General Election in Pakistan: A critical study
An election is a critical component of democratic governance. In the formation of an elected government, elections play a decisive role. The Election Commission of Pakistan derives its authority from the constitution of Pakistan 1973. It deals with conducting elections in constitutional intervals. The Chief Election Commissioner of Pakistan is the head of this institution. However, the forty-eight-year electoral history of Pakistan is full of accusations, rigging, and malpractices. The defeating parties do not accept the electoral results that create uncertainty, political instability, and erode democracy. The paper examines the "Part VIII of the constitution of Pakistan." It delves into the electoral history and critically evaluates the role of subsequent elected governments in manoeuvring the disagreements over the results of the General Election. It argues with electoral reforms and analyses their applicability in the next general elections. It answers why these reforms did not resolve electoral issues. The paper contributes to clarifying ambiguities that persist with elections. It identifies issues and suggests recommendations to make the electoral process transparent. This research is conducted using various approaches, i.e., critical, analytical, deductive, and qualitative.
Building a Case for Reforming the Electoral System of Pakistan

Electoral systems are set of rules and procedures which determine how voters cast their votes and how the votes are converted into representative seats. Beyond this, each electoral system has its own impact on how the political system functions. From this perspective, the author has tested the discontents of the Pakistani electoral system, the first-past-the-post (FPTP) taking the election data of 2002, 2008, 2013 and 2018. The research finding showed that the FPTP electoral system is ill devised to the Pakistan’s current needs and realities. In view of such discontents, there is a genuine concern of reforming the Pakistan electoral system. The question remains, however, which electoral system best suits the Pakistani situation from the bulk of alternatives? Elections are means of making political choice by voting. They are used in the selection of leader and in the determination of issue. This conception implies that voters are presented with alternatives that they can choose among a number of proposals designed to settle an issue of public concern. Elections are central to the existence stability and development of democracy. It is important to understand what the word Election means. The encyclopedia of social science defines election. The process of selecting the officers or representative of an organization or from by the vote of its qualified members. Election could be defined in a technical sense as the process by which an office is assigned to a person by an act of voting needing the simultaneous expression of opinion by many People. In a social sense Election is the process by which a person is liked to an office with due provision for the participation of the people meant to come under the officer is authority. Accordingly, it is observed that this social aspect of election give the idea of ruling a society with the consent of the ruled, which tantamount to democracy and differentiates it from appointment. An election is meant to given the electorates the opportunity to decide who should rule them, and what the ruler’s policies and programs should be. Thus, in the words mayo “the main purpose of the whole electoral process is to produce a government vested with legitimacy. Electoral process is an important issue in relation to political growth and democratic stability of any society. Before any country’s electoral process is to be awarded a pass mark, some salient question requires appropriate consideration. Such questions include the following: Is the franchise restricted or Universal in a state? Are there adequate provision made by the institutions whose study is to conduct elections in such a manner to guarantee free and fair Election? Is there freedom of expression? Is there freedom of association? Is there really an independent judiciary has press given free hand to operate? Any country without these requirements is assumed undemocratic. The Electoral system of government is the process which causes political growth and democratic stability of any society or country. It is also a process by which the citizens of a democratic country select through either direct voting indirectly, those who will represent them in the parliament, so as to protect the interest of the general public or country. However, as a result of the growth of population great expansion of counties specialized art by of modern government direct representation or democracy practiced in the ancient small Greek city whereby the met together in the place has given way for indirect representation. Therefore, a body to conduct the election known as election commission should be made to be independent and non-purism. Hence Pakistan is a well-known democratic country? What are the functions of elections and why it is necessary to hold elections in a country? What are the measures that should be taken by government in order to ensure free and election in a country? The research is equally aimed at pointing out all those practices which are not part of the normal electoral process, the extent of deviation and to inform a better understanding of the nation’s electoral process are well as putting formed suggestion that electoral process as well as putting formal suggestion that might correct the anomalies, and the pattern of electoral process in Pakistan. 8 TH CONSTITUTIONAL AMENDMENT AND REJUVENATION OF PAKISTAN'S PARLIAMENTARY SYSTEM: AN ANALYSIS

