Opportunities and Challenges: E-Commerce in Indonesia from a Legal Perspective

The development of e-commerce in Indonesia has encouraged the creation of a digital economy. On the other hand, this business model presents various legal challenges that are no less interesting to anticipate. By applying normative research methods and using statutory and comparative law approaches, this study examines two issues. First, what are the legal aspects that are used as the basis for the role of Information and Communications Technology (ICT) in capturing e-commerce opportunities? Second, what are the legal challenges ahead with the rapid growth of e-commerce in Indonesia? This study concludes that normatively Indonesia already has various regulations in the field of cyber law that support the use of ICT in e-commerce. However, it needs specific regulation. Objective: The importance of an electronic deal is the validity of the electronic information contained in it. The Legal Effort of E-Commerce Fraud’s Victim According to The Indonesian Consumer Protection Law

The study aim to identify explain the legal efforts that can be taken by the victim of E-Commerce fraud. This research is descriptive normative legal research, which use secondary data (literature) in the form of primary and secondary legal materials. The approach taken is the Legislative Approach and the Legal Concept Analysis Approach. The results of the research show that the legal effort can be taken by victims of E-Commerce fraud, victims can make efforts outside the court, namely, complaints to the Indonesian Consumers Institutions or sues the merchant through courts within the general court environment. Settlement of disputes outside the court doesn’t eliminate criminal responsibility as regulated in Law. If an out of court settlement effort has been chose, a lawsuit through the Court can only pursued if the effort is declared unsuccessful by one of disputing parties.

The qualitative research through the phenomenological approach, the results of the study showed that: protection of the parties in e-commerce transactions and specifically giving the customer a coverage in e-commerce transactions, Need to make legal regulations regarding cyber law including so that the provisions on e-commerce transactions can be displayed. With these arrangements, the rights of consumers as electronic technology users in the trading process, especially in conducting e-commerce transactions, can be more secure. For consumer protection in e-commerce transactions are not yet accommodation in the consumer protection ACT. This is because of the characteristic of special e-commerce transactions, especially the transnational Transkei that crosses the boundaries of applicable national law. They must address legal arrangements about electronic transactions in Indonesia from the rules of legal certainty so that society believes in conducting electronic transactions. This paper aims to provide insights into the consumer protection in e-commerce in Indonesian context. In 2015, ASEAN Economic Community (AEC) which includes Indonesia as a member, was established for a regional economic integration by reducing the transactions costs of trade, improving trade and business facilities, as well as enhancing the competitiveness of Small and Medium-Sized Enterprises sector. AEC is expected to promote electronic transactions. Even though Indonesia has the Law Number 8 Year 1999 on Consumer Protection, this law does not regulate specifically on electronic transactions. A few decades ago, the internet was only known to a handful of people who had an interest in the world of technology, especially computers. However, with the increasing years and times, people's interest in the internet is growing rapidly, and the internet has even become an inseparable part of their lives. Now, the internet is not only for entertainment and information; it has even been used as a medium of business and trade known as Electronic Commerce (E-Commerce). E-commerce is buying and selling carried out via the internet, which can benefit consumers. Still, on the other hand, sometimes it is detrimental to consumers because they often do not get the protection that provides certainty in a dispute. In an ecommerce business transaction, which is a characteristic of business-to-business transactions where business actors conduct transactions with fellow entrepreneurs, business-to-consumer transactions are carried out by business actors with consumers themselves. The benefits of ecommerce transactions for consumers include that consumers can make transactions for 24 hours without leaving their houses and do not require transportation for selling costs. Consumer protection for e-commerce is regulated by Law Number 8 of 1999, concerning consumer protection for online transactions, or e-commerce. In the Trade Law, the regulated E-commerce trading system stipulates that every person or business entity that trades goods or services must provide complete and correct data and information.
