The article deals with two main problems. The first concerns the interpretation of the concept of "court" within the meaning of the provisions of Art. 47 CFR and Art. 267 TFEU. The second part is devoted to the analysis of judgements of the Court of Justice regarding the reform of the Polish judicial system. It enables one to draw several conclusions. Firstly, the Court of Justice found that Poland had violated its Treaty obligations by introducing the provisions that determine the retirement age of judges and establish the procedure enabling the extension of active service by virtue of the discretion of the President of the Republic of Poland. Secondly, the Court of Justice analysed the concept of "court" from the perspective of Art. 19, para. 1, subpara. 2 TEU. It emphasised that these provisions obligate the Member States to establish a system of legal remedies and procedures ensuring effective judicial protection in areas covered by EU law. It also stressed that this concerns a body that can only potentially settle cases with an EU element. Thirdly, the Court of Justice clarified the concept of judicial independence in the context of irremovability of judges and judicial impartiality. It formulated a certain test of judicial independence that should be conducted by the referring court.

Cases with international elements appear more and more frequently in the daily practice of Polish courts. They are related to the performance of the judging function (issuing judgments) and auxiliary activities (supporting the trial process, e.g. delivering correspondence, taking evidence abroad). Increasingly important in the judiciary is the correct and active application of European Union law, other international law and national law linked to foreign affairs. Polish courts and their staff are unable to handle international elements. Court employees are incompetent in the field of international services, avoid applying the rules of international law, and incorrectly perform international auxiliary activities. The problem is deficits in education, human and technical resources and the lack of connection with the outside world. Year by year, the Polish justice system alienates more and more from effective participation in international court cases. In the years 2016 to 2019, sociological and legal research was carried out among Polish lawyers, representatives of regional bar councils. As part of the interviews conducted using the method of in-depth structured interviews (SSI), a diagnosis, evaluation and explanation of the functioning of Polish court and non-judicial lawyers in the era of internationalization of the Polish justice system was made. The present article is an attempt to evaluate the international activity of Polish court lawyers (judges and other court employees).

Poland's progressive integration with the European Union has led to the extensive application of EU law within the Polish judiciary. This also applies to other acts of international law. The changes are clearly observed in civil procedure, where new instruments of EU and international law are increasingly applied. At present, in the Polish legal order we can observe 31 civil procedures created under the influence of international law, mainly of the European Union. The aim of their existence is to facilitate foreign turnover, including the creation of civil law effects in international relations. However, the scope of application of the new legal solutions in courts varies greatly. The effects of their application do not always correspond with the assumptions, and the practice of judges and other court employees differs from the normative reality. The main objective of the research was to discover and diagnose the practical application of civil procedure instruments introduced by international, mainly EU, law. Moreover, the essence of the research was to show the judicial practice of applying instruments of supranational civil law. Another important element of the considerations was to trace the scope of application of these procedures, the inclination of Polish courts to use them and the effects of the use of these procedures. The study was carried out on the basis of several research methods, of which the method of analysing the content of statistical materials led the way. The annual reports for 2020 of all district courts and a sample of regional courts in Poland were analysed. The analysis was conducted in terms of the intensity of application of all civil procedures introduced by international law, mainly of the European Union. This research method was complemented by the use of the functional method of examining legal acts, the method of analysing the content of the subject literature and the method of structured interviews (SSI) conducted among Polish advocates and legal advisers. The results of the study are surprising. It showed that Polish courts do not use civil procedures of international origin at all in their judicial practice. Nationwide, less than 1% of civil cases contain a foreign element. Most of the theoretically existing instruments in civil procedure are not known and used in courts. Flawed judicial technical tools also prevent full insight into the scope of application of international procedures. This state of affairs is influenced by macro and micro factors, only the latter of which is easy to eliminate.

Since May 2004 Polish administrative courts have passed a great deal of judgments in which the law of the European Union (formerly European Community law) has played either the main role or a subsidiary role in the proceedings. This article seeks to examine how the above-mentioned courts comply with the expectations which are put on them by EU law and how they participate in the process of legal integration within the EU. In this context, the author scrutinizes how the national judiciary adjudicating in the administrative law area understands, interprets, employs and applies the systemic principles of EU law such as: supremacy, and (in) direct effect and effectiveness. The purpose of the article is to present the fundamental rules and regulations constituting the position of the judge in Poland, which finds its basis first of all in the regulations of the basic law interpreted over the years by the Constitutional Court, but now – in the norms of international law. Moreover, the author included his thoughts on the issues of the legitimization of judicial power and its relationship with the legislative and the executive. Direct Application of the Republic of Poland’s Constitution in the Case Law of Administrative Courts

This article analyses the judicial decisions of the Polish administrative courts from the perspective of the principle of direct applicability of the Constitution. This principle, integrally connected with the highest legal force of the Constitution, is of fundamental importance in the process of reconstruction of the legal provisions carried out by courts. It takes various forms, including independent application of the Constitution’s provisions, co-application of the Constitution and other legal acts, and ascertainment of conflicts between the provisions of the Constitution and other legal acts. Poland: Current Debates on the Supervision over the Administrative Activity of the Common Courts

This article examines the institution of the supervision over the administrative activity of the courts of general jurisdiction (the so-called common courts) in Poland. This kind of supervision is performed in Poland by the Minister of Justice, judges seconded to the Ministry, as well as the presidents of the courts. The author considers the basic constitutional principles referring to the status of the judiciary and draws the reader's attention to the discussion on the current regulations concerning such supervision. The problem, first of all, lies in the ambiguous wording of the statutory regulations, which makes it difficult to clearly distinguish administrative tasks in a strict sense from duties connected with the dispensation of justice. Despite the friendly attitude of the Constitutional Tribunal towards the supervisory competences of the Minister of Justice, the author argues, like many scholars and judges in Poland, that the administrative activity of the common courts should instead be controlled by judicial organs (i.e., the First President of the Supreme Court on his own or with the cooperation of the National Council of the Judiciary). At the same time, the author is convinced on the necessity of pending general debates concerning the competence of executive power towards the judiciary in future.

The current crisis in the relationship between the Polish Constitutional Court and the Court of Justice of the European Union (ECJ) is of crucial significance for the process of regional integration based on the values of liberal democracy taking place in the EU. The constitutional crisis in Poland that began in the end of 2015 has challenged the systemic position of the Polish Constitutional Court. It resulted in a new model of constitutional adjudication, and in this new model the Constitutional Court, stripped of its counter-majoritarian power, cannot be perceived as the guardian of liberal democracy. This article postulates that the assessment of the present case law of the Polish Constitutional Court in European matters is made through the prism of the Constitutional Court’s jurisprudence pre-2016 (i.e. before the constitutional crisis).