This article is the critical analysis of the 18 th amendment to a renewal of the parliamentary system. In Pakistan's Parliamentary history, the Eighteenth amendment considered an important milestone and it empowered parliament more than ever before. The 18th amendment of the constitution of Pakistan was passed by the parliament in 2010, from the last 37 years of the constitutional history; just the first decade of the 21 st century was bringing the hope of development for Pakistan, which was to adopt the 18 th amendment in the constitution. It eliminates the Presidential Powers unilaterally to dissolve or suspend the Parliament and revolves Pakistan from a semi-presidential system to the parliamentary form of government. The supremacy of Parliament, Judicial Commission, and an independent Election Commission has been reformed on an institutional basis. The eighteenth amendment presented a step forward that encompasses many missteps to creating an economic union and has reinforced an unfashionable model that is 'pot belly' (federalism of provinces), whereas another model is an 'Hourglass' (federalism of local government). These two models are more suitable according to the circumstances of Pakistan. The 18th amendment has reinstated the parliamentary and federal spirit and reinstated the parliamentary character of Pakistan's Constitution, which was subverted during military rules. The paper analyzes how the eighteenth amendment empowered parliament more than ever before and how better results have appeared with development. The paper also analyzes that after the constitution making in 1973how the eighteenth amendment marks the 2nd twist towards democracy. The research work is analytical as well as descriptive in nature.

Abstract : The model of democracy has been universally accepted as the soundest, most people-oriented and efficient form of governance. It is currently the most widely employed administrative mechanism in the world, with nearly 167 countries currently making use of it. However, the ancient Athenian system presents a number of flaws that may provide different outcomes to different nations based on their economic and societal setup. This article seeks to provide a viable solution to counter these flaws and enhance the system of governance in countries across the world. The contours of this article deal with the functioning of a democracy, with special emphasis laid on the Indian administrative setup, and the various human traits that can serve as effective parameters for the proposed solution. This article primarily seeks to highlight the various fallacies of democracy and the need to counter such demerits in order to enhance the system of governance currently in practice. This article makes use of various analogies cited by different authors and makes use of comparative analyses between various nations to highlight the variance provided by a democratic setup and its outcome. The focal point of this article emphasizes on the need to implement a Political Eligibility Test (PET) to increase the efficiency of administration and quality of elected representatives in the Indian political arena. It shall also contain a basic framework of the suggested PET which shall function as a guiding model for its legislative implementation. The latent objective of this article is to alter and develop the current legal machinery to incorporate the changes necessary for improving the model of governance currently employed by various nations and to increase the quality of elected representatives capable of making better decisions, informed choices and sound laws for the benefit of the nation.
An Analytical Study of Lower House in Pakistan: Legislation During Civilian and Military Rule
A legislature is one of the strongest pillars of a state where legislation is made with the consent of the two-thirds majority of the House. The legislative body of Pakistan comprised President, National Assembly, and Senate. The National Assembly forms on the basis of General Elections in which people elect their representatives to make laws for them. In Pakistan's chequered political history, this institution remained unable to establish credibility in society. Since the promulgation of the Constitution of 1973, the Lower House has been dissolved seven times by either military or civilian rulers, and it also remained non-existent until ten years. As per the Constitution, it was dissolved only once in 1977 on the advice of the Prime Minister to the President. General elections were also held during military regimes, and the House had been formed under it, but there was a difference between the legislation passed during civilian and military-led eras. The paper examines the role of the Lower House in the Constitution of 1973. It deals with its mandate and responsibilities. It analyses the legislation passed from this House during military and civilian rule periods, including the amendment bills that affected the governance system in Pakistan. It identifies issues and challenges the lower House has to face in regard to its smooth functioning. The paper suggests recommendations to improve the sanctity and credibility of this House that leads to strengthening democracy in Pakistan. The paper adopts analytical, qualitative, and deductive approaches to carry on this research work .
65 ] ELECTORAL SYSTEM IN LOCAL GOVERNMENTS: A CASE STUDY OF PAKISTAN
The sole aim of this paper is to examine the electoral system used in LGs ordinances issued by the military rulers in Pakistan during different eras. Mainly it covers three major Local Government Ordinances (LGOs) i.e., Basic Democracies (BDs) 1959 issued by General Ayub Khan, Local Self Government (LSG) 1979 issued by General Zia-ul-Haq and Devolution Plan (DP) 2000 issued by General Pervez Musharraf. The colonial system of LGs continued in Post-Colonial Pakistan and a few reforms were seen in the basic electoral structure. Ayub and Zia both used indirect and non-party based election in LGs to manipulate the system in their favor. A visible change occurred during Musharraf regime with his introduced reforms in LGs but basic electoral structure of non-partisan with few others colonial legacies remained intact. This system still needs continuity along with further reforms to run on permanent bases in Pakistan.
