Declaration of nullity for the divorced and remarried couples: A Study Case in Manado Diocese

This research seeks a permanent juridical solution for the pastoral problem of catholic split marriages. Many such couples need the Catholic Church's intervention to give way out of their family problem. And there is indeed a solution provided by Pope Francis with the reform of Canon Law regarding the issue of divorce and remarried couples of Catholic families. The research method is identifying and documenting what has been done in the diocese of Manado by Fr. Jan van Paassen and studying his approach to dealing with families needing help. Bibliographical research indicates the method of Fr. Jan van Paassen in dealing with the problem. It has a solid foundation and a reasonable argumentation which may be accepted by the authority of the Church based on the Calon Law itself. May this research help solve the pastoral problem of the catholic split marriage on the one hand. On the other side, the indissolubility of marriage remains the permanent teaching of the Catholic Church.

This paper analyzes the rules of the Moroccan Family Code that regulate the dissolution of marriage and its effects, from the point of view of Spanish public order. The purpose is to establish its applicability by the Spanish Courts to meet the demands made in this regard by the Moroccan immigrants residing in our country. This is based on a strict concept of public order and respect for multiculturalism as a factor of integration in European societies. The study is supplemented by a critical examination of the cases law issued in this sense En este trabajo se analiza las normas del Código de Familia de Marruecos que regulan la disolución del matrimonio y sus efectos, desde la óptica del orden público español. La finalidad es establecer su aplicabilidad por los Tribunales españoles para atender las demandas que en este sentido se formulan por los inmigrantes marroquíes que residen en nuestro país. Para ello se parte de un concepto estricto de orden público y del respeto a la multicultularidad como factor de integración en las sociedades europeas. This article addresses Law Number: 11,340 of 2006 – better known as the Maria da Penha Law – and its implications for the Brazilian legal system, demonstrating the importance of this legislation for the protection of women victims of domestic and family violence, as well as for confronting different forms of violence perpetrated against women. Furthermore, it exposes data about women's perspective and experience of domestic or family violence, as well as about the aforementioned law.
CONSENSUS PRACTICES ADOPTED FOR THE SOLUTION OF LEGAL AND FAMILY CONFLICTS WITHIN STATE COURTS (Atena Editora), 2023
The family is a locus of ongoing relationships permeated sometimes by affection, sometimes by clashes. Faced with the complexity that emerges from these marital and/or parental connections, it is necessary to adopt consensual practices that encompass this tangle of legal, sociological and psychological issues, so that the parties involved can have autonomy in decision-making. The research problem consists of identifying, within the scope of legal-family conflicts, which consensual practices have been made available by the Brazilian Courts of Justice and whether these practices are properly regulated, whether in terms of methodology, training and qualification of professionals. The logical-deductive approach method was adopted based on the indirect documentary technique, and in the legal field, legislative and doctrinal ones were used, and in the statistical plane, existing data extracted from official bodies were collected and used. As a result of the research, it was found that the Courts of Justice have been adopting Restorative Justice, the Divorce and Parenting Workshop and the Family Constellation as self-compositional tools aimed at resolving family disputes. It was found that the first two practices are duly regulated, but the Family Constellation does not have specific regulation, with criticisms, among other factors, due to the lack of scientific knowledge, methodological regulation and criteria for training and training of working professionals. The proposal is to promote actions by the Judiciary, in order to encourage, support and disseminate the systematization of duly regulated consensual practices (Restorative Justice and Divorce and Parenting Workshop) and, on the other hand, to make efforts to scientifically investigate the use of the Family Constellation to – depending on the result of the investigation – regulate what has not yet been applied and improve what has already been applied, in order to endorse or not its application under the scientific bias.
Impactos da Mudança na Lei do Divórcio no Brasil e a “Extinção” da Separação Judicial

Este trabalho explora as conexões entre a mais recente mudança legislativa referente ao divórcio – a Emenda Constitucional n.66 – e seus impactos nas decisões individuais a esse respeito. Para tanto, analisa-se, por um lado, quão imediata são as repercussões comportamentais para esse tipo de mudança legislativa e, por outro, como a separação judicial é afetada pelo fato que ela não mais é um pré-requisito para o divórcio. Os resultados mostram que as taxas de divórcio e de casamento aumentaram significativamente, enquanto a separação judicial decresceu. Isso mostra que a lei foi bastante efetiva em menos de seis meses e que a separação judicial parecia ser utilizada quase que exclusivamente por seu status de obrigatória.
