This entry is devoted to a survey of the main analytical conceptions of legal science. The focus will be in particular on (1) Alf Ross’s legal realism and his neo-positivistic approach to legal science; (2) Norberto Bobbio and the Italian analytical legal philosophical school, which firmly tie legal science to language analysis; (3) Herbert Hart and the analytical philosophy of ordinary language, and, eventually, (4) Ronald Dworkin and the interpretative turn.
The British Tradition of Legal Positivism
A Companion to Legal Positivism, 2020
This essay traces a thematic thread through broadly Anglophone legal philosophy since the seventeenth century. Ownership of the title “positivism” is contested in contemporary Anglophone jurisprudence. If we to take the core theses embraced by contemporary legal positivists to identify the key figures in their tradition the story would be very brief, starting, perhaps, with Hart. Hence, rather than tracing a line of development of a coherent jurisprudential tradition, this essay sketches in broad outlines the transformation of Anglophone legal philosophy since Hobbes. However, it begins with a brief discussion of the headwaters of Anglophone positivist tradition in the “thetic” tradition of legal theory in late medieval jurisprudence and in the practice and theory of English common law and ends with a discussion of Salmond and other twentieth-century jurists who paved the way for Hart’s contemporary version of legal positivism.

One Myth of the Classical Natural Law Theory: Reflecting on the “Thin” View of Legal Positivism

Much controversy has emerged on the demarcation between legal positivism and non-legal positivism with some authors calling for a ban on the-as they see it-nonsensical labelling of legal philosophical debates. We agree with these critics; simplistic labelling cannot replace the work of sophisticated and sound argumentation. In this paper we do not use the term 'legal positivism' as a simplistic label but identify a specific position which we consider to be the most appealing and plausible view on legal positivism. This is the view advocated by Gardner in his paper 'Legal Positivism: 5 1 =2 Myths' (Gardner 2001, 199), where he carefully scrutinises the most convincing and unifying postulates of legal positivism, which he calls "the thin view". The study shows that this thin view presupposes an empirical conception of action that is untenable and implausible since it makes acts of engagement with the law unintelligible to an observer of such acts.

In this article, I argue that the debate between contemporary legal positivism and contemporary natural law philosophy must be understood in terms of underlying assumptions about the nature of philosophy. Despite differing conclusions about the nature of law and legal theory, contemporary legal theorists generally approach the study of law in a similar way. Generally speaking, contemporary legal theorists attempt to provide general accounts of law which are theoretically valuable. They believe that a general and theoretically valuable account of law can be achieved by bracketing-off metaphysical questions and focusing on the analysis of concepts. However, it is ultimately because contemporary legal theorists share assumptions about the nature of philosophy that they share similar problems. Because of these share assumptions, contemporary philosophers of law must choose between two alternatives which have limited theoretical value, namely, an overly formal account of law or a relativistic account of law. Thus, this article is not only a critique of specific contemporary legal theories (those of Dworkin, Hart, Raz and Finnis), but also a more general critique of contemporary legal philosophy as a whole. Only by challenging the basic assumptions which underlie contemporary legal philosophy can we hope to provide accounts of law which are both general and theoretically valuable. INTRODUCTION The traditional debate between natural law and legal positivism is relatively easy to understand. It is easy to understand because the contrast between the two sides was sharp. Traditional natural law philosophers were Thomists in the full sense of the word. They accepted not only Aquinas' position on natural law, but also the metaphysics and epistemology which, they thought, were presupposed in his account of law. Traditional legal positivists were followers of Bentham, and they accepted not just his proposal for the separation of law and morality, but also his reasons for this separation. Traditional legal positivists shared Bentham's distaste for metaphysics and for the pretentions of an ethics grounded in metaphysics and religion. So, the traditional debate between natural law philosophers and legal positivists was a more fundamental debate about the nature of morality and the place of metaphysics in philosophy of law.
Philosophy of Law in Analytic and Continental Traditions
This paper is concerned with understanding the nature of law itself and the role justice and a system of values plays with respect to law. The analytic tradition or positive law doctrine proves useful in the attempt to obtain an understanding of the nature of law itself; that is, what law is in the most literal sense. The theory of natural law is useful for understanding what role morality and justice play within the framework of legal theory. However, both doctrines have tended to exclude the other at face value, so a deconstructionist approach has proved the most useful in the attempt to grasp the answers for which I have been searching, vigorously, in that it seems to tie the theories together in a plausible manner. In addition to discovering the meaning and nature of law, it seems even more useful to discover its purpose and application. That being said, a useful issue to apply these theories to is the issue of corporate personhood. In this paper, I shall attempt to first explore the different theories as mentioned above in order to obtain a sense of what justice is and how law works, and secondly, I shall apply the theories to the issue of corporate personhood, specifically focusing on its ties to political spending.
Legal philosophy, legal theory — and the future of theoretical legal thought

Surveying the ways-along with the whys and hows-of connecting law and philosophising, as contrasted to the appearances of modern formal law, it is concluded that in the final analysis law is a façon de parler-a specific communication, or game carried out in an open scene-, an actual event, if one played by humans practicing whilst simultaneously referencing it. The contemporary outcome of reflection upon its developments is (1) the reduction of legal philosophising to discourse-reconstruction, in terms of which instead of the issue of "what is it?", "all that notwithstanding: how can it be achieved?" is usually raised; (2) the unresolved enigma of natural law, calling for axiology to define at least some foundational standards as stepping stones (albeit without a claim that any statement has genuinely concluded from them or been subordinated to them, as in the classical era when natural law and positive law were at odds); and (3) positive law without legal positivism, according to which a new synthesis and correlation amongst humans' natural, societal and intellectual worlds is expected to be reached. At the same time, flourishing at the peripheries, a genuine foundation is coming to the fore, in order to suitably respond to global challenges.
