E-Commerce Based on the Law of Buying and Selling in Islam

The digital era that is growing so rapidly affects the sales system in the world. With the industrial revolution 4.0, e-commerce is rapidly expanding to meet the needs of millennial. However, from the estimated E-Commerce sales there is less trust in E-Commerce based on sharia law. Transaction in the E-Commerce needs to be studied in Islamic law to provide a legal basis for the transaction. Many discussions need to be discussed regarding E-Commerce, starting from transactions, payment systems, producer rights, consumer rights and the law of buying and selling E-Commerce itself. This study aims to find out how the law of buying and selling contained in Islamic E-Commerce and whether the payment system and the rights of consumers and producers are also in accordance with sharia. This study uses literature qualitative research methods with resources taken from secondary sources in the form of books, journals and rules of law relating to buying and selling. This paper uses descriptive analysis content. The results of this study indicate that Islam supports E-Commerce in order to continue to develop based on sharia principles.

Issues concerning purchasing on-line, the medium of transaction via on-line or Internet, e-payment mode are among new challenges that require Islamic scholars and researchers to broaden the scope of definition of Shariah compliance e-commerce transaction. As Malaysia is heading towards e-commerce and purchasing on-line has no longer a new trend; the challenges arise for solution in accordance with Shariah principles. This paper will propose a model that comprises several components namely, the core Shariah component itself, sound technological means and regulatory body that supports e-commerce transactions.
Formulation of Business Fiqh Contemporary (Formulation of Sharia Maqashid E-Commerce)
The formulation of Islamic law is based on a universal-humanity foundation, covering worldly and hereafter interests, aiming to make people happy protect them from evil and destruction, and Islam is suitable in various conditions, times and places. There is a greater difficulty if the development of Islamic law does not want to go through the path of the goals of Islamic law, or at least the general principles of Islamic law. Therefore, in the development of Islamic legal thought, thinkers are relatively quick to agree on ‗mashlahah' as ‗maqashid sharia' or what is more popularly known as the goal of Islamic law. More than that, maslahah in its development is not only a legal goal but also becomes a proposition in the formulation of Islamic law itself. The importance of research based on Islamic legal philosophy through the maqashid sharia of electronic commerce (e-commerce), because it is a modern trading model, not discovered by researchers in classical fiqh, and even contemporary fiqh before the 1990s, in Indonesia e-commerce began in the early 2000s. This qualitative research paradigm and its type of normative legal research used secondary data traced and obtained from libraries and internet sites to find new arguments regarding the formulation and purpose of Islamic law on ecommerce.

Abstract In e-Commerce, sales contract is a vital element in the trading and selling of commodities and in the provision of services, resulting in increased production and profit. Sales contract assures that commodities are efficiently delivered to consumers with consideration towards consumer needs, and supply and demand. This study examined one major issue relating to sales contract in e-Commerce, a vital mechanism in economic development, by combining sales contracts on products and services. For consumer protection, Jordanian legislators should ratify rules and regulations to govern the practices between parties. A descriptive analytical method was applied in this study for its suitability in legal provisions initiation. Analyses were performed to attain outcomes that will fill the research gaps concerning sales contract aside from determining a legal way for contract in e-Commerce. In Jordan, the lack of legal regulatory framework that stimulates sales contract has caused issues among producers, distributors, and consumers. The Application of Khiyar Principles to E-Commerce Transaction: The Islamic Economy Perspective

This essay seeks to analyze the utilization of khiyar in e-commerce transactions within the context of Islamic economics. The principle of khiyar allows individuals to exercise the option to either proceed with or terminate a transaction. This theory is applicable to various types of buying and selling transactions, including those conducted in the realm of e-commerce. This study employs a normative legal methodology with an Islamic economic perspective, which is evaluated descriptively. The data was gathered through an extensive analysis of literary sources, including journal articles, books, journals, legal documents, and other relevant references pertaining to the topic of discussion. Islamic economic theory is applied as an analytical framework to examine the concept of khiyar (option) in the context of buying and selling in e-commerce transactions in Indonesia. The research findings indicate that the utilization of khiyar in e-commerce transactions, in accordance with the Islamic law, is permissible as long as it adheres to the prerequisites and fundamental principles of buying and selling. These include honesty, fairness, and the absence of any fraudulent elements. However, if harm is inflicted upon one of the parties involved, the transaction becomes unlawful. In the Islamic law, there is a rule stating that all forms of muamalah transactions are permissible, as long as there are no contradictory arguments prohibiting them. The contract and payment mechanisms in e-commerce transactions are considered to be in accordance with Islamic law and contain benefits, also in line with the opinion of the ulama in the fatwa of the Indonesian Ulema Council. From an Islamic economic standpoint, engaging in e-commerce transactions for buying and selling is sufficient to contribute to the nation's economic expansion, particularly benefiting the middle class and streamlining transactions

The use of information and communication technology for online commercial transactions may pose some Shari’ah issues. Whilst several studies have elaborated the issues from Islamic viewpoint, none of them provides an empirical investigation on e-commerce transactions in the light of Islamic law of contract. Thus, the objectives of this study is firstly, to examine the permissibility of online transactions from the Shari’ah perspective, particularly in the context of Islamic law of contract, and secondly, to analyze whether or not e-commerce transactions satisfy the Shari’ah requirements. Sharia Compliance Requirements Framework for E-Commerce Systems: An Exploratory Study

There is a growing concern among Muslims over the need to ensure Sharia compliance in e-commerce transactions. Because non-conformity to Sharia principles can result in a lack of trust and a barrier for many Muslims to partake in e-commerce transactions. However, there is currently no comprehensive and clearly specified Sharia compliance requirements guideline for e-commerce systems. Therefore, a need to explore and develop a comprehensive guideline for Sharia compliance requirements in e-commerce systems. In this study, an exploratory qualitative study involving eight semi-structured interviews with Sharia compliance scholars/experts was conducted. Consequently, a conventional content analysis of data was carried out with the aid of QSR-NVivo 11. People could buy commodity-like products and digital products simply from Internet, and get these products sent to their homes or them online. This era is called the E-Commerce era. A lot of conferences and seminars were held pertaining to the e-commerce but only a few brought up matters about e-commerce in the Islamic perspective. To fulfill this gap, the paper will highlight the framework of Islamic E-commerce stressing the key success factors to ensure the successful and the challenges that the Muslims would be facing.
