Enough is Enough: The Case for Federal Regulation of Sports Agents

I. INTRODUCTION Professional athletes rely on sports agents to represent them in the business aspects of their profession. Agents play a critical role in the athletes' lives by managing business affairs off the field, so that the athletes can focus on their performance on the field. 4 Most professional athletes rely on agents as trusted advisors for many off-the-field aspects of their careers: to negotiate contracts, engage in marketing activities, develop athletes' brands, secure their financial futures, and prepare them for life after their playing careers. In playing such a key role in the athlete's life, great trust is put in the agent. Violation of that trust by the agent, which results in eliminating an athlete's athletic eligibility, ruining an athlete's financial future, harming a collegiate athletic program, and interfering with professional contracts should be addressed by Congress. Legal Aspects of the Players' Agents Licensing System in Football

Sport entities have always tried to protect their autonomy from interventions. This status has been seriously put into question by the authorities of the European Communities and especially by the Court of the European Communities. One of the most recent cases, where sport authorities were confronted with European competition law, was the one involving players' agents licenses. At present, the reader can find a summary of the famous «Piau Case» (C-171/2005) tackling problems such as whether private organisations like F.I.F.A., whose main statutory purpose is to promote football, have a rule-making power in the issuance of players' agents licenses, taking into consideration that these rules do not have a sport-related purpose; regulate an economic activity that is peripheral to the sporting activity in question, and touch on fundamental freedoms.

The Role of Sports Agents in Men's Basketball in a Small Island State

This study explores the role of sports agents in men’s basketball on the small European island of Malta. The limited literature on sports agents considers them as athletes’ key advisors throughout their careers. The impact sports agents have had and continue to have on player careers and the basketball industry is investigated in this qualitative study. Twelve semi-structured interviews were conducted with key stakeholders in the Malta basketball scene including professional male basketball players that have played on the island, sports agents who have represented players in Malta, league representatives such as club presidents, and coaches with experience in coaching men’s basketball in Malta. Results indicate the role of sports agents as being influential in facilitating contract signings of professional players. Sports agents are seen as beneficial in a professional basketball player’s career, but they may also be difficult to deal with, especially for clubs. In addition, the interviewees spoke about how sports agents have influenced the overall average skill level of the Maltese men’s 1st Division league, providing modes of improvement for Maltese basketball in general.
