Rethinking African Governance Architecture; Lessons and Recommendations for Action
Abstract- What has been seen from the experiences of African countries is that a leadership style based on command and control is no longer suited for making a capable state, characterized by constitutionalism. This will require high-level skills combined with strong commitment and determination on the part of African leaders at large. Beyond the coming into power with a limited experience, African leaders are too stubborn and are attacked by rigidity and no room for dynamism in their character. This situation contributes its part to the today’s insecure governance structure in the continent. If African leaders and the government they lead are dedicated to the rights, unity and well-being of their people, they will ensure the consolidation of their nation and its security which will have a cumulative transformation on the governance architecture of the continent. Recently, Africa needs leaders that understood the social, economic and political forces that constitute the security arena and who never forget their role as an ultimate stakeholder for promoting good governance and the subsequent events of wealth creation and sustainable development in the continent. In 2001, the African states established the African Union (AU) as a successor of the Organization of African Unity (OAU). Since its establishment, the Union has made a significant effort to become an active player in promoting democracy in Africa. This represents a significant change in tempo from its predecessor, the OAU, also raises important questions as to exactly how committed the AU is in promoting democracy in Africa since the majority of its member states are autocratic/dictatorial regimes and leaders. This paper addresses the so forth question by examining a number of cases in whcih the AU has-or has not-been able to realize its goals and agenda due to the presence of such regimes and leaders within the Union.
From OAU to AU: Rethinking Supranational Governance in Africa

The transformation of the Organization of African Unity (OAU) into the African Union (AU) in 2001 placed in sharp focus the need to endow continental structures with the powers to make binding rules and regulations for the enhancement of Africa’s integrative efforts. This supranational aspiration is espoused through the legal and institutional framework of the organization. In specific terms, the Constitutive Act endows the AU with the powers to coordinate the activities of the regional economic communities, intervene in member states, and determine and monitor the implementation of common policies. This chapter will place the continental integration efforts within the supranational paradigm by dissecting some of the peculiar problems hindering effectiveness, and will then posit measures for redressing these obstacles.

After more than five decades of the establishment of the Organization of African Unity (OAU) now the African Union (AU), Africa remains at a cross road in her struggle to grapple with the daunting challenges of achieving its core objectives of promoting sustainable development (SD) and economic integration, despite various earlier development initiatives and treaties in that regard. In analyzing the problem, this paper adopts the concept of law as instrument of social change and argues that at the heart of Africa’s missed development opportunities in the past lies the fundamental problem of democratic governance deficit. Democracy is a political culture that seeks to promote majority participation in the process and art of governance, with the aim of developing a society; based on the principles of equality, freedom and social justice. This implies that democracy must operate within the confines of a State structure, which means there must be a State before we can talk about the enthronement of democratic culture and institutions. Thus, this paper examined the nature of African States and discovered that Africans are operating a dislocated state structure that is at far variant, with Universal Characteristics of a State. IMPACT OF DEMOCRACTIC GOVERNANCE ON AFRICA`S DEVELOPMENT BY OTACHI ORINA [JACOB
In today’s democracies, citizens, elect individuals to represent them, a concept known as delegated power. However, a crisis of confidence seems to emerge between citizens and existing governance systems and the leadership. This paper explores “Africa`s Development” from an African democracy context and interrogates its successes as well as challenges. A description of pre-colonial and post-colonial forms of governance paths are postulated with their key set-ups. To augment this, the traditional, social and political governance systems as well as international institutions and their implications on African development have been expounded. Further, a characterization of contemporary African democracy alongside its key features is featured with a comparative analysis with best practice examples. A raft of common approaches are advanced that can be employed to put Africa on its right development path.

The establishment of the African Union was noteworthy in the way it undermined the authoritarian theory and practice of its predecessor, the Organization of African Unity. The justification was based on the right of peaceful coexistence of member states and-as a consequence-the right of member states to request intervention from the Union in order to restore peace and security. The African Union's Constitutive Act introduced an array of responsibilities, powers, and rules that challenged the premises of Africa's earlier leaders. The Act established how the Union would carry out its business through a network of organs, agencies, government ministries, and NGOs, which this paper examines in some detail. While the organizational structure attempted to balance national and continental concerns, it also revealed an obvious weakness in the power of its three principal parliamentary, administrative and legal bodies. Although AU has made great strides in building an institution committed to human security and development, there is need to sharpen its focus, and bring about more specificity in organizational goals. The dual missions of a movement championing the independence of sovereign African states and simultaneously creating a homeland for all of African descent were, if not contradictory, at least so divergent as to strain the ability of its leaders to ensure a lasting consensus. While the initial vision was a powerful one and attracted a group of true believers, the complexities of a modern global economy have demanded an array of new developmental strategies to meet this challenge. The challenges include but not limited to good governance in Africa, alleviation of poverty and hunger, as well as hindrances to citizen participation, especially women, in civic and state affairs.

20 years marks the constitutive act of the African Union. However Africa's progress towards political and economic integration remains elusive. This challenge combined with the persistence of instability and new forms of insecurity on the continent have been partially attributed to the incompetence and futility of the AU even by her own members. One has to admit that the AU has been plagued with a number of challenges, the most pressing being a lack of financial autonomy making it unable to address some of African's protracted civil conflicts in different parts of Africa. The reliance on international partners for the provision of funding undermined the AU's legitimacy and leadership in African's affairs. It is expected the reform will likely facilitate the realization of AU's Agenda 2063 which seeks to achieve an integrated prosperous and peaceful Africa driven by its citizen and representing a dynamic force in the international arena.
