The compliance function, today a cornerstone of the control system in place within financial services providers, acts as an «instant legislator» that produces norms when legal or regulatory texts do not match practical contexts faced by market operators. Compliance officers can be described as compasses that guide the choices and actions performed by traders, and therefore legitimate market practices. As frame-makers, they contribute to the institutionalization of non-fraudulent practices within given contexts, not only by controlling or sanctioning, but rather through discussing and interpreting situations, with regards to the texts available. This research draws on a long-lasting participant observation within a brokerage house and shows, with a few examples, how regulation is produced in the field. We conclude that in most cases, the identification of fraud is not easy to perform, and rests on the kind of hermeneutical view that is conducted
L'évolution de la réglementation prudentielle entre la crise financière et la crise sanitaire

The context of this research comes particularly after the occurrence of subprime financial crisis in 2007 and the health crisis that occurred at the end of 2019, which put the four corners of the world in endless turmoil. The main objective of this article is to highlight the new Basel Accord 4, whose implementation of his recommendations will be spread over a period of 11 years (2017-2028) as well as its challenges and prospects after three decades of implementation of Basel regulations (since 1988). A few months before the start of implementation of this reform, initially planned for January 2022 and postponed until 2023 due to the health crisis, we will focus on clarifying the changes made by this new Basel Accord, by showing its contribution and impact on the financial system in view of the current international economic circumstances, particularly after the spread of Covid-19 which has impacted and disrupted the global economy. Nevertheless, the stakes are high for the banks, mainly because a global financial crisis could arise in the near future.

Cet article tente de concilier deux courants de la littérature, l’un qui montre l’effet favorable du développement financier sur la croissance économique, l’autre l’effet défavorable des crises financières. L’hypothèse centrale est que dans les pays en développement l’instabilité du développement financier croît avec celui-ci. Cette relation positive entre les deux phénomènes diminue l’impact favorable du développement financier sur la croissance. Plusieurs arguments théoriques sont présentés à l’appui de cette hypothèse, qui est ensuite testée avec succès sur un vaste échantillon de pays en développement durant la période 1966-2000. Cette analyse montre qu’une politique de libéralisation financière, destinée à promouvoir le développement financier, ne doit pas se faire dans n’importe quel environnement politique et économique.

During the last several years Robert Amzallag as Senior Fellow at CIRANO has taken an active interest in the research and transfer activities undertaken by the Finance Group. He has suggested initiatives that would be of topical interest to the financial industry in Montreal, particularly in derivative products and concerning practical issues in governance at the director's level. Before moving to London, he had met on a regular basis with the researchers at CIRANO. Of course, we have been eager during his career here in Montreal to listen to someone with his considerable experience in the banking sector, notably as the former President and CEO at BNP Paribas (Canada).Mr. Amzallag is certainly well placed to offer insightful commentary on the financial crisis that has preoccupied us over the last several months, and we have taken advantage of his annual stay at his country home north of Montreal to suggest that early in the New Year he present his thoughts on the crisis.... The Indian financial system has changed considerably since the 1990s. Interest rates have been deregulated and new entrants allowed in the banking and the securities business. The Indian equity market has become world-class. New private banks have emerged that are more customer-oriented than the older state-owned banks. Meanwhile, the scale of saving within the economy has expanded considerably, much as in East Asian economies during their high-growth period. This adds to the need for further financial-sector reform. In particular, banks need much greater freedom in asset allocation. While public-sector banks did appear sounder to the public during the 2007/08 crisis due to implicit government backing, they ought to be privatised to improve their governance and minimise the recurrent need for recapitalisation. The remaining obstacles to new entry have to be reduced. Financial inclusion is an important priority and restrictions on microfinance should be avoided. The regulatory and legal framework also needs to be overhauled, consolidating the diverse legislation. While such reforms would improve financial sector efficiency they would also likely have positive spillover effects on the rest of the economy and help sustain rapid growth.

Our work consists in an exploration of the integration of sustainability in the financial sphere, with a particular focus on capital markets and its actors, centered on the following research question : “are financial markets putting a price on the positive sustainable and environmental performance of firms?”. Our research is carried out within the theoretical framework of asset pricing, which is currently at the crossroads of two major revolutions. On the one hand is the sustainability revolution, which brings a challenge to these actors in the form of a massive global systemic risk which can only be compared in its possible global impact to the threat once posed by weapons of mass destruction. As financial actors are starting to understand the economic threats – amongst others – that represent climate action failure, biodiversity loss, extreme weather events and environmental disasters, financial markets will inevitably change. The paper describes the methods used by the French Banking Supervision Authority (ACP) to run stress tests for the corporate credit portfolio, through credit migration matrices (or transition matrices). This approach is currently used for “top-down” stress tests exercises. Developed for Basel II, it is still relevant under the Basel III framework. It includes sufficient flexibility to accommodate the severe crisis period observed recently. The paper introduces the basic model underlying the approach, largely based on Merton’s model; it then describes carefully the different steps for its practical implementation, providing hints on how it can be extended to other banking sectors. Finally the paper comments a few outputs of a stress testing exercise.
