One of the main aspects that relates different types of societies with their habitat is housing as an essential part of the configuration, transformation and consolidation of both. In addition, the right to housing is related to the right to the city so it is particularly important to urban and territorial scale./ At present we are immersed in a residential crisis that is essentially linked to the fact that housing has become a commodity rather than be defended as a right and a fundamental need of every human being. This situation involves an imbalance between the development of housing production and public access to it as a central element of the right to housing. There has also been territorial, economic, environmental, social and political consequences. The growth model has established a residential system with a series of paradoxes which we are more aware in times of crisis: although it has developed a high level of legislation has not prevented corruption; urbanization expands the existing heritage but is abandoned, and what is the subject of this work has been increased construction but has reduced the capacity of access./The aim of this paper is to analyze the evolution of residential construction taking into account the right to housing. Our hypothesis is that housing construction in the last expansionary cycle has responded to economic variables obviating the content of the right to housing and establishing a significant territorial imbalance. For this purpose first the content of the right to housing will be described and subsequently residential construction is analyzed in different urban habitats.
