The article is dedicated to the issues of constitutional development of Ukraine. It is stated that constitutional development does not mean every change of political, social or state character, but only the one aimed at building a Constitutional state (in the sense of state with constitutionally limited government according to doctrine of constitutionalism). The constitutional development of Ukraine is quite complex with repeatedly arising problems, which gives the grounds to call it “wandering in the circle”. The most important issues researched in the article are related to the form of government applied and the system of separation of powers, as well as the functioning of constitutional jurisdiction and concentration of powers by the Head of state. The main reasons for this are divided into two groups: those common for post-socialist states and the ones inherent to Ukraine. The first group includes the problems of separation of powers, independence of the judiciary, and the effective activity of constitutional jurisdiction. The second one deals with lack of a single and unchallenged state-national identity reflected in constitutional identity, difficult geopolitical situation related to voluntary abandonment of nuclear weapons, and problems of protection of state sovereignty and territorial integrity of Ukraine from armed aggression.
SOME ISSUES OF CONSTITUTIONAL JUSTICE IN UKRAINE

The article identifies trends in the development of and access to constitutional justice in Ukraine at the current stage. It is alleged that on the one hand, there are attacks on the judicial status of the Constitutional Court of Ukraine, which intensified after the 2016 constitutional reform and the position of the Supreme Court. On the other hand, the effectiveness of a constitutional complaint as a human rights mechanism, i.e. for the formulation of the rights and responsibilities of the individual, is still insignificant. This is due both to the model of the constitutional complaint itself (being exclusively normative) and to the practice that is being formed. The reason for inefficiency can also be called doctrinal unpreparedness for the implementation of a constitutional complaint, because, in fact, despite the large number of studies on the subject, the practical aspect was not well thought out. Both the institutional component and the regulatory framework of the Constitutional Court of Ukraine itself need to be significantly improved. We refer specifically to the Law ‘On the Constitutional Court of Ukraine’ in terms of the interim provisional and protective measure, the implementation of decisions of the Constitutional Court of Ukraine, their actions in time, and specific mechanisms for the restoration of individual rights. In pursuance of the Constitution of Ukraine, a legislative mechanism for compensation for damage caused by unconstitutional acts of public authorities needs to be developed. The provisions of procedural law regarding the review of court decisions in exceptional circumstances as a result of declaring laws unconstitutional need to be adjusted. Application of constitutional principles in criminal legislationof Ukraine

The article examines the importance of constitutional principles for the development of criminal law. The main directions of application of the principles of criminal law in the criminal legislation of Ukraine are investigated. It is determined that the principles of the Criminal Law of Ukraine include the main provisions established by law or derived directly fromit, provide a clear description of the content of this branch of law and are used in the legislative and law enforcement activities of the state bodies. Using dialectical and historical methods, the general law principles of Criminal Law are analyzed. Law-Making Activity in the Case Law of the Constitutional Court of Ukraine

The aim of this paper is to reveal and examine law-making elements in the jurisprudence of the Constitutional Court of Ukraine. It should be noted that the Constitutional Court has no direct powers to establish new legal norms under national legislation. However, in the process of constitutional interpretation, the case law of the Court demonstrates de facto the presence of law-making activity, that leads to the extension of its discretionary power on the formation of law. The paper will focus on the analysis of the practice of the Constitutional Court of Ukraine with regard to the 'creative inter-pretation' of law. A review of selected case law leads to a conclusion that the Constitutional Court often uses the dynamic interpretation of the Constitution. Moreover, the Court may change its own legal position in order to protect constitutional rights. Thus, the Constitutional Court of Ukraine has the right to 'develop' the law through evolu-tive interpretation of the Constitution. It can also be concluded that the Constitutional Court enjoys a wide 'margin of appreciation' in its interpreting of the Constitution. CONSTITUTIONAL PRINCIPLE OF JUSTICE IN UKRAINE IN ITS GENESIS AND IMPLEMENTATION IN PRACTICE

The authors study the principle of justice in Ukraine, focusing on the problematic issue-the violation of the principle of justice in the administration of law. An example is the decision of the Constitutional Court of Ukraine of 27 October 2020 No. 13-r/2020 on the abolition of electronic declaration of officials, which led to a constitutional crisis in the country. To resolve the situation, the President of Ukraine submitted to the Verkhovna Rada of Ukraine a bill on the dissolution of the Constitutional Court of Ukraine and the annulment of the above-mentioned decision of the Constitutional Court of Ukraine. The situation in the country is of great concern, as Ukraine's visafree regime with the European Union and Ukraine's expected membership in the European Union are under threat. Corruption, long-term judicial reform, the constitutional crisis, violations of the principle of justice lead to the outflow of foreign investment from Ukraine, mass migration of Ukrainians to developed countries of the European Union. All these factors hinder the development of the state as independent and democratic. It is concluded that a necessary step for Ukraine's European integration is not only the declaration, but first of all the implementation of the principle of justice by all branches of Ukrainian power.
Ukraine as a country of constitutional transition from totalitarian to democratic practices of the government finds ambiguous position. On the one hand, today, more than 20 years and the collapse of the Soviet Union, deepening integration process including European integration. At the same time European integration's failed because of economic recession and the need for the completion of the relevant financial institutions of the EU. On the other hand, Ukraine finds its place in the legal world map. In this context we will consider the characteristics of the constitutional traditions of Ukraine that identify it on the world map of constitutionalism namely: a) tradition of deliberative democracy that is embodied in the form of viche (assembly) – maidan (Square); b) guarantees the dignity and individual freedom; c) deconcentration of power including parliamentarianism and local self-government; d) respect human dignity and individual freedoms and e) due process of law. It is very important incipience of political of Ukrainian nation as a political body. Such elements of Ukrainian constitutionalism fully express its compliance with European constitutional tradition. In this paper it is proved that the neglect of these traditions has constitutional implications discontinuity, including actual loss of national sovereignty and their own state. In terms of the transformation of the doctrine of national sovereignty this context is the basis for understanding the benefits and weaknesses of European and Eurasian Integration of Ukraine. Special attention is paid to the course of the preparation and conclusion of the Association Agreement between Ukraine and the EU. I analyze the impact of European institutions, including the European Court to confirm the values of democracy, human rights and the rule of law in the legal system of Ukraine and the development of constitutional democracy.

THE SYSTEM OF PRINCIPLES OF CURRENT ADMINISTRATIVE LAW IN UKRAINE

The article is devoted to the definition of fundamental principles of the administrative law of our country and to the research of the historical path that has led to their current formation. The principles which are outlined in the article reflect the relationship between the society and the executive authorities and represent the foundations of regulation of social relations that are inherent in the creation of socially just administrative law.
