An Appraisal of the Concepts of Delayed and Cancelled Flights in International Carriage by Air

International and domestic carriage of passengers by air are on a daily basis confronted by the twin challenges of delay or cancellation of scheduled flights. Whereas delays and cancellations of scheduled are in some instances unavoidable and absolutely necessary, the rate at which the passengers goes through these experiences have created doubt in the inevitability or otherwise of malaise. Strictly speaking, delay is the late performance of a scheduled flight. Cancellation is the non-performance of a scheduled flight. Because cancelling a scheduled flight should ordinarily attract more severe consequences than delay, some airlines preferred to be accused of delay than cancellation. A case of cancellation may thus be confused for delay to the detriment of air passengers. This paper is intended to clarify the difference between delay and cancellation of scheduled flights, for the purposes of compensation to the passengers and the liability of the air carriers.

In this case about two fictitious airlines, RegionEx, a small regional airline, is a contracted regional carrier for MississippiDelta Airlines (MDA), a major U.S. airline. In September, RegionEx exhibited a worse flight delay record than MDA, and is now at risk of losing its contract. The flight operations manager at RegionEx is tasked with analyzing the flight delay records and explaining RegionEx's seemingly poor performance to RegionEx's chief operations officer. Reflecting the recommendations of the Guidelines for Assessment and Instruction in Statistics Education (GAISE) published by the American Statistical Association, this case emphasizes statistical literacy and conceptual understanding of data analysis rather than rote procedures. The Air Transport Inspector carries out supervision according to objects and events directly in the field. Supervision carried out by the Air Transport Inspector is very important in order to maintain security and safety during operations at the airport. The purpose of this study was to determine the effect of supervision and the results of monitoring delays by the Air Transport Inspector at Soekarno-Hatta International Airport. This study uses a qualitative method. Data collection was carried out at the Regional Airport Authority Office. Data was obtained from observations, interviews and documentation. Primary data sources were obtained from interviews with 5 (five) informants consisting of the Head of the Air Transport Section and 4 (four) Air Transport Inspectors. This article describes and analyzes a case study of flight delay and the rejection of compensation to the passenger under the argument of extraordinary circumstances. The article first describe the delay in British Airways flight from London to Amsterdam; the regulatory framework that governs compensation for aviation delay in the European Union and in Canada; and analyse the case study in light of the regulatory framework. Finally, the implications with respect to the regulatory agencies involved are considered and recommendation to improve the regulatory regime are offered.

Analyzing the case of delayed crises and cancellation of Lion Air flight schedules
To analyze the case of crisis delays and cancellations by Lion Air flight schedule, I used the theories of information seeking. Informastion seeking theory is a theory that discusses the information search as many made by the audience to meet the information needs of the media to compare one with the other media to get the right information or appropriate. Media as a source of needed information certainly becomes the choice of audience or passengers. Passengers who felt disappointed with delays and cancellations made by Lion Air trying to find as much information on the reason of Lion Air delay and cancel flights. Information search process has different impacts to each passenger. Not all passengers are feeling enough with the information received that the prospective passenger amok and damaging the airport's facilities. Loss and disappointment felt passengers over the incident needs to be responded positively by related parties, therefore passengers compared the right media, which can be rated as a medium that has credibility. From the information obtained from the media can be considered the inaugural information on Lion Air's negligence that has laid waste to its passengers, so that the audience or passengers can determine the next steps for conducting a complaint over the losses and disappointments to the Lion Air, the Angkasa Pura and Minister of transport as the institution that gives permission to the Lion Air flight. In paragraph ten explained that the Directorate of Airport Service, Lion Air, Daniel Putut, who attended a press conference it was explained, Lion Air management is ready to accept any sanctions as a form of their responsibility towards the customer. From that information, the passengers discover that Lion Air is responsible for the delays and cancellations, this is an attitude of empathy Lion Air loss and disappointment felt by passengers. Through the press conference, Lion Air using media as a channel to provide information to passengers regarding the actions and response performed by Lion Air. Jet Airways was founded by Naresh Goyal in 1992 after India opened its skies for private airlines. One of India’s finest and the biggest private airline company Jet Airways (India) Private Limited, which ruled the Indian skies till 2005 has been grounded and all operations are at a halt. The last flight of the airline was from Amritsar to Mumbai on 17 April, 2019 and since then the airlines is grounded. The company is in a debt of billion dollars and shutting down of the company has badly affected more than 20,000 employees. This case study analysis the reasons that led to the collapse of one the finest airlines in India. The findings and observations from the study give a conclusion report of problems faced by the airlines. The ultimate aim of the study is to find the causes for the downfall of India’s premier airlines Jet Airways.
