Demokratisasi Calon Tunggal Pada Pemilihan Kepala Daerah

Based on the philosophical basis, the purpose of holding direct regional head elections is to achieve sustainable democratic values, namely the process of community participation in exercising their right to vote. The simultaneous regional head elections that were held in December 2020 gave rise to the phenomenon of a single candidate. One of the regencies/cities that carry out regional elections with a single candidate is Boyolali Regency, which is located in Central Java Province. This study discusses whether simultaneous regional elections by presenting a single candidate pair are in accordance with democratic democratic principles; How is voter participation in Boyolali Regency where there is only a single candidate in the simultaneous regional elections in 2020. This study uses a normative juridical approach, data is obtained from primary data and secondary data, this writing uses descriptive analysis method by collecting data from literature review and legal literature. Results of the study, it is known that the presence of a single candidate in the 2020 regional head election in Boyolali Regency is a form of empirical democracy and develops dynamically and the law must follow every social development of the community in their respective regions.

The legal issue on the single candidate of regional head has been initiated with the emergence of phenomenon of the single candidate of regional head in a number of regions in Indonesia. In reality, Law Number 8 of 2015 does not anticipate the existence of the candidate of regional head and to anticipate such condition, the Regulation of KPU No. 12 of 2015 regarding the postpone of the election of regional head is issued if there is only one pair of condidate in one region. The research studies the issues: first, the legal issue the single candidate of regional head in the election of the regional head is contemporaneous in 2015 in accordance with Regulation No. 8 of 2015; Second, the effort to cope with the single candidate of regional head in the following election of regional head. This is a qualitative research with the method of normativedescriptive approach that has been analyzed descriptively and processed using the literatures from the secondary data sources. The results of the research showed that first, the legal issue on the single candidate of regional head in the election of the regional head simultaneously occurred in 2015 is initiated with the legal solution from KPU with the issue of Regulation of KPU no. 12 of 2015 and the existence of the legal claim of judicial review to the Constitutional Court creating a number of legal implications. Second, the effort to prepare the next contemporaneous election of the regional head needs to be given a revision of Regulation No. 8 of 2015. This is as an effort to enforce the demoracy and to prioritize the people's rights in Indonesia.

Pilkada dengan satu pasangan calon atau calon tunggal mulai dikenal pada pilkada tahun 2015, karena sebelumnya, peraturan perundang-undangan tidak mengakomodir pasangan calon yang kurang dari dua pasangan calon. Yang menjadi permasalahan pada tulisan ini adalah bagaimana konstitusionalitas calon tunggal dalam pelaksanaan pemilihan kepala daerah melawan kotak kosong. Isu ini menjadi menarik, mengingat bangsa Indonesia tanggal 9 Desember 2020 akan melaksanakan pesta demokrasi pilkada serentak, sehingga perlu adanya kepastian hukum dan keadilan dalam pelaksanaan pilkada dengan hanya satu pasangan calon. Kajian ini menggunakan metode yuridis normatif atau penelitian doktrinal. Pada surat suara pemilihan satu pasangan calon yang akan dicoblos memuat dua kolom yang terdiri atas satu kolom yang memuat foto dan nama pasangan calon dan kolom kosong yang tidak bergambar. Pelaksanaan pilkada pasangan calon tunggal lawan kotak kosong merupakan pembelajaran politik bagi bangsa Indonesia. Hal ini merupakan bukti bahwa perkembangan sistem ketatanegaraan dan sistem pemilu bangsa Indonesia semakin menunjukkan bahwa hak konstitusional warga negara, baik hak untuk dipilih maupun hak sebagai pemilih akan terpenuhi walaupun hanya terdapat satu pasangan calon kepala daerah dan calon wakil kepala daerah. Untuk itu, pelaksanaan Pemilihan satu pasangan calon harus secara tegas diatur dalam peraturan perundang-undangan dan pendidikan politik baik kepada partai politik maupun kepada masyarakat sangat perlu, guna pembelajaran politik yang lebih baik. The single candidate became a political phenomenon in Indonesia. However, the phenomenon rarely happens, consistently increasing the number of single candidates in the local election. This research aims to analyze whether this political phenomenon alerts democracy decadency or a typical circumstance in a democratic state. The method used in this research is doctrinal legal research. The result shows several reasons the single candidate consistently increases from event-to-event sort of an epidemic virus that could spread across the province. Pemilihan satu pasangan calon (paslon) atau pemilihan calon tunggal berpotensi terjadi pada Pemilihan Kepala Daerah Serentak 2024 (Pilkada Serentak 2024). Pilkada Serentak 2024 memiliki skema yang berbeda dari pilkada sebelumnya yakni dilaksanakan lima tahun sekali di seluruh daerah. Permasalahan yang dihadapi terkait ini, jika paslon tunggal kalah maka jadwal pemilihan berikutnya akan dilaksanakan lima tahun berikutnya. Selama kekosongan jabatan kepala daerah tersebut maka posisi kepala daerah akan diisi oleh penjabat yang bertugas selama lima tahun. Tulisan ini mengkaji pertentangan kondisi ini dengan nilai-nilai demokrasi. Oleh karena itu, Komisi II melalui fungsi legislasi dapat mengajukan perubahan regulasi terkait aturan pencalonan baik dari partai politik maupun calon perseorangan, dan aturan pengangkatan penjabat yang melibatkan DPRD.

Munculnya fenomena calon tunggal di Indonesia merupakan anomali. Di negara-negara demokrasi maju seperti di Inggris, calon tunggal muncul di daerah-daerah dengan jumlah pemilih sedikit, atau dapil kecil. The background of this research problem is the simultaneous regional head elections in 2018 that occurred in several regions, such as the case of "victory" of an empty box against a candidate for mayor of Makassar and the existence of a single regional head candidate in several regions such as Tangerang Regency, Tangerang City and several regions other. In addition, there are also a number of regional head candidates who have been convicted for criminal acts of corruption going forward again in the regional head election in 2018. The purpose of this study is to discuss problems in the simultaneous regional head elections in 2018, specifically regarding the causes of a single candidate and the reasons for the victory of the empty box so that it is expected that the problem can be analyzed in relation to existing laws and regulations. The research is also aimed at studying the budget efficiency which is one of the objectives of holding simultaneous regional elections in Indonesia or not. The research method uses qualitative methods using an empirical juridical approach. The data used are normative data derived from literature studies and empirical data derived from observations and interviews with relevant parties in the 2018 elections. Samples of data are taken from several regions that indicate there are problems in the simultaneous election process in 2018 namely Makassar City, Tangerang Regency, Tangerang City. The results of the study found that the emergence of a single candidate that had implications for empty box wins and budget inefficiencies were caused by the weakness of Law Number 10 of 2016. The results of this study were expected to provide recommendations for the next simultaneous local election improvement, both improvements in regulatory arrangements and improvements in practical arrangements.
