The rapid ratification of the Rome Statute of the International Criminal Court (ICC) and the orderly election of its judges and prosecutor believe the radical nature of the new institution. Indonesia is one of countries that rejected the International Criminal Court (ICC) Statute. Indonesia's reason at that time was that Indonesian sovereignty would be threatened or its national security would be compromise. Interestingly, some of the crimes within the Rome Statute jurisdiction (Article 5 of the Rome Statute) had been adopted by Indonesia in its domestic law such as the Law No. 26 year 2000 concerning Human Rights Court. Jurisdiction of the Law No. 26 year 2000 is and genocide and crimes against humanity. The Law No. 26 year 2000 also adopts the idea of Ad hoc tribunal that is possible to apply ex post facto justice. Finally, it plays important role in order to protect Indonesian interest and to fulfill international community point of views.
Implementation of international crimes under the Rome Statute into national legal systems

The present research paper describes the most traditional ways of Implementation of Rome Statute. The main section of the paper concerns the effect of adopting Core crimes in different countries as well as determine key way of such implementation and its practical results. Such description aims to comprehend and compare the practical questions which arise in the prism of implementation of International Crimes, as well as find good practical answers which are based on states’ experience. Most issues, which will be introduced in this article should answer following important questions: first is whether the states have to implement international regulations on genocide crimes, terrorism, war crimes with crimes against humanity, and second question is arisen due to the definition of International Crimes in national laws. At main part of the research, we discuss the national legal background to implement the regulations of Rome Statute, as a part of International law, as well as analyze foreign countries experience in this direction. In this legal research, three categories of methods were used: philosophical methods, general scientific methods and legal methods. All the methods, including dialectic method, method of analysis and synthesis, historical, sociological and comparative, the method of the general theory of scientific knowledge of social and legal phenomena, as well as, method of systematic analysis, comparative legal method, and logically legal method were used to consider the most traditional ways of Application of the Rome Statute in domestic laws together with all the regulations of international law in general.

This study aims to find out the dynamics of the legality principle in the renewal of criminal law laws in Indonesia. The type of research used is doctrinal research. All data obtained were analyzed qualitatively juridically. This study examines and examines secondary data about the dynamics of the legality principle in reforming criminal law laws in Indonesia. The principle of legality according to Paul Johan Anslem von Feuerbach is nulla poena sine lege; nulla poena sine crimine; nullum crimen sine poena legali. The paper examines Indonesia’s viewpoints on international law by analysing the various stages in Indonesia’s history from its independence through the present times. In the Third World State approach, international law was deemed used as a tool of legitimacy to colonize. This hypothesis can not be generalized to prevail in Indonesia context. To avoid generalization, author determines BPUPK/PPKI Session in 1945 as an object of the research because it’s represent important moment for Indonesia. This research use interdisiplinary approach, which combine between legal and histrory studies. Base on study on BPUPK/PPKI Session in 1945, author show the result is controvert to the previous hypothesis. First, international law is a legal regime that supports Indonesia's independence. The role of international law in the BPUPK / PPKI session is used as a tool to legitimize Indonesian independence.

The state of law is the concept of a state based on applicable law. In the development of the state, there are two concepts of state of law used by countries in the world, namely rechtstaat and rule of law. These two concepts also inspired the Indonesian state of law but were not followed absolutely. Indonesia is still building a legal system with a culture of society.
