The Belgian model of budget cooperation has been originally devised to maintain Belgian economic and monetary union through a close follow-up of Regions and Communities deficits and debts. Enlarged to take into account European budgetary constraints, this model has devoted a growing attention to the local sector, as detailed in this paper. Up to now, budget and debt assignments for local authorities have been agreed by the supervisory authorities – the Regions – despite the lack of available data on a regional basis. Developments could come from greater involvement and responsibility from local authorities themselves.

Contextualization: The new model of State, which is based more on the stereotype of a constitutional State, imposes an objective of not allowing any constitutional directive to be distorted by the Public Administration. Thus, a recent discussion has been raised among Brazilian academics, following the presentation by the new Law of Acquisition of Public Services and Products; Law 4.253/2020, already approved, which focuses on the requirement of governance by state suppliers, in the same way as is already required of private companies. Si le droit administratif colombien se fonde sur les mêmes principes que le droit administratif français, l’interdiction de l’arbitrage aux personnes morales de droit public n’a pas été reprise en Colombie. La jurisprudence a admis l’application de l’arbitrage aux contrats publics même en l’absence d’autorisation législative. Le principe de légalité, la continuité du service public et le respect de l’intérêt public fondent le droit des contrats publics. Cependant, celui-ci se développe sous l’égide du droit commun des obligations et des contrats et il partage les aspects essentiels du droit de l’arbitrage : l’autonomie de la volonté et la liberté contractuelle. Procédures et gestion budgétaires au niveau des collectivités locales

Budgeting is not only a technical process but also a highly political one because technique and discretionary judgement are intertwined, and different actors have different interests. Budgetary procedures can and should help to reduce various types of information imbalance and help local authorities to deliver services more effectively. This study highlights certain sensitive areas in the budgeting process, analyses the solutions tried by the different Council of Europe member states and identifies practices that seem particulary worthwhile. It suggest finally conclusions and guidelines for central governments and for local and regional authorities.

Towards the end of the twentieth century, the trend that seemed to be emerging in many countries was towards a certain distribution of roles whereby transport operations were assigned to the private sphere and infrastructure to the public sphere. Over the past ten years, however, growth in the use of PPPs has signalled a significant change which completely redefines the issue of infrastructure funding.
