Indonesia legal policy of the simultaneous local election to appoint a district head had been amended by Law Number 8 of 2015 concerning the local election (governors, regents and mayors) from the regular models to the simultaneous models. Simultaneous local election will be implemented in periods, namely a first period in 2015, a second period in 2017, a third and fourth period will be approximately held from 2018 to the 2021, and a national simultaneous local elections will be held in 2027. The simultaneous local election is aimed to make the efficiency and effectiveness of the budget, time and labor organizer; to eliminate boredom voters; to increase public control. The simultaneous election is a strategic step to strengthen the process of institutionalizing democracy in Indonesia, for example, about enhancing the presidential system. The existence of parallelism between the executive and legislative power, for instance, makes the political systems and processes running more stable than before. It can be achieved, among others, by holding of the elections simultaneously. However, it is not easy to realize it. There are at least three challenges to make elections simultaneously as a road to strengthening democratic institutions. Firstly, the modernization of political parties. There is hardly any political party in this country that is truly modern. Some characteristics of current political parties at least can be seen from three aspects: first, recruitment of members. In this context, the main problem is the pragmatic consideration that often stands out, for example, a person who has a high popularity or financial capital were prioritized despite having weak political capability; Secondly, the election of KPU and Bawaslu commission. Until nowadays, this process is still not free from the problem of impartiality and lack of professionalism that is undoubtedly very influential in the election process. Thirdly, public or civil society. The issues related to it are the phenomenon of money politics (vote buying), and so forth. Those are the three threats faced by the simultaneous election about the strengthening of democratic institutions. It is in this context that it needs for the continuity of political literacy efforts at its various levels so that the purposes of the simultaneous elections are in line with the public expectations.

This article will examine and explore the urgency of the state's civil apparatus to be neutral in the simultaneous local election. State civil apparatus is an apparatus that works to serve the public interest rather than serve a particular group. That is why the need for the construction of constitutional law in an effort to create regulations in order the state civil apparatus has to be neutral. The construction by progressive constitutional law is by looking for new ways or role breaking and innovative breakthroughs, if the normal way and normative unable to immediately realize the objectives of the simultaneous local elections. There are three ways: First, to revoke the right to vote of state civil apparatus in the general election. Second, models political apointee bureaucracy in the local government. Third, change the model of career guidance state civil apparatus fom government regional autonomy to the central government by rank or class.

The implementation of democratic elections in accordance with the principles of the election, then it is very necessary function of oversight by the Elections Supervisory Institution to carry out the function of oversight over the organizers, participants and the public (constituent). As it turns out in practice, however, it has certain weaknesses, particularly in view of the accountability and legitimacy aspects of its establishment. In fact, the dispute settlement authority granted to the Election Supervisory Institution is limited. The type of research in this article is a normative-legal research or also called as doctrinal research. This legal research was conducted by examining library materials or secondary and primary materials. The results of the research indicated that the legal position and function of Election Supervisory Institution deemed important presence in the general election.In order to ensure the implementation of democratic elections in the future it is very necessary to election oversight body through setting in concrete in the Constitution as the highest law.

Past-approval of government regulation in lieu of Law No.1 of 2014 concerning the election of governor, regent, and mayor (hereinafter called local election), In accordance with the decision of the Constitutional Court Number 97 /PUU-XI / 2013, the Constitutional Court is no longer authorized to resolve disputes on direct election results, because the provisions of Article 236C of Law Number 12 Year 2008 NRI are against the Constitution of 1945. Article 157 paragraph (1) Law No. 8 Year 2015 determines that the dispute settlement on direct election results become the authority of specialized judiciary.
