Abstract

RESUMO: O objeto deste artigo concentra-se no estudo da formacao do mercado de ensino superior privado. Para demonstrar como esse processo ocorreu, primeiro discorre-se sobre a abertura inicial, passando ao perfil empresarial do setor, com a Lei de Diretrizes e Bases (LDB) de 1961 e a Reforma Universitaria de 1968. Analisam-se, tambem, as consequencias que estas legislacoes trouxeram para o setor privado nas decadas de 60 a 90. Ato continuo apresenta-se o contexto em que a Lei no 9.394, de 20 de dezembro 1996 Lei de Diretrizes e Bases da Educacao Nacional e o Decreto 2.306 de 19 de agosto de 1997 foram redigidos, justificando a postura neoliberal adotada pelo Estado e a consequente mercantilizarao do setor, atenta-se para os novos arranjos do setor que profissionalizou sua governanca e gestao, bem como para o surgimento de grandes grupos educacionais com capital aberto que com auxilio de capital estrangeiro expandem suas operacoes. Por fim, aborda-se o mercado concorrencial apresentando os consumidores, concorrentes e seus segmentos de atuacao, finalizando analise com o modelo proposto por Michael Porter, que leva em consideracao cinco fatores ou como denomina o autor cinco “forcas” competitivas. ABSTRACT: The object of study from the present article is concentrated on the formation of the Brazilian private high-teaching sector. To demonstrate how this process has occurred, firstly the initial opening to the corporal area is analyzed, with the Law of Headings and Bases from 1961 and the Academic Reform from 1968. The consequences, brought by these laws to the private sector from the 60’s to the 90’s, are also studied. In the sequence, the context in which the Law n° 9.394, from December the twentieth 1996, and the decree 2306 from august the nineteenth 1997 were written are also studied. Justifying the neoliberal posture adopted by the Estate and the consequent commercial exploitation from the sector, the new arrangements made by the sector that has professionalized the administration on education, such as the formation from great educational groups of open capital that, with the aid of foreign capital, expand their operations are addressed. Finally, it studies the competitive market showing the consumers, competitors and their acting segments, and then, it ends with the analysis of the model proposed by Michael Porter, that takes into consideration five factors or like the author denominate: five forces shape strategy.
