An Analysis of the Factors Responsible for Habitual Criminal Behaviour in India: An Overview

Crime is a social phenomenon which has always been a matter of concern for Criminologist. Despite of devising different methods to curb the activities detrimental to the society, there is no decline in crime rate. Generally, there is a tendency in criminals to fall back again and again into the life of criminality. Habitual criminality is the recurrence of such undesirable and antisocial practices on the part of a concerned person that may tend to lead him the career of crime. Criminal behavior is an integral part of social behavior that can be understood only in relation to the person's social situation. The personality of the offender, the social world in which he lives, and the previous experience growing out of interaction between the individual and the environmental situation play a vital role in the social process leading to criminal behavior. Man and his environmental conditions in which he lives influence each other so intricately that any attempt to prevent crime inevitably may require manipulation on both the sides. The purpose of imprisonment is to protect society against criminals and to transform them a law abiding and self-supporting person after his release. However, the prevention of crime through the use of punishment is hardly to be considered satisfactory. The basic thrust of this work is to examine the factors which contribute to generate a habitual criminal behavior among criminals and in consequence it becomes their way of life.

Attempts to explore the causes of crime in the Indian context and situation have been sporadic and generally non-empirical in nature. This research explores the causes for criminal motivations in India. The paper describes and analyzes the major reasons of criminality amongst convicted offenders. Crime, a persistent problem, has been with us from the time immemorial. Social, planner and criminal justice system have seldom been able to control it effectively. Statistics both from developed and developing countries on crime or delinquency reveal an upward trend. Indian society has not been immune from this. It is rather a basic social problem which is seen in our community, religions, castes and classes. The present study was conducted on 200 male convicts 25-40 years age taken from Patna Jail, out of which 100 will be notorious criminals and 100 will be trivial criminal. Personal Data Schedule, Eysenck Personality Questionnaire, General Intelligence Test and materials used in this present work.

Exploring The Determinants Of Juvenile Criminal Behaviour In India : A Qualitative Study

The most vital and active segment of the population in any nation is its youth. Due to psycho-social influences, teenage life exhibits a variety of qualities, structures, aspirations, and temperaments... India being a collectivistic society, juvenile delinquency results majorly due to cultural crossroads, socio-psychological factors, economic/social disadvantages and faulty influences of surroundings. Data was collected in the form of semi-structured interviews from the sample of representative officers (N=14) and other working professionals of Juvenile Justice Boards and correctional homes in 3 districts of Uttar Pradesh. After the thematic analysis, several sub-themes were derived and discussed. Further analysis has shown a remarkableimpact of education, gender and socioeconomic status on the proportion of children in conflict with the law.

Criminal Behavior: A Psychological Approach Research Paper

Through many centuries, criminal behavior was mistakenly explained mostly with biological defects of the individual. It was believed, that abnormal actions, negatively affected society, were preferably conducted by those, who suffered from serious physical deviations in development. However, as the science was progressing, scholars have begun searching other possible causes of the formation of antisocial behavior and psychology began to actively explore this area. Nowadays, it is known, that incorrect parenting style, negative influence of environment, and formation of improper role models may significantly result inner conflicts and thus, led to the abnormal behavior. In this essay, we would further examine, how these aspects can influence the behavior of individuals and lead to criminal conduct, illustrating it with examples from biographies of famous criminals to show how concepts can be applied in reality. First of all, it is necessary to draw a distinction between biological and psychological factors, influencing the behavior of individual. Under biological factors we mean physical anomalies, such as neurotransmitter dysfunction, bradygenesis, and other problems of neural development, genetically predisposed or caused by trauma or injury. Under psychological factors we mean mental disorders, and deviation in education and mental development of the individual. However, despite the fact that the differences seem obvious, both areas are interconnected between deeply. As we know, the connection of nature and nature is rooted into every individual. As the course textbook states " everything psychological is simultaneously biological " (Meyers, 1999, Chapter 2, p.47). Thus, various theories, designed to explain the emerging and development of deviant behavior, combine both approaches. For example, theory of personality and crime by Hans J. Eysenck, British psychologist, states that each individual has innate hereditary predisposition towards asocial behavior, which discloses in certain circumstances. Thus, " criminal behavior is the result of an interaction between certain environmental conditions and features of the nervous system " (Bartol & Bartol, 2005). However, Eysenck does not say, that deviant behavior inborn, but may be caused by the compound of heredity and environment. It is not itself, or criminality that is innate; it is certain peculiarities of the central and autonomic nervous system that react with the environment, with upbringing, and many other environmental factors to increase the probability that a given person would act in a certain antisocial manner (Eysenck & Gudjonsson, 1989)

FACTORS AND PATTERNS ASSOCIATED WITH JUVENILE DELINQUENCY WITH REFERENCE TO JUVENILE CRIMES IN INDIA

Objectives: This study aims to examine the patterns in juvenile delinquency based on factors including age, gender, offence type, and characteristics used in NCRB reports and to comprehend the various factors that contribute to juvenile crime. Methods: This study was done using the secondary data which was collected from the National Crime Records Bureau (NCRB) reports in the year of 2017 to 2021 by the Government of India. Result and discussion: The analysis of the aforementioned data reveals that there is a higher level of juvenile crimes in India especially in various states. It also shows that a significant proportion of juvenile individuals have unfortunately fallen victim to a multitude of socioeconomic pressures, including poverty, inadequate parental guidance, limited access to education, and the influence of peer groups. The crime rate in India has exhibited a notable upward trend over the years, accompanied by a concerning decline in the rate of convictions. Conclusion: The issue of juvenile delinquency necessitates focused consideration and an approach that prioritizes the well-being of children, with an emphasis on safeguarding and proactive measures to prevent their involvement in deviant behaviour. Research Implications: The findings can have implications for policymakers and educators in the realm of pedagogy development. Additionally, it bears relevance for family members and other stakeholders who play a crucial role in fostering the comprehensive growth and development of children.

SOCIO-DEMOGRAPHIC PROFILE AND FACTORS ASSOCIATED TO NATURE OF CRIME OF PRISONERS IN CENTRAL JAIL OF KOTA (RAJASTHAN

Background: Crime is a mane made concept. Crime and its relation to various socio-demographic factors has been subject of debate since time immoral. Crime is wide spread, diverse in nature and increasing frequency. Objectives of the study were to pinpoint socio-demographic profile and to find out the association between socio-demographic parameters of the study subject in relation to nature of criminal behavior. Method: 134 Prisoners in Central Jail Kota by adopting a random sampling. A socio -demographic characteristics of study subjects, was obtained by interviewing them. Inferences were drawn in form of percentage and applying chi square test Results: Majority of criminals were male (85.8%) in young age group 20 to 40 year (74%) and married (64%). (57%) of prisoners were of rural background and majority of them (66%) belonged to lower and lower middle socioeconomic status. (44%) of prisoners were illiterate. In category of murderers motive of the crime in half (50%) cases was petty quarrel and family vendetta and fights over land were the motive in (22.06%) of the prisoners. (60.5%) prisoners were belonged to violent category according to nature of crime. Conclusions: Job oriented education system strengthened and strong family values incorporated through IEC since childhood.
