Forensic Science or Forensic Sciences? Conceptual analysis

Seven Editora eBooks, 2023

Science and justice need to interact to solve different situations. This interaction, however, needs to occur efficiently to avoid generating even more doubts. Scientific evaluation in the legal context must be understood and achieve its purpose. For this, much has been discussed about the nature and purpose of forensic scientific assessment. In this work, the aim was to evaluate what forensic science is and what is the conceptual alignment of this area of knowledge concerning national and international scenarios. We performed a bibliographic review on the subject to understand the fundamental aspects of this theme. Conceptual studies on forensic science are practically non-existent in the national literature. Forensic science was contextualized in its multi, inter, and transdisciplinary aspects. The quantitative results of the bibliographic review showed the urgent need for developing the theme in the national scenario and its alignment with the world understanding. Historical aspects of the development of forensic science were used in the discussion about the conceptualization of the term. Yet, internationally there are constant efforts to define the purpose and scope of forensic science. The Sydney Declaration was recently launched as a guiding document. We concluded that discussion about the concept of forensic science must be constant to improve it at the national level and to align it with international thinking. Hopefully, this work will encourage the discussion of the topic, strengthening the development of forensic science and reinforcing its importance for the administration of justice.

Science in Aid of Law

Crime is a deviant behaviour and to reform the erring citizen through appropriate punishment, all societies have a criminal justice system. Societies regulate the social behavior of their members through Laws, to ensure peace and tranquility in the society so that the citizens can enjoy the fruits of endeavors and their rights and freedom, Law takes every initiative to protect its citizen for that new methods/ modes are need to investigate the cases so that justice is seen to be done. Modern day criminal uses science and technology to his advantage in committing crimes. Consequently investigating officer is required to possess scientific knowledge and skills to investigate and unearth these crimes. Forensic science comes to their rescue. Forensic science is an umbrella term to describe the application of principles of science and technology in investigation of crime to enable the courts to determine the guilt of the accused. Science since long is in aid of Law. The principles of forensic science has enable the law enforcers to solve many seemingly unsolved blind criminal cases and also help the civil courts in determining many intricate and difficult cases. Theword forensic comes from the Latin forensic, meaning "of or before the forum." further to simplify it, it means a criminal charged presenting the case before a group of public individuals in the forum. Both the person accused of the crime and the accuser would give speeches based on their sides of the story. The individual with the best argument and delivery would determine the outcome of the case. This origin is the source of the two modern usages of the word forensicas a form of legal evidence and as a category of public presentation.

The Advancement of the Law from the aspect of Forensic Science

2022

The standards of acceptance of forensic evidence in trials are discussed in this paper. The scientific field of forensics is focused on demonstrating criminal acts. It indicates that an investigator acquires, analyzes, and evaluates all relevant data more about the offense. The investigator's most essential duty is to compile as many sources of evidence as feasible that pertain to a criminal offense. After the conduct of the crime, the investigation team seeks to collect as much evidence as possible from the crime scene. Their job is to go into every detail since even the tiniest proof may turn the case around. Forensic science has made significant contributions to criminal proceedings and other forms of brutal violence. There are several grounds for the Court's reluctance to employ forensic evidence for criminal investigations.

Forensic Science: A Boon or Bane for Criminal Justice System

Journal of emerging technologies and innovative research, 2018

Introduction Law is dynamic and not static and therefore, as society evolves, law has to keep in consonance with the changing social order. Law is the instrument of societal change and the judiciary has the responsibility of interpreting the law for the greater good. 1 Therefore, it is clear that the judicial mind must stay in touch and keep in step with the advancement of humanity. To combat organized crime, its detection, investigation and prevention method have to be employed synchronously. 2 If the criminals use new technology in committing the crimes, the enforcement agencies have to be used to the new techniques in solving such crimes. If the enforcement agencies do not use these new technologies for solving such complicated the crimes, it would be very difficult to detect the perpetrators of such crimes. Therefore, in the context of the changing organized modern criminal who are taking shelters behind and making full use of new sophisticated technologies .Krishna Iyyer J. Rem...

The Relevance of Forensic Science

There is growing consensus that there is a crisis in forensic science at the global scale. Whilst restricted resources are clearly part of the root causes of the crisis, a contested identity of forensic science is also a significant factor. A consensus is needed on the identity of forensic science that encompasses what forensic science 'is', and critically, what it is 'for'. A consistent and cogent identity that is developed collaboratively and accepted across the entire justice system is critical for establishing the different attributes of the crisis and being able to articulate effective solutions. The degree to which forensic science is considered to be a coherent, interdisciplinary yet unified discipline will determine how forensic science develops, the challenges it is able to address, and how successful it will be in overcoming the current crisis.

Evolution of Forensic Science

Evolution of Forensic Science, 2018

The history of forensic science dates a few centuries when scientists and law enforcers started to apply it to solve puzzling crimes. However, most people might think that forensic science is a modern knowledge unaware that the fingerprint techniques were found in the paintings and historic rock carving of prehistoric humans. Forensic science is basically the use of science in criminal law during investigations as governed by the standards of admissive evidence in the court of law. The work of forensic scientists is to collect, protect, and analyze scientific details of a case during an investigation. Forensic scientists can either be in the field collecting evidence themselves or in the laboratory, performing an evaluation of the objects brought to them by others. Besides their laboratory evaluation role, forensic scientists are mostly required to testify as expert witnesses in the criminal or civil case either in defense or prosecution sides. Scientists have developed various techniques that forensic scientists can use in their investigations to get admissible evidence in court hearings. This paper analyzes the evolution of forensic science field and some techniques that have evolved along with it.
