Abstract
The illegal enslavement of free and poor men, subjected to living and working conditions similar to those of slaves, was reported throughout the nineteenth and twentieth centuries. Article 179 of the criminal code of the empire was a legal attempt to combat such a practice which received less attention in the republican penal codes, not being included in the first, dated 1890, and receiving lighter sentences in the second, dated 1940 and drafted as article 149. Article 149 of the Republic's second penal code proved to be an ineffective legal instrument to suppress illegal enslavement and was only perfected in 2003 through the struggle of the Pastoral Land Commission initiated in the 1970s and 1980s as part of the strategy to combat work analogous to slavery.
