- es on the distinctive techniques adopted by Zoppo and on his highly original capacity to mediate between the perspective and compositional innovations assimilated during his stay in Padua and the chromatic qualities of the Florentine “painting of light” which had arrived in Emilia thanks to the activity there of Piero della Francesca.
