Legal Communication in Non-Litigation Procedure
MB University International Review, 2023
The research topic of this paper is legal communication in non-litigation procedure with the focus on the communication during the hearing process. Legal communication in non-litigation procedure refers to the official procedure of exchange of information in oral or written form that has been planned in advance between the participants in non-litigation procedure. The specificity of legal communication during the hearing process in non-litigation procedure compared to litigation procedure has been emphasized in the paper. The specificity comes from different methods of judicial work, different subject matters of the hearing process, different goals due to which the procedure takes place, different interests to be protected, and different nature and character of both procedures. Contrary to litigation procedure, legal situations that are resolved in non-litigation procedure are those situations, in which parties are not in dispute, that is, in which parties do not have opposing interests. Due to its heterogeneous structure, non-litigation procedure is characterized by numerous specificities that demand a more subtle approach in the realization of different types of this procedure.
Consultation with Legal Professionals
Language and Legal Proceedings
The legal profession is a vocation, and legal professionals study, develop, and apply the law. Usually, there is a requirement for someone choosing a career in law to first obtain a law degree or some other form of legal education. Chapter 4 demonstrated how Cameroon legal professionals apply the law in courtrooms. Chapter 5 aims to define what makes up the training of legal professionals in Cameroon. It is clear that to be a legal professional you need to know the law, but the content of this work already demonstrated that within the law we have language. All those involved in legal matters need to speak and listen to a language. Therefore, in courtrooms, legal professionals should consider both the legal and language issues of litigants. With the aid of semi-structured interview guides, I interviewed Cameroon Bench Magistrates (judges), magistrates (state counsels), lawyers, and interpreters to know how they were equipped and prepared to face the legal language-related problems of the nation. In other words, I seek to explain legal professionals' use of the behabitives, exercitives, verdictives, and receptive illocutionary speech acts in courtrooms.

If the privilege did not exist at all, everyone would be thrown upon his own legal resources. Deprived all professional assistance, a man would not venture to consult any skilled person, or would only dare to tell his counsel half his case. The following discussion compares the laws dealing with privileged communications in India and England. Objectives Through this project work, the researcher aims comprise together and understand the concept of Professional Communication.
