The Organization Of Turkish Administrative Courts From The Ottoman Age to the Year of 2016
The sustainability and the effectiveness of any legal system are as important as its existence. So as to ensure the sustainability of Turkish administrative judiciary system by coping with the huge backlog and also to enhance its effectiveness, the legislature enacted some crucial legal amendments amounting to a new phase of the system which have just been implemented as from 20 July 2016. In order to be able to comprehend in what way Turkish administrative judiciary was effected by these amendments, it is obvious that previous structure and functions of Turkish administrative courts must also be known along with the content of the amendments. In this frame this article aims at providing an overview of Turkish administrative courts’ today together with their yesterday, from the moment of their birth to the year of 2016.

The Legal Aid in Turkish Administrative Procedure Law in the Light of the Echr Case-Law

The ability of individuals to apply to the judicial way is important in terms of guaranteeing their fundamental rights and freedoms. In particular, the existence of this legal guarantee becomes more meaningful in terms of legal relations between the individuals and administration who have the privilege of using public power while performing their duties assigned by positive legal rules. At this point, besides the independence and impartiality of the judiciary, accessing the judicial path also appears as a requirement of the right to a fair trial. So that the right to a fair trial can find application in the legal relations between individuals as well as in public law relations between the administration and individuals. In this sense, it should be stated that the legal aid institution in Turkish administrative procedure law has an important value in terms of the right of access to court within the framework of the right to a fair trial. Nevertheless, the decisions of the European Court of Human Rights (ECHR) should be examined to better understand the legal aid institution and ensure the conceptual integrity within the framework of the right to a fair trial. In this direction, the study will examine how the legal aid institution's theoretical foundation is determined, and in the light of judicial decisions, how it relates to the fundamental rights and freedoms of individuals.

Introductıon Seperation of powers in Turkish legal system such as others in Europe leads to evaluate two kinds of sanctions different ffom each other: the sanctions applİed by courts and the sanctions applied by Administration. Administrative sanctions can be regarded as an old in applying and a new fıeld in theory in the sanctioning system of Turkey. That was a neglected fıeld in Turkish Law. There was only one theoretical administrative law study on this subject by recent times, which was focused on administrative sanctions and particularly on the ones in Italy1. Sometimes, that fıeld has been studied in some administrative law textbooks as a matter of competence of independent regulatory agencies2, and sometimes as a particular dissertation thesis3, In this study, fırst of ali, we will try to determine the term of administra tive sanction. Later, some sorts of administrative sanctions in Turkey will be introduced. Eventually, general principles applying to administrative sanc tions in Turkish Law will be discussed. Administrative law, one of the branches of public law in Turkey, briefly regulates the internal functioning of the administration and the relations between the administration and individuals. The concept of administration refers to institutions and organizations that perform a public service by using public power on behalf of the public. The public services provided by the administration are very diverse, particularly security, health and transportation. Although the public services provided by the administration were very limited in the past, today, a wide variety of services have started to be provided in different areas of life. Moreover, with increasing globalization, the factors to be taken into consideration in the provision of services have also diversified. Today, administrations have to take into account both national and international dynamics and developments while providing the public service they are assigned to provide. This is because the legislature or authorized bodies make legal arrangements for the needs of the society. While implementing the legal regulations, the needs of the society and the developments should be taken into consideration. While acting on behalf of the public and pursuing the public interest, the administration must take into account factors such as technology, international law, digitalization and adapt itself to developments according to the conditions of the day. This depends on the flexibility of the administration in adapting to the developments. This is because the failure of the administration to adapt to the developments causes the administration not only to fail to fulfill the duties it is obliged to fulfill in the globalizing world, but also to fall behind international developments and become unable to see the needs of individuals and society. Therefore, this study examines the relationship between administrative law and the global economy, tax regulations, the right to intervene for the public interest, international regulations, digitalization, environmental protection and competition law. Finally, we propose solutions as to what the attitude of the administration and administrative law should be in the face of these developments.

The legal system of the Ottoman Empire was founded solidly on the principles of Islamic law, with absolute power belonging to the Sultan. In classical Islamic theory, “law is a divinely-ordained system preceding and not preceded by the Muslim state, controlling and not controlled by Muslim society.” The Sultan was his instrument and representative on earth. In principle, the Şeriat covered all aspects of Muslim life, public and private. The main function of the state was to maintain and enforce the divine rules. Thus, in theory, there was no legislative power to regulate any aspect of social or political life. However, in reality, the Sultans could not find answers to their complex government and society in revelation. When the Empire grew enormously, it became impossible to govern it by enforcing only Şeriat, which had only a few rules concerning public law. On the other hand, new institutional environment is far from perfect. There are some serious risks and deficits. First, legal ambiguities between regulatory agencies may create power struggles and inefficiency. Secondly, having independent regularity authorities and new laws alone does not mean a guarantee for expected effective results. Finally, political class in Turkey is a myopic behaviour and their understanding has very serious short comings. Especially, I argue that the political commitment to support those independent administrative authorities by political elites is limited. I believe that the role of independent administrative authorities and the reorganization of Turkish traditional state structure towards regulatory state will continue to be debated in near future. I.
Recent Administrative Reforms in Turkey: A Preliminary Assessment

The Turkish public administration has recently experienced significant reform, resulting from the convergence of external and internal factors favoring change. It is possible to classify administrative reforms into two main groups. They are respectively managerial reforms and governance reforms. The study broadly reviews and provides a preliminary assessment of recent reforms undertaken in the first decade of the 2000s. The content and spirit of recent managerial and governance reforms reflect a new understanding of administration that is quite different from the traditional form of administration. Thus, they have the potential to bring about considerable changes not only in the role of Turkish public administration, but also in the nature of relationship between state and society. Judicial Branch in Turkey: Issues and Solutions

Discussions regarding the judicial branch in Turkey have always been on the agenda. Following the 2017 constitutional amendments, the frequency of these debates increased, and especially problems concerning the independence of the judiciary became more prominent. This situation brought forth studies on how to solve these problems. The prominent points made in most of the studies from a general perspective are the reforms that need to be made regarding the judiciary in general, and the high courts in particular. In this report, constitutional problems, and proposals for solutions regarding the formation and characteristics of the judicial branch are highlighted. As such, the aim is to evaluate the constitutional regulations regarding the judiciary rather than to provide a general perspective, and to contribute to the studies on the subject by making recommendations. The report first briefly discusses the Ottoman judiciary of the classical period, and then the formation and characteristics of the judicial branch in the 1876 Constitution, the 1909 Amendments, as well as the constitutions of 1921, 1924 and 1961. Then, the formation and characteristics of the judicial branch in accordance with the 1982 Constitution are examined. In this framework, the reforms made up until 2010 are discussed in detail, whereas the changes and transformations after that year are discussed more broadly. Afterwards, the problems that emerged in the judicial system following the 2017 constitutional amendments, and the connection between these problems and the new government system are evaluated in detail. Finally, there is a discussion on how the problems identified here may be resolved; accordingly, suggestions are offered. In this framework, a dual method is employed: first, there is an evaluation of how the constitutional problems related to the judiciary can be resolved if the current government system is continued. Then, the constitutional requirements regarding the judiciary, regardless of the government system in place, are emphasized. Since most of the constitutional issues related to the judiciary are considered to be independent of the government system in place, more weight is given to this second point.
