Penelitian ini bertujuan untuk menganalisis rasional dasar pelarangan penyertifikatan tanah ayahan desa dan sengketa tanah ayahan desa yang terjadi di Desa Adat Panglipuran. Pemilihan dan penentuan lokasi dan subjek penelitian dilakukan secara bertujuan ( purposive sampling technique ) sesuai dengan fokus masalah dan kebutuhan data penelitian, selanjutnya jumlah dan jenisnya dikembangkan secara “ snowball sampling tecnique ” bergulir sampai tercapainya kejenuhan data atau informasi/data telah terkumpul secara tuntas. Strictly speaking, the Basic Agrarian Law is not intended to wipe out someone’s or legal body’s rights but rather to unify the National Land Law. As mentioned at Part II of the Basic Agrarian Law, the conversion had to be done to admit both the western registered lands and those bearing the adat rights. One of the rights that can be converted into the right of ownership is druwe desa land. Eventhough there has already been a rule on the above conversion, druwe desa at Pakraman Beng Village have not been converted up to the present moment. Abstrak Penelitian ini dilatarbelakangi oleh keprihatinan penulis terhadap proses pelaksanaan Konsolidasi Tanah di berbagai daerah provinsi Indonesia yang rumit dan lama sehingga menimbulkan kerugian materiil maupun immateriil kepada masyarakat pemilik tanah. Penulis memilih lokasi riset di Subak Sanggulan, Desa Banjar Anyar, Kec. Kediri, Kab. Tabanan, Provinsi Bali karena dalam pengamatan penulis, di antara beberapa proses pelaksanaan Konsolidasi Tanah yang terjadi di daerah-daerah, maka proses Konsolidasi Tanah di Subak Sanggulan adalah yang paling lama (mangkrak selama 33 tahun) dan paling kompleks permasalahan hukumnya hingga sampai pada proses peradilan sehingga menimbulkan banyak kerugian bagi masyarakat adat pemilik tanah. Most People around this country must have their own ways and mechanism for land issues before the form of written legislation is being publicized including people in Bangka Island. For example, the plantation land in Pasirputih Village, Tukak Sadai District, South Bangka Regency is arranged orderly. There are several requirements that must be obey in order to open the plantation land, such as they must be ‘herenteng’ (equal) between one plantation land and others. Besides, there are several prohibitions when opening the plantation land that shouldn’t be break by the people, those are ‘apit’ and ‘kaet’. These prohibitions are not written, but still being obeyed by the people. Something that is still maintained in this area is interesting to examine from the perspective of law number 5 of 1960 that is concerning the Basic Regulations of Agrarian (UUPA).

The provisions of state control rights are clearly stipulated in Law Number 5 of 1960 concerning Basic Agrarian Principles, one of which is in Article 2 paragraph (2), namely the welfare of all Indonesian people in relation to earth, water and space. According to the provisions of Law Number 5 of 1960 that the abolition of rights to land was abandoned. In practice, it happened in Mekarmukti Village, there were many indications of neglected land. This study aims to determine the implementation of abandoned land control that occurred in Mekarmukti Village, Cianjur Regency and to find out the legal protection of abandoned land owners who were taken over by the state in Mekarmukti Village, Cianjur Regency. This study uses a normative juridical research method, namely library research on secondary data in the field of law. In this study data collection techniques used are library studies to find theories and discoveries related to problems in the form of laws or the results of undergraduate research and field studies to obtain primary data by conducting interviews with various parties involved. Based on the results of the study it was concluded that, the implementation of abandoned land control over land use rights in Mekarmukti Village in the early stages was in accordance with the basis of Government Regulation Number 11 of 2010 concerning Control of Neglected Land Utilization and Regulation of the Head of the National Land Agency of the Republic of Indonesia Number 4 2010 concerning the Procedures for the Control of Neglected Land. Furthermore, the second stage of the control of abandoned land is one of the articles that does not become the basis for the control, namely, Article 8 of Government Regulation Number 11 of 2010 concerning the Control and Utilization of Neglected Land. As well as for landowners of usufructuary rights that were abandoned in Mekarmukti Village no legal protection and business rights certificate as legal protection for business use rights were taken back by the state.

The regulation on community rights to land ownership is worth investigating considering that the development of law and policy issues of national land is apparently in line with the strategic value of land in the development. Thus, the reconstruction on state law and customary law in the regulation of community rights over the land is important so that the community rights are not neglected by the dominance of the right to control the land by the state. The management of village land in Bali (the land owned by the village called as druwe) is a concrete example that can be mentioned as the subject of land rights. Without having a clear law reference, it is then possible for the customary community to face difficulties in the control of their rights to the land owned by the customary village (desa pakraman). The community also does not have the legal protection that is strong enough to be used to defend their rights. This study is a normative juridical research that makes all of the problems are referred to judicial review as a system of norms that are used to give the prescriptive justification concerning the legal event. Results of the research showed that the land policy concerning the customary law community is governed by Article 3 of Act No. 5 of 1960 on the Basic Rules of Agrarian involving the recognition of indigenous peoples' rights although it is still limited. There is, even, a denial of the right to the land by other regional regulations related to land and natural resources. The rights of indigenous peoples, including druwe village land in Bali is set in accordance with to the concept of state law and customary law complementary without dominating one another. State law can be resolved all problems through the legal structure. Based on the theoretical aspects, settlement of land issues in the conception of state law and customary law can be thoroughly observed by putting the appropriate concepts and principles of the national land law that is still based customary law.

Minuman arak Bali, yang semula eksistensinya dipandang illegal, kini dengan terbitnya Peraturan Gubernur Nomor 1 Tahun 2020, mendapatkan legalitas hukum. Permasalahan yang muncul dibalik pemberlakuan kebijakan tersebut, adalah mengubah paradigma pengrajin dan penjual arak di Desa Besan. Sebagian besar masyarakat berpendidikan rendah, serta menekuni usahanya secara tradisional dan turun-temurun. Namun demikian, agar hasil produksinya dapat dijual ke pasaran, mereka harus menginisiasi untuk melakukan proses legalisasi dengan persyaratan yang cukup rumit. Langkah sosialisasi ini, terutama konten Peraturan Gubernur tersebut dapat diketahui sangat perlu dilakukan secara berkelanjutan.

Abstrak Pasar tradisional merupakan wadah bagi masyarakat sebagai pelaku utama pembangunan dalam bidang perdagangan sehingga perlu adanya penataan dan perawatan pasar tradisional. Penataan kawasan pasar tradisional dilakukan untuk menertibkan para pedagang pasar dan menciptakan pasar tradisional yang bersih, nyaman serta fasilitas yang memadai sehingga stigma buruk mengenai pasar tradisional lama-kelamaan akan menghilang.
