Welfare Regime Transformation in Indonesia: A Citizenship Debate

This article discusses Indonesian welfare regime outlook by using citizenship framework. It is argued that transformation of Indonesian welfare regime from productivist characteristic to universalism has been disrupted by the discourse of communitarian citizenship and market citizenship that has become path-dependency of welfare configuration in contemporary Indonesia. This circumstance has become an endogenous factor that obstructs innovations and changes within an administrative body of universal social protection. By using evidences from Indonesia experiences, this article can be used to develop a further understanding on the complexity of relations between welfare provision and citizenship in the context of developing countries.

Political law, political economy and political economy law are three concepts that arise from a deep understanding of the 1945 Constitution as statutory norms. A series that tries to align the interests and desires of the 1945 Constitution with the interests of the state and the people's wishes, which often have different views and practices between the two. This article aims to analyze the direction of Indonesian economic law politics policy in the Welfare State conception based on the 1945 Constitution. The method used is a normative juridical approach with descriptiveanalytical techniques using qualitative juridical data analysis methods. This article concludes that the direction of Indonesian economic policy shows some adoption of neoliberalism values that have become references in the formulation of monetary policy in Indonesia. As a government law politics, the direction of economic policy must be oriented towards the institutionalization of the status of the Indonesian nation to advance the general welfare. And the "vehicle" for institutionalizing this staatsidee, as formulated in Article 33 of the 1945 Constitution of the Republic of Indonesia, is the concept of a welfare state.

The purpose of this study is to ascertain the relationship between investment law and state sovereignty, and then to construct national investment law politics in the future in order to advance economic development and retain independence. This research is normative by taking a statutory approach and a conceptual approach. The study's findings indicate that investment is critical for economic growth and job creation. In the last decade, Indonesia has successfully reduced the poverty rate from 11.96% in 2012 to 9.22% at the end of 2020. However, the rate of inequality in Indonesia is considered the highest within the region. Therefore, it is pivotal for Indonesia to strengthen and expand its welfare system in order to overcome the inequality. This paper aims to examine the institutional arrangement of welfare regime in Indonesia especially the health care policy. This paper implement qualitative method by examine secondary resource such as journals, articles and government report to gain understanding about institutional arrangement on welfare system in Indonesia. The Indonesian Constitutional Court Decisions as a Social Engineer in Improving People's Welfare

One of the national goals of the establishment of the Indonesian state is to improve the people's welfare. To support this achievement, the law comes to bring its functions as a social engineer. It means the law plays a role in influencing the occurrence of a social change in a planned manner to achieve prosperity. The Constitutional Court decision is one of the sources of law that is expected to improve people's welfare. This article aims to analyze the Constitutional Court decisions that have significant implications for maintaining and improving the people's welfare in Indonesia. The methodology used in this research is a normative juridical with library research and case study approaches on decisions declared by the Constitutional Court in the last five years (2013-2018). This study found that there are socioeconomic rights of citizens that have been protected and restored by the Constitutional Court. These erga omnes decisions indirectly contributed to the improvement of the people's welfare, in particular regarding the rights of a pension fund, a minimum wage and severance pay. This article concludes that an effort to maintain and improve the people's welfare in Indonesia can also be enforced effectively through a social engineering based on the Constitutional Court decisions.

Since its first announcement in March 2020, the number of positive confirmed patients as well as patients under surveillance has increased exponentially. Recognizing the impact of Covid-19 on the poor, the government reallocated expenditure budget by increasing the amount of aid to the community. This paper focuses on social safety net policies, mainly in Sembako Program as noncash social aid. This aid is actually not any new programs, as it have been around since 2017, but the Covid-19 pandemic is adding to the economic burden of the household so the aid is increased in amount. This paper puts the emphasis on how the actual social safety net policy must be implemented, not only look at how policies are carried out, but also look at how policies should be carried out, as well as predict their impact when they are done. It is undeniable that the problem of bureaucratization always comes up in every policy, with no exception for social aid policy. By mapping out obstacles, this paper provide a number of key solutions for resolving the problem

The purpose of this study is to analyze the factors of natural resources, income per capita, infrastructure, education, institutions and population against inequality between regions and welfare in Indonesia. The study uses panel data regression analysis analyzing secondary data consisting of 33 provincial cross section data and 10 years time series data (2008-2017). The results of the study found inequality between regions in Indonesia with different intensities. Factors of natural resources, income per capita, infrastructure, education, wealth and population have a positive and significant effect on inequality between regions. Furthermore, 2% of the inequality variables between regions affect the level of welfare and the rest are influenced by natural resources, per capita income, infrastructure, education, institutions and population.
