Although compliance with the Government Procurement Policy is mandated by regulations, cases of non-compliance, irregularities and frauds in government procurement do still occur. Mandating compliance with procurement standards by law does not necessarily resulting in full compliance without concerning other relevant factors. This research focuses on voluntariness of compliance behaviour and factors that affect compliance with Government Procurement Policy among procurement practitioners in Malaysia. A factor relating to shariah ethics is also introduced to increase the scope and going beyond the proposed framework from prior studies. Survey questionnaires were administered to 104 government organizations, and 177 responses were received from procurement officers. Based on multiple regression analysis, the results indicate that familiarity with the policies, enforcement, professionalism and shariah ethics have a positive impact on compliance. SUSTAINABLE PUBLIC PROCUREMENT IN MALAYSIA: A LITERATURE REVIEW

Sustainable public procurement has been widely used to achieve global sustainability agenda. Malaysia"s government has initiated the National Sustainable Consumption and Production Blueprint 2016-2030 and 11 th Malaysia Plan, which promotes economic growth without compromising the environment or jeopardising the needs of future generations. However, despite the government"s initiative, there have been relatively small articles discussing the implementation of sustainable public procurement in Malaysia and what the future holds. This study explores a literature review regarding Malaysia"s performance of sustainable public procurement through the patterns and trends from the year 2011-2021. The results show that the emerging patterns and trends from previous publications concentrated on the policy, sectors, challenges, and determinants that drive sustainable public procurement implementation in Malaysia. It is envisaged that this study will provide the basis for future research into sustainable public procurement practices in Malaysia and beyond.

The biggest challenge to achieving the stated goals has been procurement professionals' adoption and conformity with best procurement practices under Public Procurement Act 663 of 2003. Therefore, this study assessed the factors that influence the implementation of best procurement practices in conformity with the Public Procurement Act 663 (2003) of the Republic of Ghana. An assessment tool has been developed to determine the level of conformity of procurement professionals at the Ghana Atomic Energy Commission (GAEC). The survey questionnaire was sent to 30 procurement and supply chain professionals, user departments and senior management at the Ghana Atomic Energy Commission. The study found that the average conformity score was 82%, indicating that the level of conformity achieved is very good, but that efforts to improve best procurement practices in accordance with Law 663 on Public Procurement of 2003 are almost none. Considering the discussed results and conclusions, the following recommendations for further research are made here. In accordance with the law, it is recommended that an investigation be conducted to determine the level of conformity with each objective of Act 663. In this way, different provisions addressing specific objectives of the law and the tools needed to evaluate them are identified. Further research may also be conducted to improve the implementation of other sustainable practices within the framework of Law 633 and its complementary regulatory framework.

Regulatory compliance plays a key role in influencing organisations to engage in responsible business practices that contribute towards driving objectives around social, economic and environmental considerations. At a national level, governments around the world use regulation as a policy lever to drive imperatives that promote socioeconomic and environmental objectives. Procurement, therefore, plays a significant role in ensuring that the contribution towards sustainability objectives is achieved and accelerated. This study set out to understand the impact of regulatory compliance on the adoption of sustainable procurement practices by organisations, whist assessing whether leaders are able to balance compliance and the interests of various stakeholders in procurement decision making processes. Confirmatory factor analysis and structural equation modeling were the main statistical techniques that were used to quantitatively test primary data that was collected from 247 procurement and sustainability managers within the public and the private sector. Relationships were observed between regulatory compliance, leadership and decision making towards adoption of sustainability objectives by organisations. It was observed that leaders are able to consider and translate stakeholder views into compliant decisions. Finally, the results have showed that there is strong relationship between regulatory compliance and sustainability, highlighting the contribution of procurement compliance towards driving sustainable development.

Compliance with the stipulated procurement process in local governments: a case from a developing nation

Empirical evidence of compliance or otherwise with procurement laws especially in developing nations is limited despite its importance in ensuring quality project delivery. This research assessed compliance with the procurement law in the local government setting of a developing nation, challenges to compliance and workable solutions. A total of 108 copies of a carefully structured questionnaire was administered to individuals concerned with contract administration in the local governments in the study area and 87 were considered good enough for analysis. Data analysis was done using cross tabulation, chi-square, mean score and percentile. Among other findings, the study revealed that there is partial compliance with the procurement clauses in the local governments. The study also revealed that significant relationship exists between knowledge of the procurement act, owning a copy of the act and compliance with the act. These findings of this study will be useful for construction and public procurement administrators as an evidence of the need for a multifaceted action towards strengthening compliance.

Do pressures foster sustainable public procurement? An empirical investigation comparing developed and developing economies

There is limited understanding of how various pressures foster sustainable public procurement, particularly in the context of developed versus developing economies. Using Institutional Theory, this paper develops a theoretical model to provide a nuanced understanding of how institutional pressures and citizens' attitude towards sustainability affect the level of sustainability adoption in public procurement and how this impacts sustainability performance. Using a sample of 546 public procurement practitioners from 102 countries, a structural equation model to test the proposed hypotheses is developed. The proposed conceptual model has been validated on three categories of public procurement, namely goods, works, and services. Results show that institutional pressures and citizens' attitude towards sustainability significantly impact the level of sustainability adoption in public procurement, which, in turn, improves sustainability performance. The impact of these pressures differs in developed and developing economies. Accordingly, policymakers may harness various pressures according to their context and the procurement category to foster sustainability in public procurement.

Sustainable procurement behavior: a case of government departments

This paper discusses the concept of sustainable procurement behavior (SPB) and the effects of personal values, leadership style and awareness on SPB. As the SPB became increasingly important in implementation for sustainable procurement practices, the paper aims to present the review of the existing literature on SPB and study the factors that can influence the SPB of procurers. The paper based on review of past literature, conceptualizes that personal values, awareness, leadership are significantly related to SPB and organizational culture moderates the relationship among personal values, leadership style, awareness and SPB. The results of this conceptual paper are likely to provide important insights to managers, policy-makers and researchers to further understand the factors which effect the SPB and improve the implementation of SPP practices.

The Determinants of Green Government Procurement (GGP) Implementation in Malaysian Public Enterprises

Green government procurement (GGP) is a method for purchasing decision with a consideration on environmental and social issues. The effective application of GGP is urgently needed especially in developing countries due to increase in environmental and social issues. The Malaysian Government has accredited the importance of GGP and initial steps have already been taken towards its implementation in Malaysia. This study aims to investigate the determinants of GGP implementation in Malaysian public enterprises. The sample of the study consists of 129 statutory bodies and 17 non-statutory bodies or government link companies (GLCs). The data is obtained using questionnaire survey distributed directly to procurement officers in the respective organisations. The findings revealed that perceived cost efficiencies, organisational initiatives, supplier availability and perceived benefits are the determinants of the GGP implementation in Malaysian public enterprises.
