La Privación Injusta De La Libertad, (en adelante P.I.J.D.L.), es un tema de gran relevancia en la práctica del derecho administrativo, puesto que consiste en una grave violación al derecho fundamental a la libertad personal. Es un tema que ha tenido un amplio desarrollo jurisprudencial, sobre todo a raíz de la constitución de 1991, y de la fórmula de Estado social de derecho, debiendo cumplir con procedimientos más estrictos y garantistas al momento de privar a cualquier colombiano de su libertad. Se usó el método de investigación cualitativa, hermenéutica, y será de tipo descriptiva, dado que llevaremos a cabo un estudio de la jurisprudencia del C.D.E., y especialmente la indemnización de perjuicios inmateriales. This chapter aims to identify how Constitutional texts refer to the prison population, con sidering both the content of rights and guarantees, as well as suspensions and exceptions established for persons deprived of freedom. It first presents the results of a survey of the laws contained in the current Constitutions of Brazil, Colombia, Mexico, and Peru, which are the four countries with the highest number of incarcerated persons in Latin America, surpassing a total of one million people. The focus on constitutional laws, however, does not allow for observation of the repertoire of prisoners' rights that are a part of the infraconstitutional legislation of these countries, or provided for in instruments developed starting in the mid-twentieth century, within the scope of UN and the OAS. Therefore, this research is concerned with analyzing only the norms explicitly included in the constitu tional text of these countries. The third part of the text addresses the way Constitutional Courts, particularly in Brazil and Colombia, have been facing this issue in the context of the 'state of unconstitutional affairs' doctrine.
The crisis of detention and the politics of denial in Latin America

This article assesses the causes of the crisis of detention in Latin America. It is argued that this crisis, which manifests itself in overpopulation of the region's prison systems, deficient infrastructure, prison informality and violence propelled ultimately by political processes, is mostly related to, on the one hand, disastrous human rights conditions inside Latin American prisons, and on other, the political denial of these conditions. This denial produces a state of institutional abandonment that is preserved by the interests of politicians and bureaucrats, who are engaged in denying prison violence and human rights abuses while simultaneously calling for more punishment and imprisonment.
Penitentiary Treatment: Its Perspectives in Argentina. Legal and Criminological Analysis

Argentine legislation (Law 24,660 and its amendments) regulates penitentiary treatment both as a stage of the progressive regime and as the activity of prison administration itself, made up of specific programs, whose objective is the social reinsertion of the convicted person. This chapter proposes, on the one hand, to analyse the issue of treatment from a regulatory perspective, outlining its distinctive notes, while also describing and problematizing the criminological aspects that characterize it. In this way, this integration (legal and criminological analysis) allows for accounting for those key elements related to carrying out treatment in prison facilities in Argentina.
The rebirth of the prison in Latin America: determinants, regimes and social effects
Throughout the last three decades, almost all Latin American countries witnessed a dramatic growth of their inmate population that is indicative of the rebirth of the prison in the region. This article contextualizes the rebirth of the prison in contemporary Latin America in empirical and theoretical terms. To this end, it offers a discussion of the expansion of Latin American imprisonment, changes in the region’s prison regimes and their embeddedness within wider social and economic contexts, as well as of the impact of institutional histories, larger economic and political transformation processes and globally circulating penal ideas and institutional models, all of which contribute to the growing punitiveness of contemporary Latin America states and politics.

The Ecuadorian prison system has conditions that denotes a questionable validity of rights for inmates. In this context, access to justice (ATJ) is one of the most important rights to guarantee the rehabilitation of persons deprived of liberty (PDL) since confinement and the reality of the prison generate unique barriers for the ATJ. Through the analysis of in-depth semi-structured interviews, the ATJ experiences of the PDL and of actors linked to the social rehabilitation system are identified to state critical points in relation to the validity of this key right.
