The present work was done addressing the central theme: The ineffectiveness of the custodial sentence in Brazil -A reflection on the Brazilian prison situation. Its institutional objective is the production of a Work Completion Course to obtain a bachelor's degree in Law at the Faculty Synergy Teaching System. The general objective is to investigate the problems that exist in the Brazilian prison system, in addition to pointing out causes and effects, as well as demonstrating the (in) effectiveness of custodial sentences. Finally, it aims to point out problems and possibilities for solutions regarding the Brazilian prison system and custodial sentences. Within the theme, there is an approach to various topics which describe the prison situation in Brazil, its historical evolution, the types of custodial sentences, the main criminal benefits of the Brazilian legal system, the latest massacres in prisons and the main problems that occur in this type of environment. This subject is difficult to study, because it is a very controversial subject, since popular opinion differs totally from many relevant points raised by specialists. Currently there are several social problems found in the Brazilian prison system. All these problems cause certain effects in the Society and are caused by a series of failures and errors. There are many criticisms directed at the prison system currently applied in Brazil, but there are practically no notes on solutions that seek to solve these problems. In the north, for the sake of clarity on the subject, it can be observed that the aforementioned problems occurring within Brazilian prisons are only caused by failures of the State, which in the same way, only the State itself can correct them. It also points to some alarming numbers and statistics, discovered by recent research.
