The current situation of legal education is analyzed. In the modern world, quality legal education is a key component in ensuring the proper functioning of the entire legal system. Legal science began to appear fragmented and improved in ancient times. This is particularly true for Ancient Greece and later Ancient Rome, where legal doctrine and its practical application began to gain importance in society. Today, the field of law is closely related to the branches of public management and administration, as well as to the political sphere. Considering legal education in a broad historical context, researchers highlight its importance for everyday relationships between subjects of social relations. Thanks to the field of systematized knowledge about the essence, content, and characteristics of the law (i.e., jurisprudence), representatives of a society can obtain more information about the rules and mechanisms by which the relationship between them is arranged. It is concluded that l...
The Brazilian Legal Profession in the Age of Globalization
Globalization and its multiple cross-border exchanges in virtually every area of human life has led, in the legal arena, to a growing demand for global lawyers, that is to say, for legal professionals capable of proficiently thinking and practicing Law from a global, rather than local, perspective (FLOOD and SOSA, 2008). The demand for such professionals is the result of specific tension that has surfaced between the organizational mesh of legal systems, which are founded on the national State and sovereignty within defined geographical borders, and the transnational (borderless) vocation that characterizes the social, political and economic dynamics of globalization (SILVER, 2009). If the economy and trade, over a long period, have already incorporated the international context as an intrinsic element into its thought-process and its practice, the same cannot be said for Law, which continues to operate on the territorial-national basis which characterizes the institutions that materialized during the rise of the Modern State. Law"s predominantly local approach struggles to meet the demands of a world that some label a "post-State" (HORSMAN and MARSHALL, 1994). As it undeniably remains, nonetheless, a vital instrument to design and drive the economic means that characterize a globalized world, Law has come under significant pressure to change its workings, institutions and dynamics.
Legal Education in the Global Context
2011
Legal education is going through profound changes around the world because of globalization, technology, and government changes in the organization of legal services. English lawyers have traditionally enjoyed high standing in the world but the question arises will changes introduced by the Legal Services Act 2007 and potential changes arising from the SRA-BSB-Ilex review of legal education damage that reputation?
Legal Education is the Basis of Legal Culture
Zenodo (CERN European Organization for Nuclear Research), 2022
The importance of legal education for our country is determined by the tasks of transition to a democratic society, a legal state, and a market economy. The new socioeconomic conditions significantly increase the traditional problem of education-the most important component of any educational system, the search for ideals that can be the basis of goal setting. The target component of the educational system determines the specific characteristics of the means of achieving these goals, the criteria for evaluating the obtained results, and possible adjustments to the specific direction of the educational process. In the context of the modernization of law and legal education, the issue of forming the legal culture, sense of justice, value orientation of future lawyers is gaining special importance. Among the various problems of modern legal education in Uzbekistan, development of the main directions of legal policy in the field of legal education occupies one of the main places. Legal education should be based on the model of a lawyer focused on the needs of society's development and the achievement of state-legal development goals. Because such goals have not yet been clearly defined, there is a need to analyze the relationship between legal policy and legal education policy, legal ideology and legal education, legal culture of a lawyer and legal education in modern Uzbekistan. Accordingly, the problem of studying the professional legal culture of lawyers arises in connection with the educational effect of legal education. This is related to the role of jurists in ensuring the effective functioning of the legal regulation mechanism at all stages. Not only the effective functioning of the mechanism of legal regulation, but also the attitude of ordinary citizens to law and legal institutions largely depends on the level of activity of lawyers. In other words, the authority of the law and the state, the level of legal consciousness of the population, and the legal culture are largely determined by the professional skills of the legal staff. However, the most urgent problem of modern legal education is the quality of training of lawyers. Consequently, the educational and legal aspects of the qualitative renewal of the legal education system, the preparation of students, the acquisition of a certain
How global should legal education be
European Journal of Legal Education, 2020
International aspects play an immense role in the work of most lawyers today. Accordingly, knowledge of how to deal with these aspects is of fundamental importance for the goal-oriented and high-quality training of lawyers. Ideally, these aspects should always be an essential part of the training, but this is only possible if sufficient basic knowledge and skills are guaranteed. The main finding of this article is that most universities (in Switzerland - and this probably applies elsewhere) offer a good choice of courses covering international aspects of law but do not ensure that all their students get the minimum necessary. In addition, the language skills so necessary on the (Swiss) job market are too often left to the student and not guaranteed by the university when delivering a degree. A third finding is that it is not easy for students to find out which universities are more diligent regarding the adequate teaching of international aspects. Without a thorough introduction to ...
