Prevention of Violence Against Wife In The Household (Human Rights Perspective)

This paper aims to find and discuss new ideas or thoughts in preventing violence against wives in the household. This research is a normative legal research, the type of research is descriptive analytical. Sources of Legal Materials used are primary legal materials and secondary legal materials. The technique of collecting legal materials is through a library research on legal materials, both primary legal materials, secondary legal materials, then analyzed qualitatively on the problems, as well as conducting an inventory and systematization. The results of this study found several new ideas in an effort to prevent before the occurrence of domestic violence, including 1) as part of a legal society we must help each other in creating a “harmonious household” 2) provide understanding to husbands that domestic violence against wives is a crime that can be subject to legal sanctions, 3) help instill good religious values for men in this case is the husband 4) Build a positive mindset for men as husbands to fight egoism and believe that violence against wives is something that is prohibited 5) The role of religious leaders in this case is every couple who is getting married must at least carry out premarital counseling for 3 (three) months, and 6) be aware that domestic violence committed to the wife will have a psychological impact that is not good for the wife, especially the child's psychology.

This study aims to describe the position of women in the family/household, violence against women, as well as how the protection of laws against women victims of domestic violence. This research is the juridical normative and prescriptive. In a family, woman as the wife is a member of the family besides father and son. Women have the same position with the other family members, including equality in rights and opportunities as well as the protection of rights in the field of civil, political, economic, social, cultural, and other fields. Violence against women is a violation of the rights of women in the household. The birth of the Domestic Violence Act, Number 23, the year of 2004 was the protection of women, carried out based on the principles of respect for human rights, justice, gender equality and non discrimination. Protection is based with a variety of considerations, among them is that every citizen has the right to get a sense of security and freedom from all forms of violence.

The domestic violence is a bitter reality of all humanity e a phenomenon which has taken worrying dimensions for the society. The domestic violence is increased during last years not only as phenomenon with social, economic and psychological consequences that impacts significantly the human rights.The extended transition has created more social and economic issues on all democratic societies, but in our country it is not ended for a long time. Women are treated as second class citizenry. They are in back seat far from the men. Though the half of the world's population is women, still they suffer even today, the course of discrimination. The women comprise 66% of the world's illiteracy and 70% of the world's poor. Therefore, the problem spells for establishment of a just and equitable social order, where nobody can be treated or exploited by another as unequal. This study is to undertake the nature, extent and incidence of domestic violence against women and to find out the impact of Hindu Succession Act (Amendment) 2005 in domestic violence because the Act has opened the doors of equal rights to their male partner in ancestral property. My study will examine condition or instigating factor for domestic violence and machinery involved in solving the problems of the abused women.
