Analysis of CSR Legislation in Indonesia: Mandate to Business
Business and Economic Research
Indonesia was one of the first countries in the world to implement legislation mandating businesses to undertake Corporate Social Responsibility (CSR). Different with other countries with their voluntary approach of CSR, the legislation makes CSR as a mandate to business in Indonesia. Through document analysis method, this study analyses six laws related to CSR in Indonesia to define the mandate of CSR legislation in order to understand the form of CSR should be practiced by companies operating in Indonesia. Indonesia as one of the developing countries may require sufficient fund for their local development. CSR may be seen as a source of fund for local development. Therefore, CSR legislation in the country provides mechanism for wealth or resource distribution of companies for local government to develop local communities.

Corporate Social Responsibility has grown as an issue in corporate governance in recent years. By having such programs, a private company might seem as having a social responsibility towards its social surroundings. In October 2020, no less than 19.056 studies had been conducted on this subject in various contexts. Even though plenty of research was conducted in the area, there is still limited understanding of how CSR helps a Multinational Company (MNC) during a crisis. This study will analyze the role of private companies (as the example is AkzoNobel) in providing for public needs while gaining economic benefit simultaneously. The Corporate Social Responsibility (CSR) program's design dynamics of creativity continue to evolve across concepts and goals. This design was made in response to the broader community's growing interest and its larger contributions to the nation and state. This study focuses on how state defense values are the basis of CSR activities for the "State-owned Enterprises Present for the Nation" program in increasing nationalism in five own state corporations that actively participate in the program. On the official websites of the companies, a content analysis approach is applied as the study methodology. This study analyzes how CSR news makes the values of state defense the basis of CSR activities in increasing nationalism. A value analysis of how CSR activities are implemented and the ability to implement CSR is based on the country's value of the essential elements of the defense. The purpose of this research is to search the concept of state defense values in CSR practices on five state-owned corporations. The data is processed and analyzed to determine the content of state defense value in the CSR implementation and practice that is used as the basis of CSR activities on state corporations in Indonesia.
Standardization of CSR as a Legal Obligation in Indonesia

The policy requiring CSR especially for companies engaged in the business sector of natural resources has been implemented since 2007 in Indonesia. Previously, the Investment Law had also regulated the obligation to implement CSR as a legal obligation. This article will elaborate on the absence of standard guidelines on CSR mandatory in Indonesia so as to cause legal vacuum and confusion among CSR stakeholders in Indonesia both companies, NGOs and beneficiaries of CSR programs. This article is compiled from a research that uses qualitative research techniques where secondary data collection is done by collecting data and documents in the library while primary data collection is done by interviewing through the distribution of questionnaires to 30 CSR expert persons who come from various scientific backgrounds and professions that are related to the field of CSR. From this research, it was found that Indonesia does not yet have a Standard Guideline on the Implementation of Mandatory CSR Policies, although the policy has been implemented since 2007 through Law No.40 / 2007 on Limited Liability Companies. Then, there are several international organizations that have issued guidelines for implementing CSR programs and their reporting and several ministries have also issued several policies and guidelines regarding the implementation of CSR programs, but neither of them has touched on the implementation of CSR mandatory in Indonesia. Through this paper, it is expected to provide comprehensive information to the public that the importance of standardization and codification of policies and guidelines in the implementation of CSR mandatory programs in Indonesia in order to realize transparent and accountable CSR programs.

CSR is a responsibility that must be implemented by every company, where the company's responsibility is not only on the financial condition. But corporate responsibility (CSR) is also related to all stakeholders included their family employees. The existence of a company can have two impacts, namely positive and negative, therefore the company needs to prevent negative impacts that may arise and can interfere with the company's operations and community activities. This, CSR is very necessary to be implemented in every company. This research uses qualitative research and uses a deductive approach. The results of this study indicate that the implementation of CSR is indispensable in a company, the variable of participation democracy takes part in the establishment of the company and the level of welfare of the Indonesian people is one of the impacts of the success of a company in promoting the concept of CSR.

