The Corona Virus and Labor Rights Issues: How Do Workers Get Their Rights?

The Indonesian Journal of International Clinical Legal Education

The impact of Covid-19 is very broad and comprehensive in all human life. Students must learn from home, workers work from home, and all people worship from home. Really, a life that I never imagined before. Students complain about online lectures because assignments are increasing, internet quota runs out quickly, not to mention students from remote areas that are difficult to signal. This is clearly very troublesome for them. Even for workers who cannot work from home, the appeal to work from home is not valid. They are not office workers or lecturers who can work from home. They have to work on the streets, in the field, even in the fields or gardens. It is impossible for farmers to work from home. This can make us realize that we cannot eat money. Food needs will still be fulfilled by farmers. Referring to the right to decent work and livelihood, it is fitting for the Government to ensure that there is no Termination of Employment by the company and the provision of adequate wag...

In fact, many workers have been terminated and some even did not receive any severance pay at all. Accordingly, the researchers formulated the following research questions: how to terminate employment in the midst of the Covid-19 pandemic, and how is the government’s responsibility for the welfare guarantees for workers. The complex and dynamic relationship between employers and employees is being tested due to the Covid-19 pandemic. The era of the Covid-19 pandemic created a new way of living imposing physical distancing, social isolation, increased workplace safety measures and decreased economic activities. Local governments introduced and applied measures to reduce the dispersion and transmission rate of the virus that affected both employers and employees. We explore the impact of Covid-19 on employee relations and HRM by addressing the research question: "How Covid-19 pandemic impact on employee relations?'' Employees during the period of lockdown expressed fear for the virus, confusion and experienced insecurity as during the lockdown they were preoccupied for the survival of their organization. Employee's voice is more difficult to be heard due to the pandemic, especially when there is no physical presence in the workplace. We explore the impact of Covid-19 on employee relations and the created changes that are to be considered in Human Resource Management practices in the Covid-19 era. We suggest that Organizations need to manage external crisis and remain adaptive and alert and find solutions to problems and challenges arising due to coronavirus. Human Resource Management function now should focus in helping employee's adjustment to the new created situation deriving from coronavirus. Besides, HR managers, HR consultants and Organizations need to rethink, redesign, redefine their roles, adopt new practices and create initiatives such as counseling services to reduce the fear and insecurity and enhance the health and wellbeing of employees.
