Technological developments and Covid 19 Pandemic "forced" the Supreme Court (MA) to make breakthrough in procedural law, namely by launching E-Court application, through MA rules Number 3 of 2018 which was exchanged for rules Number 1 of 2019 concerning Case Administration and Trial in E-Courts. Based on the Decree of the Secretary of the Supreme Court of the Republic of Indonesia Number: 305/SEK/SK/VII/2018, the Supreme Court has chosen 17 District Courts, 6 State Administrative Courts and 9 Religious Courts as the Pilot Project Court for the e-court Application. The purpose of this study is to examine and analyze the effectiveness of the virtual criminal justice process in the Covid-19 pandemic conditions on the workings of the criminal justice system in the courts.. This study uses a normative juridical approach. Based on the research, it can be concluded that the practice of online trial, known in the Supreme Court as e-Litigation, will not be effective if Act No. 8 of 1981 concerning Criminal Procedure Code (KUHAP) does not change. The principle of the presence of the defendant (in absentia) in the Criminal Procedure Code is contrary to the practice of elitigation, if e-litigation is applied to criminal cases. Meanwhile, the Circular Letter of the Supreme Court of the Republic of Indonesia Number 1 of 2020 does not allow criminal cases to be examined through the e-Litigation application. These things cause the implementation of online court proceedings in Indonesia to not be effective, where regulatory developments are stagnant and there is disharmony between regulations. If the stakeholders do not immediately address, then this problem will cause quite complicated and complex problems in the future. On the other hand, conducting online trials is the only way out during the Covid-19 pandemic so that the settlement of criminal cases under the Supreme Court does not stop.

The objective of the e-Courts project is to revolutionize the application of Justice in Brazil by making the whole process of justice available twenty-four hours a day, seven days a week via the world-wide web. It is a new way of managing juridical knowledge with integrity, quality and faster distribution of information, making the access to Justice easier and speeding up the whole judgement process. The proposal is innovative both in terms of its strategy for juridical knowledge management, as well as in terms of the technology to be applied. Technology-based companies, State Courts of Justice, Universities and Investment Funds are involved in the process of turning the project into reality.

Strategic Policy for The Development of Electronic Judiciary in Indonesia During the Pandemic Period

The Electronic judiciary is a policy issued by e-court launching. This was to address global challenges as well as to realize the acceleration of case management. During the pandemic, litigation becomes hampered because it has to reduce physical contact in implementing health protocols. Therefore, the problems of case management that were previously done offline should begin to be diverted by optimizing the function of the e-court. Thus, the implementation of technology information is very important to ensure the court running process. The development of electronic judiciary is carried out by comparing with several countries to become evaluation and reference material. The goal is to make the electronic judiciary more accessible and easier to use by the public. The method used is a qualitative approach with policy conceptual comparison. The result is that the e-court must be able to facilitate up to the administrative process, the trial, until the verdict.
Reconstruction of E-Court Legal Culture in Civil Law Enforcement

Legal protection for the community to obtain rights and recovery of the situation is one of them taken by settling civil cases through the courts. During the times and the adjustment of existing conditions, the Supreme Court issued a responsive and progressive law with the enactment of Supreme Court Regulation Number 1 of 2019 so that the public could obtain essential justice based on the principles of fast, simple, and low-cost justice. The aims of this study are: (i) knowing the legal culture in the implementation of e-court as a reflection of the problems of law enforcement; and (ii) reconstruction of legal culture regarding case administration and court proceedings electronically. This study aimed to compare the religious courts’ service quality using qualitative methods with the PIECES analysis approach. They electronically facilitated proceedings through the e-filling application or online case registration, e-payment of litigation fees, e-summons, and e-litigations. The courts achieved this through Supreme Court Number 3 of 2018 concerning the Administration of Cases in Courts Electronically, complemented by the Regulation of the Supreme Court Number 1 of 2019 concerning the Administration of Cases and Trials in Courts. The results showed that all services at the Class IA Religious Court Tulungagung have used the e-Court application.
