Reveiw of Committees in the Post-Communist Polish Sejm: Structure, Activity and Member
Polish Sejm simply mean the lower house of national legislature of Poland. The term is initially referred to as Polish legislature as a whole, which first met for all of Poland in 1493 comprised of two houses. In 1946 the Senate (upper house), of the body was eliminated and reinstated in 1989, the Sejm (lower house) plays a vital role in the governmental system of Poland. Its political culture and contemporary experiences in the field of political governance expressed in the provisions of the 1997 Constitution. According to the Constitution, the Republic of Poland is a democratic State ruled by law and operate on the principle of separation and balance of powers. The Constitution recognizes the inherent and inalienable dignity of people as a source of rights and freedoms. The fulfillment of those values and principles makes indispensable a democratically elected Parliament which would create law and control the activities of the executive power.

Even though analysis of political institutions - their history, legal and political foundation, and systemic significance - are more and more often treated as a kind of anachronism, this type of research is without any doubt the starting point for any reflection on individual political systems. In our view, institutions contain tradition, reflect the mentality of social groups, customs, ways of conduct, sanctioned by legal or moral norms, respected in each society, as well as reflect the socio-political realities in which they exist. Thus, the process of institutional changes, which is the main axis of the analysis in this chapter, is a key aspect of subsequent civilization evolutions. The twentieth-century history of Poland abounded in several institutions essential for the functioning of the political system, however, in our opinion, two deserve a detailed reflection. The first will be the Senate, which is part of the legislative power, which underwent significant transformations in the 20th century (or even liquidation in a certain period, which was an expression of the prevailing ideology). The second is the institution of the head of state (both in an individual and collegial form), which is part of the executive branch, which, like the upper chamber of the parliament, was subject to a number of changes resulting from the prevailing socio-political realities and the ideological foundations of political systems. The starting point for the analysis below is the hypothesis that, despite several transformations in the Polish state, it was the classic institution that reflected the social and political realities of individual periods in the history of the twentieth-century Poland, as well as the ideological foundations for given political systems crystallised within them. Due to the above observation, in our analysis we will use not only a historical approach to selected institutions, but also a normative and cultural approach. In this perspective, it will be crucial, apart from the normative conditions, to look at the phenomenon of focusing by institutions the most important constitutive symbols and ideas for particular periods in the history of Poland. The analysis will be located between the legal and constitutional approach focusing on the reconstruction of legal norms regulating the field of politics and explaining the relationships between them, and the approach to the science of politics, which emphasizes the description and understanding of this reality.

Our considerations will begin by presenting the theoretical premises of the Polish law making system (definitions, the theory of rational law making). Next, we will discuss the characteristics of particular types of normative acts (such as the constitution, laws and regulations). In the following points, we will present the principles of legislative technique in Poland (requirements for preparing drafts of new laws, the structure of the act and principles for editing the content of provisions) and the stages of the legislative procedure (legislative initiative, parliamentary stage, the role of the president, promulgation of laws). After the theoretical part we will present the most important data on the practice of lawmaking in Poland, paying attention primarily to the problem of excessive regulation (inflation of law), which is the main factor reducing the effectiveness of legal system in Poland. The causes of this phenomenon may be sought in both political and systemic factors. We conclude our discussion with a proposal of a catalog of issues that should become the subject of more detailed studies of lawmaking systems in Poland and in other countries.
The paper represents an attempt to analyse the reasons and consequences of the radical refocusing of the Polish state's system in the interwar period. The thesis was advanced that in the interwar period in Poland two fundamentally different models of polity and governance of the state were created, which had a material bearing on the state's general domestic situation, including also the security and stability of the polity. The presented arguments suggest that in the years 1918-1939 the model of the Polish polity evolved from the strengthening of the executive authority, during the initial formation of the independent state entity, through the representative parliamentary democracy, and up to the presidential polity, in which the president clearly dominated over the legislative and judicial authorities. Such momentous changes introduced over a relatively short period of time could be the evidence of destabilisation of the political scene and could also indicate that the bases of the democratic polity of the state were not firmly established in the interwar period.
