The chapter comprehensively examines gender inclusion in the Argentinian constitutional and legal framework and practice. We begin with a historical account of women’s exclusion in the 1853 Constitution and their gradual incorporation from the middle of the twentieth century. Then, we continue with an analysis of the incorporation of gender equality and a gender perspective in the Argentinian constitutional framework through the constitutional reform of 1994. We also review the different administrations’ public policies in this area. Finally, the chapter seeks to approach the interpretation of gender equality clauses: what has been done and what has been lacking to incorporate and effect gender equality in Argentina.

Judicialization in Argentina: Legal Culture or Opportunities and Support Structures?

This article shows that the institutional design of Argentine federalism allows for differences in the protective scope of the provincial domestic violence laws. It holds that the broad legislative capacities of subnational districts enable the working of political and social local factors, which, in turn, determine heterogeneity in these laws' protective scope. It analyzes, compares, and measures 37 laws on domestic violence sanctioned between 1992 and 2009. It advances a methodology to measure their differences and it evaluates the impact local factors have on legal variations across jurisdictions. The article shows that the protective scope of these laws is determined by the intensity of the local electoral competition and by the strength of women's organizational capacity. Results also show that time matters insofar as it allows for the diffusion of more protective laws.
Argentinean Legal Education: Curriculum and Pedagogy
This work is divided into two sections. In the first one I will describe the Argentinean university system and some of its unique features, such us democratic elections of its authorities, with the participation of some of the national political parties, and joint governing bodies, which have an impact on legal curriculums. Secondly I will depict the research system since its short life and weaknesses determine the possibilities of our work. Finally, this first section is devoted to the pervasive model of legal research and its relations with the pitfalls of our university and research system. In particular, I will refer to lawyers’ notion of law studies as science. In the second part I will show some of the results of a research I conducted on how law is taught in the Law School of the National University of Rosario (U.N.R.). My work followed the previous research conducted in the Law School of the Córdoba National University, (U.N.C.). Because research on legal education in my country is scarce I will start the section with a very brief state of the art of this topic. To conclude, I will concentrate the attention on some of the aspects of the research with special attention to the curriculum and pedagogy analysis following the concepts of Basil Bernstein’s sociological theory of education.
GENDER INEQUALITIES IN LEGAL OCCUPATIONS

The present article seeks to analyze empirically how the educational effect of women in higher education Law courses affects their insertion into the formal labor market. To achieve this goal, we used data from the Relação Anual de Informações Sociais [Annual Social Information Report] (RAIS) to analyze all occupational fields that require legal training. The data show that women were already the majority as court clerks and the like, and became the majority in private law from 2010 onwards. As for the income received, controlled by other variables, women tend to earn less than men in the same occupations, with higher incomes only among public prosecutors and lawyers.

The article analyses the situation of women in the legal professions in Argentina, with special reference to the Argentine judicial system. It enquires into the context of the main socio-legal transformations that allowed Argentine women, initially, to access higher education, professional practice and political citizenship and, later, to access the rights that provide the framework to have a life free of gender-based discrimination, including the cluster of LGBTI+ rights. It describes the incorporation of gender mainstreaming into the legal and institutional universe of legal professions in recent decades. Lastly, it reflects on two dimensions of gender-based discrimination that still prevail: that of epistfemicide and that of the glass ceiling, and provides some keys to design strategies for its eradication.
