There is little debate on the issue of free movement and mandatory requirements in the legal literature on preparation for accession and EU enlargement, although mandatory requirements are part of the acquis communautaire and should therefore be part of the accession preparations. However, the ability of the candidate countries to promote their national interests upon accession was not a concern of the European Commission in its Regular Reports on the progress made in accession preparations. Upon the accession of the ten new Member States, their preparations to successfully promote domestic conditions of market integration in the process of European policy making and rule making was a central prerequisite for the EU to successfully cope with the increased diversity of the Internal Market. Finding a proper balance between national values and Community interests in issuing and enforcing legislation became a common concern of new entrants, EU institutions, and the original Member States.
