Theoretical-practical approaches regarding the detention regimes in the penitentiaries of the Republic of Moldova

This article highlighted the specific nature of the execution of custodial sentences in the Republic of Moldova. Similarly, some theoretical and practical aspects of the current difficulties encountered in achieving the purpose of the deprivation of liberty were approached through the proper application of progressive and regressive regimes. Special importance has been given to the identification of the current regulations that determine the placement in different types of prisons with the three detention regimes. Also, this scientific paper draws attention to the necessity to carry out studies aimed at contributing to the formulation of proposals for amending the normative and institutional framework in order to enforce custodial sentences, including the current infrastructure conditions. Romanian Prison System and Azerbaijani Prison System

Speaking in regard to one penal system is complicated enough. However, discussing two systems simultaneously and providing a comprehensive analysis is even more complex. Comparing two systems can allow us to learn what works and what does not and also, what we could learn from these two systems’ weaknesses and strengths. This analysis is conducted based on the Criminal Code, the law regarding the execution of sentences, and the regulations for internal discipline in prisons from both countries. This paper aims to conclude the strengths and weaknesses of these laws, but also the alternatives to prison system.

Release from 'prison' in Hungary

In my study I introduce the Hungarian conditional release and presidential pardon and new compulsory presidential pardon system. This study is based on research carried out in the Ministry of Justice at the Pardon Department in which I analyzed several dozen petition pardons. In connection with the new compulsory presidential pardon I examined the judgment of the European Court of Human Rights, which has condemned Hungary because of its adoption of real (whole) life imprisonment.

Causes of Violating Prisoner’s Right to a Decent Life: Romania in the European Context

This paper presents a part of the results of a research project named “Prisoners’ Rights. Romania in the EuropeanContext”, conducted at the Institute of Sociology of the Romanian Academy, between November 2015 and September2017. Given the novelty of our study for Romania, we have considered an exploratory data analysis as a feasiblemethodology, able to objectively highlight and model our findings. Based on the perception of the sociological inquiryrespondents (N=557), the main causes of the violation of their right to a decent life in penitentiary were identified tobe overcrowding, disinterest on the part of the state and old infrastructure of penitentiaries. From a statistical point ofview, the Pearson’s chi square test indicated significant or highly significant associations between most of the causesof the breaching the prisoners’ right to decent living.

Preparing A Draft Strategy For The Development Of The Prison System In Romania

This project propose a strategy focused on the realization of some measurable, well definited objectives, and on a series of strategically options, supported by actions with clear deadlines and with direct implications on the entire system of Romanian penitentiaries. In order to determine the essentials elements of the strategy, we took into consideration the aim of this institution and the necessity to adopt a development strategy, in the context of lining-up the penitentiaries from Romania to conditions enforced of the EU. Through the strategic objectives and the suggested actions for the system of Romanian penitentiaries, we followed as the suggested strategy for insuring a competitive durable advantage and to offers the funds required of the development.
