Politik hukum hadir di titik perjumpaan antara realisme hidup dengan tuntutan idealisme. Politik hukum menyangkut sebuah cita-cita atau harapan, maka terdapat visi hukum yang ditetapkan terlebih dahulu yang kemudian bentuk dan isi hukum dibangun untuk mewujudkan visi tersebut. Urgensi keberadaan peradilan administrasi dalam mewujudkan Negara hukum mendorong pemerintah untuk membentuk sistem hukum dibidang peradilan administrasi, yakni melalui pembentukan Undang-Undang Nomor 5 Tahun 1986 Tentang Peradilan Tata Usaha Negara, yang merupakan fondasi bagi pembentukan Peradilan Tata Usaha Negara di Indonesia. Pada penjelasan Undang-Undang Nomor 5 Tahun 1986 disebutkan bahwa Peradilan Tata Usaha Negara diadakan dalam rangka memberikan perlindungan kepada rakyat percari keadilan, yang merasa dirinya dirugikan akibat suatu Keputusan Tata Usaha Negara. Secara prinsip, suatu negara diharapkan dapat memberikan perlindungan terhadap hak-hak asasi manusia warga negaranya.

The Political Law of Act Number 30 of 2014 on Government Administration regulates do administrative effort must be taken before sues to administrative court. This research aims to find out two matters. the first matter is to find out how the paradigm of Law Number 5 Year 1986 and Law Number 30 Year 2014 on decisions that are petitioned to State Administrative Officials (hereinafter TUN Officials). Second, to find out the legal implications of the differences in the position of decisions that are applied to TUN Officials based on Law Number 5 Year 1986 and Law Number 30 Year 2014. The following research results, (1) that related to the paradigm of Article 3 of the Law on State Administrative Court and Article 53 of the Government Administration Law, should be related to the type of decision.. (2) The legal implication of the decision’s differences that have been petitioned to TUN officials may allow confusion to occur when it is applied in the process of administering the government and also the process in court.

The type of research used is juridical normative, namely explaining various literatures and / or literature. research results in initiating ethical judiciary for state administrators in Indonesia, due to the increasing number of ethical code enforcement agencies in each branch of power. The Rule of Etich is an instrument that must be implemented for all citizens in the life of the nation and state, in initiating an ethical court in Indonesia it is very urgent. The urgency of establishing an ethical judiciary in Indonesia is due to philosophical factors as reflected in the Pancasila that all five precepts are ethical grounds, juridical factors as regulated in the 1945 Constitution and MPR Decree No.V1 / MPR / 2001, with this juridical foundation, it is clear that the organizers the state is obliged to behave properly. While the sociological factor is the increasing number of ethical code enforcement agencies in each power clump, therefore the consolidation of ethical code enforcement agencies and the establishment of ethical courts is urgent due to the weak adjudication process of the Institute.
