The legal innovation brought by law 13.964/19, inserting § 9º in article 2º of law 12.850/13, brought modification to the serving prison sentences those who convicted of joining criminal organizations. The norm, in this turn, prohibited progression regime and others benefits when the prisoner keeps a relation with the criminal organization for which he was convicted. The criminal organization is defined and typified by the law 12.850/13. However, doing an expansive interpretation, other institutes can be qualified by criminal organization, like the criminal association, the privative militia or drug trafficking groups. The mean problem is the questionable possibility of an expansive interpretation of the term "criminal organization" and, if it possible, an analogical application of the new norm, especially when facing prisoners convicted under the drug law.
