The article deals with the problems of determining the concept of “public official” and definiteness of terms in the context of enforcement of the United Nations Convention against Corruption. The author carried out the analysis of the specified category, identified its attributes and features of the international legal enshrinement both in the text of the Convention, and in the text of other international legal acts in the field of anti-corruption, mainly of regional value . The object is public relations that are directly related to the settlement of the principles of "external" activity of public servants. The subject is the anti-corruption standards of legal regulation of "external" activities of public officials. Research methodology is shaped by both general scientific and special methods of scientific research. The basic is dialectical analysis, semantic, comparative-legal, logical-legal, modeling, forecasting are also used. The following conclusion can be made. The purpose of analyzing Limitation of Administrative Law Against Abuse of Authority in Corruption. The type of research used in this research is normative legal research or doctrinal legal research. The results of the study, First, the nature of the element of abuse of authority has similarities with the element "against the law" in the Corruption Eradication Act, which is both formally and materially against the law. The research recommendation is, the presence of Law Number 30 of 2014 should be able to become a benchmark for KPK investigators not to arrest the investigation of the defendant before the decision from the State Administrative Court, it is also necessary for the Supreme Court to issue a PERMA which contains provisions regarding the necessity of law enforcement officers comply with the decision of the Administrative Court which states that a Government Official has no abuse of authority not to proceed to criminal proceedings.
The Nature of Sentencing Against Private Legal Subjects as Perpetrators in Corruption
Background: The mode of criminal acts of corruption is growing, such as using private legal subjects such as legal entities to commit corruption crimes. This creates difficulties in law enforcement, especially in determining the legal subject of the perpetrator and criminal responsibility. This study discusses (a) What is the nature of punishment for private law subjects as perpetrators of corruption; (b) How are the restrictions on private legal subjects as perpetrators of corruption crimes; (c) What is the ideal concept of limitation on the limitation of private legal subjects as perpetrators in the criminal act of corruption. Materials and Methods: This research is a normative legal research using a statutory approach, an analytical approach and a legal conceptual approach to cases that are relevant to the research object being studied. The data used in this study is secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The theory used in this study is the Theory of Legal Authority, Theory of Legal Functions, Theory of Approach Models in the Integrated Criminal Justice System and Theory of Law Enforcement. Results: The results of this research indicate that (a) The essence of punishment in criminal acts of corruption based on Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 is cumulative punishment which includes corporal punishment, refund of state losses, confiscation of goods originating from criminal acts. corruption (primary punishment and additional punishment), while the nature of punishment for private law subjects is in addition to corporal punishment and refund of state financial losses, also administrative sanctions in the form of revocation of permits and certain rights against corporations (b) Setting restrictions on private legal subjects as perpetrators of criminal acts of corruption by taking into account the principles of governance of private legal entities to find out the party who committed the act and is responsible for the act. (c) The ideal concept of limitation on the limitation of private legal subjects as perpetrators in corruption crimes is to pay attention to the principle of error (culpability principle) which is a partner of the principle of legality in accordance with the principles of governance of private legal entities. Conclusion: Therefore, the limitation of private legal subjects as perpetrators in corruption crimes should be stated explicitly in laws and regulations so that certainty in law enforcement takes into account the principles of governance of private legal entities. Thus, Public Officials must be guided by the principles of good governance in order to avoid mistakes and comply with the application of the principle of legality, namely the principles of governance of private legal entities that result in losses to state finances or the state economy.
The Analysis of Corruption in Public Administration - a Quantitative Method

By studying the legal practice in the field of criminal provisions application regarding the prevention of and fight against illegal trafficking and consumption of drugs, the authors observe that in art. 4 of Law 143/2000 regarding the illegal drug holding for personal use, the interpretation made by the legal organs is not unilateral, two points of view taking shape. Thus, it is considered, from one point of view, that the infringement stipulated by art.4 of Law no. 143/2000 1 regarding the illegal holding does not subsist when a person who acknowledges that he/she is a drug consumer is caught by the police when he/she wishes to buy drugs for personal use, and prohibited substances subject to national control are not found on him/her. According to the other point of view, it is considered that this infringement subsists even when a drug consumer admits having consumed such substances subject to the national control, even if such substances where not found by the police on him/her or at the personal residence. The authors analyze the two points of view and give a series of solid arguments showing that the interpretations based on which it is considered that the lack of existence of the material object of the infringement regarding the illegal holding, the act does not meet the constitutive elements of the infringement stipulated by art. 4 of Law 143/2000 is correct and legal.
The Futuristic Concept of Abuse of Authority in Criminal Acts of Corruption

As a concept, the term "abuse of authority" is used by 2 (two) legal regimes, namely by the administrative law regime and by the criminal law regime of corruption, both legal regimes are public law. The impact of using the concept of abuse of authority by 2 (two) different legal regimes on the same concept/term in case of abuse of authority is the birth of concurrent jurisdiction between the State Administrative Court and the Corruption Court. Concurrent jurisdiction over the same material by 2 different judicial institutions. After the enactment of Law Number 30 of 2014 concerning Government Administration, especially Article 21 according to the author's observation, there have never been cases of corruption cases filed by the special Public Prosecutor concerning the indictment of Article 3 of Law 20 of 2001 concerning Amendments to Laws-Law Number 31 of 1999 concerning the Eradication of Corruption has been tested beforehand regarding whether or not there is an element of abuse of authority by the State Administrative Court. This situation shows that the application of laws and regulations is faced with two things, namely "performance" (validity) and usability (efficacy). While usability is related to whether the norm is adhered to or not.
Čepas A., Dobryninas A. Criminalization of Corruption: Philosophical and Legal Facets
The article discusses philosophical, historical and social issues of corruption. The authors analyse the peculiarities of perception of corruption in different paradigms of criminal justice: classical, positivistic, and constructionist, as well as its respective interpretation in terms of vice and sin, wrongful conduct, or conflict between public and private interests. The analysis presented allows to conclude that criminalization of corruption has its own legal logic and reflects existing social cultural context, and due to this reason cannot be considered to be a universal instrument of dealing with conflicts between public duties and private interests.

The intensification of the European political and economic integration also requires that our country contributes to continuing the tradition of incriminating criminal deeds perpetrated in the business field. Romanian authorities display their constant interest in expanding their knowledge of the crime phenomenon in this field, while looking to identify effective means to control it. Within this context, corruption crimes approached in the Criminal Code of Law and in Law no. 78/2000 take a distinct place within the group of crimes for which prevention and combating is regulated under the Business Criminal Code of Law. In order to ensure celerity in solving criminal cases involving corruption crimes, certain derogations from the usual procedure were required, as well as enforcement of a special procedure; also, specific procedural aspects regarding corruption crimes need to be retained as we look at the coming into force of the new criminal and criminal procedure legislation.
