ABSTRACT "Die Clearingstelle EEG", an alternative dispute resolution authority out of the state's court system, is established for preventing and solving disputes arising from the Renewable Energy Sources Act. Indeed, in addition to the resolution of current disputes, it is possible to apply for the services of this institution for preventing potential future disputes as the interpretation of controversial expressions in the Renewable Energy Sources Act is within the scope of the duties of Clearingstelle EEG. Clearingstelle EEG is an independent and neutral legal entity subject to private law. The institution has no judicial authority other than the arbitral disputes and applications to Clearingstelle EEG are discretionary; its scope of activities include Mediation (Einigungsverfahren), Vote Action (Votumsverfahren), Arbitration (Schiedsrichterliche Verfahren), expert opinion (Stellungnahmeverfahren), recommendation (Empfehlungsverfahren) and indication action (Hinweisverfahren). ÖZET Alman hukukunda, devlet yargısı dışında, alternatif bir uyuşmazlık çözüm merci olan "Die Clearingstelle EEG", Yenilenebilir Enerji Kanunu'ndan kaynaklanan ihtilaflarının önlenmesi ve çözüme kavusturulması amacıyla kurulmuştur. Gerçekten, mevcut uyuşmazlikların çözümünün yanı sıra, gelecekte doğabilecek ihtilafların önlenmesi amacıyla da söz konusu kuruma başvuru mümkündür. Zira Yenilenebilir Enerji Kanunu'nun uygulanmasında karşılaşılan tartışmalı ifadelerin yorumlanması da Clearingstelle EEG'nin görevleri arasındadır. Clearingstelle EEG, bağımsız ve tarafsız bir özel hukuk tüzel kişisidir. Tahkim uyuşmazlıkları hariç olmak üzere yargılama yetkisi bulunmayan ve başvurunun ihtiyari olduğu bu kurum, Arabuluculuk (Einigungsverfahren), Uzlaştirma (Votumsverfahren), Tahkim (Schiedsrichterliche Verfahren), Bilirkişilik (Stellungnahmeverfahren), Tavsiye (Empfehlungsverfahren) ve Yorum Kararlan (Hinweisverfahren) verme faaliyetlerinde bulunmaktadır.
