Proof of land rights ownership for every Indonesian citizen is in the form of land certificates. The certificate is a proof of right consisting of a copy of the land book and a measurement letter determined by the National Land Agency with the aim of creating a strong means of proof with the provisions of the Basic Agrarian Law No. 5 of 1960 so that a legal certainty is achieved. Matters are examined, namely regarding the definition of legal actions referred to in article 1365 of the Civil Code which is applied in a court decision. In a law there must be certainty and protection for holders of land rights certificates.
The Issuance of an Overlapping Certificate of Land Rights in Indonesia

BPN as the agency in charge of land registration has an important role in preventing the existence of overlapping certificates. However, if an overlapping certificate has occurred, BPN can only become a consultant and witness who is asked for information until the overlapping certificate can be issued. The research method used is empirical legal research. The analysis used Is descriptive analysis, namely the data that has been collected is processed for the formulation of the research conclusions. Then the research data were analyzed in depth. The results showed that the emergence of multiple certificates was caused by many factors, one of which occurred in Denpasar City and Badung Regency due to irregular data after the expansion of the Regency so that many data were not found, besides that there were several certificates that existed before 1980 and the certificate, which was never tansferred to be one of the triggers. Legal protection for ownership of land rights against the emergence of an overlapping certificate Is that the owner of the certificate can file a lawsuit due to the existence of the same certificate in the same field and carry out evidence in court for the disputing parties. The authority of BPN is to carry out land administrative activities ranging from land data collection to issuance of certificates. In addition, BPN also has a role as a mediator or witness when an overlapping certificate dispute occurs because BPN only issues 3 certificate after the data is truly valid. BPN will wait for a court decision with permanent legal force (inkrah) to further cancel the issuance of the certificate that is disputed in court.

The law regarding agrarian has undergone many changes. The debate regarding the status of land ownership still needs a lot of study. Therefore, this research is interesting to do in order to findout the subject of a land ownership by virtue of the agrarian law (UUPA). This study using a normative juridical approach and uses an analytical descriptive in writing the data by describing the secondary data so that it is factual, accurate, and systematic. The source of this research comes from statutory regulations, the existence of decisions that have the court basis then analyzed using a qualitative way. This study aims to determine how the Ratio Decidendie judges and legal consequences of the implementation of verdict on cancellation of certificate of ownership that does not remove the right to land ownership in the State Court of Kendari. The research was conducted aiming to find out how the process of settlement of land sale and purchase disputes was carried out. The research was conducted with reference to the applicable laws and regulations. Data analysis using data equations that have been obtained at the time of the study finally obtained the following research results: (1) Based on the decision of the case Number: 62/Pdt.G/2013/PN. Tk is a problem in the implementation of the sale and purchase of joint assets carried out without the consent of one of the parties. The decision of the panel of judges in Decision Number : 62/Pdt.G/2013/PN.Tk which rejected the plaintiff's claim was correct. This is because the disputed land is not a joint property (gono gini) of the Plaintiff and Defendant II. Defendant II did not act for himself but only served as a "proxy". The position of Defendant II who only acts as the "power" to sell the disputed land is reasonable because as has been considered above.

This study aims to examine the weaknesses of obtaining property rights on state land and the legal consequences of the issuance of property rights on state land through a legally flawed Complete Systematic Land Registration (PTSL). The method used is a normative legal writing method, using a statutory approach, a conceptual approach, and a historical approach. As an analytical tool for the legal issues studied, this study uses the theory of legal certainty, the theory of legal protection and the theory of legal justice. Based on the results of the analysis, it can be found that there is an inconsistency of norms between the Minister of ATR/BPN Number 6 of 2018 and Government Regulation Number 24 of 1997, namely Article 33, Article 22 paragraph (2), Article 24 paragraph (2) of the Minister of ATR/BPN Regulation No. 6 of 2018. The existence of the inconsistency of these norms creates legal weaknesses and uncertainty in the community regarding the suspension of BPHTB and PPh debts, a statement of ownership of rights in good faith, the principle of publicity for the announcement of physical data and juridical data, the application of the principle of contradictory delimitation in determining the boundaries of land parcels through Complete Systematic Land Registration (PTSL). The legal consequences of the issuance of a certificate of ownership of state land through a Complete Systematic Land Registration (PTSL) which is legally flawed, namely cancellation due to a defect in administrative law and cancellation by implementing a court decision that has permanent legal force.

This Agrarian law study analyzes the dispute of ‘Eigendom Verponding’ land taken over by the State. Agrarian Legal is principally different in every region and State. Agrarian Law describes the land rights, both right of communal property, rights of individual property, or even King's property or property of the state. Indonesia has adopted individual and communal right as well as selfgovernment property right. Land disputes are analyzed through conflict theory; and since related public policy and ownership, then another approach is through the public policy and ownership theory.

This study aims to analyze: 1) The juridical implication is the existence of overlapping land certificates issued by the Cilacap Regency National Land Agency. 2) The roles and responsibilities of the Land Agency of Cilacap Regency in efforts to resolve land ownership disputes caused by overlapping land certificates. The approach method used in discussing this research problem is a sociological juridical approach. The specification of the research used descriptive analytical research. This type of data used primary and secondary data. The data analysis method used in this research is qualitative data analysis. The results of the study concluded: 1) The juridical implications of overlapping land certificates issued by the National Land Agency of Cilacap Regency and in one of the certificates being invalid. There are administrative legal defects that can result in the invalidity of a land title certificate. In addition, overlapping land certificates also creates legal uncertainty for land certificates. The existence of administrative legal defects in the issuance of the Certificate of Ownership has been canceled based on the Decision of the State Administrative Court Number: 28/G/2021/PTUN.SMG. 2).