Karawang Regency is one of the districts that has switched functions from the agricultural sector to industry. Based on the Department of Industry and Trade Karawang regency data, there are 511 Foreign Investors (PMA), 226 Domestic Investors (PMDN), and as many as 9,025 supporting small industries. However, there are always debates about implementing CSR policies because they fail to improve the people's living standards of Karawang Regency. This is evidenced by the HDI ranking of Karawang Regency 16 out of 28 districts in Karawang Regency in West Java. This research uses a descriptive method with a qualitative approach to answer how the implementation of CSR policies in Karawang Regency. It is necessary to describe elements related to data collection techniques, observation, and interviews with informants and FGDs, after which data analysis and conclusion. According to field research, the three aspects of the policy implementation stage in the Regency of Karawang significantly impact CSR policies in companies and SOEs (organization, interpretation, and application). Also found one other aspect that influences the implementation of CSR policies, namely the power of the company owner or owner of government power in Karawang Regency (village government or regional government).
Instrumental, Strategic and Political Conception of CSR
The corporate social responsibility (CSR) literature defines instrumental, strategic and political approaches to CSR. The strategic approach to CSR in transnational corporations goes beyond the customer orientated short time issue management, persuasion and financial performance, but emphasizes a long time perspective based on planned, implemented and evaluated projects to create business value. The research in this paper focuses on the corporate communication directors conception of corporate social responsibility. Participants from transnational and Turkish national corporations have been interviewed and qualitatively analysed. Thefindingsshowthatallinterviewedparticipantsare enthusiastic about the concept of social responsibility. They define CSR as the " raison d'etre of the company " or " the sine qua non of sustainability is social responsibility ". Two of three Turkish national corporations' CSR conception can be defined as a stage between instrumental and strategic, because CSR in these corporations is more customer orientated with limited or short time influence at the one side, but also implemented for sustainability and to create business value on the other side. The CSR perspective of a Turkish national company based on a farmers union established half a century in order to serve the interests of the local community and stimulate development is clearly political. The conception of sustainability and responsiveness to stakeholders was inherent in the establishment of this particular firm. We conclude that there is a remarkable agreement between the CSR directors' perspective and the firm's organizational behaviour and that the cases follow the classification described in the literature to some extent.

The involvement of community empower companies to participate in sustainable development through Corporate Social Responsibility (CSR) programs in the era of governance are important, particularly those intended for rural or marginalized communities. However, in East Java, policies on the CSR program have not been well established, so the cooperation between the corporate governance management with the government's CSR program has not demonstrated synergic performance. Such conditions have not been determined due to the lack of operational level policy (government regulation) so that the CSR program in East Java Provincial Government has not performed well. The purpose of this paper is to analyze what and how governance reforms that needed to be done so that the CSR program performs well.
Stakeholders Perception on Mandated CSR Laws in Indonesia

Indonesia has been known as one of the first country having CSR mandatory regulatory approach. This paper tries to examine the perception of the companies and the local community members on the implementation of this CSR law. The paper firstly identifies what has been mandated by CSR law in Indonesia, and some circumstances that may affect the implementation of CSR law. Then, it continues to examine the companies and local community perceptions. The research finds that the implementation of CSR law is challenged by some circumstances in the local context, as a result of the decentralization that has distributed the power and authority to the local stakeholders. The dark side of decentralization such as the local corruption and bribery has impacted the way CSR implemented in the field. Therefore, the implementation of the law probably are not in line with its goal anymore, which is to improve the local people life.
CSR in Indonesia: Company's Perception and Implementation

This paper intends to describe current issues of CSR in Indonesia. First, this research drew a picture on how business community Indonesia perceived CSR, followed by an analysis on how was that CSR has been actually implemented in the last two year of 2014 and 2015. Finally this research explained whether CSR implementation influenced company`s performances, in terms of traditional financial and non financial performance both in 2014 and 2015. Using ISO 26000 (guidance on social responsibility) standard in order to determine CSR index as measurement of CSR implementation in 200 top Indonesian listed companies for the year 2014 and 2015, the CSR implementation data was then paired with the company’s performance data in order to find the relationship between CSR implementation and company’s performance.
