Current territorial disputes between Chile and its northern neighbors originated in the War of the Pacific (1879- 1883). In 2008, Peru filed a complaint against Chile with the International Court of Justice in The Hague regarding maritime demarcation; in 2013, Bolivia instituted proceedings against Chile in the same court to obtain access to the Pacific Ocean. In spite of different arguments and demands both cases are interdependently linked in areas related to culture social structure, and the law.

Internal waters means those waters which are comprised within the baseline from which the territorial sea is measured. Within the internal waters, the State exercises absolute sovereignty under the same terms as it does in its territory; consequently, there is no innocent passage.

Territorial discourses opposed in the 21st century: The case of the Chile-Peru relationship from a critical geopolitics perspective

The objective of this article is to understand, from the perspective of critical geopolitics, how the discourses of territorial conflicts between Chile and Peru in the 21st century have been represented by each of the parties, while at the same time establishing underlying elements that they go beyond the official conceptions issued by the States. To obtain this, a theoretical-conceptual approach to the notion of territory is considered from the mentioned discipline, and thus establish how the territory has been considered mostly as a conflictive aspect in bilateral history, demonstrated in recent years in the territorial oppositions made by the maritime border and in the so-called “terrestrial triangle”. It is concluded that the territorial conflicts are only a sample of a more structural problem in the relationship between both countries, while the territorial discourse is used to maximize the differences and minimize the similarities.

Antecedentes jurídicos de la controversia por la delimitación marítima entre Chile y Perú

El presente artículo busca dilucidar los antecedentes jurídicos de la controversia que enfrenta a Chile con Perú sobre la delimitación de la frontera marítima. Pese a la existencia de variada documentación jurídica que clarifica cada una de las posturas, se concluye que si bien la controversia es netamente jurídica, su fondo presenta importantes ribetes geopolíticos que deben ser considerados por ambas partes.

Both Chile and Peru have interesting and similar and controversial histories. The commonness relates to much of their culture, their heritage as descendants of Spain and their language. Since Chile and Peru are geographically close they share the Pacific Ocean, their Northern and Southern border, respectively. Peru’s history is dominated by the Inca Empire with its elegance, geographic expansiveness, and its great contribution to the historical archives of Latin America.

"So far, it seems that the ‘Pacific Century’ is a concept that has been understood mainly in commercial terms, driven particularly by the rise of China as a major economic power. However, the 1990s demonstrated that a strengthened economy alone does not guarantee a safer and better-engaged international arena. If Chile really wants to be a relevant actor in the Pacific during the coming decades, it should address some of the aforementioned disputes. They have impacted the country’s trade, energy, and even its security. Additionally, Chile’s global reputation has been somewhat tarnished, leading it to be perceived at times as isolated."

CONTESTING PISCO: CHILE, PERU, AND THE POLITICS OF TRADE

This article examines the geography of pisco, a South American brandy claimed as the national drink of both Peru and Chile. The historic tension between these two nations based notably on the nineteenth-century War of the Pacific is used as a backdrop to understanding the cultural and political contestation over the “ownership” of this beverage. Although both countries see exportation of pisco as a means of agricultural development, much of the animosity of this trade dispute is couched in cultural and historical terms. International trade policies, including the use of geographical indications (labels of geographical origin) for the purposes of trademarking, and the physical geography that makes pisco production possible are discussed.
