Termination of employment should not be carried out unilaterally or arbitrarily, because termination of employment occurs due to certain reasons that cause a worker to escape from a work agreement and responsibility as long as he is bound by a work agreement from the company where he works. But in its implementation there are still many unilateral termination of employment. The purpose of this study is to analyze the legal protection of workers who are unilaterally terminated by the company and analyze the judges' consideration of cases of unilateral termination based on the Decision of the Supreme Court Number 277 / K / Pdt.Sus-PHI / 2017. The research methodology used is normative juridical. Normative juridical research uses primary, secondary and tertiary legal materials and uses primary data. To obtain the data used library study methods and interviews. The approach used in this study is the case approach and the legal approach. Based on the research that has been done, it is found the legal fact that the unilateral termination of employment is not permitted by the company. Termination of employment must obtain a determination from an indutrial relationship dispute settlement institution and Law No. 13 of 2003 has provided legal protection for workers in accordance with the theory of legal protection proposed by Philipus M. Hadjon. In addition, the Supreme Court of the Republic of Indonesia in Decision Number 277 K / Pdt.Sus-PHI / 2017 has decided the case in accordance with the provisions in the legislation.

Penelitian ini dilakukan dengan tujuan (1) untuk mengetahui dan memahami perlindungan hukum terhadap hak-hak tenaga kerja/ buruh yang di-PHK secara sepihak oleh perusahaan akibat pandemi Covid-19 ditinjau berdasarkan Undang-Undang No 11 Tahun 2020 tentang Cipta Kerja dan (2) bentuk pertanggungjawaban perusahaan dalam pemenuhan hak-hak tenaga kerja yang di PHK secara sepihak oleh perusahaan. Covid-19 significantly affected nearly all companies in which many were forced to discontinue the working relationship against excuse of force majeure, proper action was required to protect the rights of worker so that a center point could be avoided the decision of termination if the working relation ship. This assessment uses the nomadic yuidis method of judging where it will use law approaches and several sources such as books, journal and others. According to public opinion, government are obligated to reserve human rights against workers in order to keep economy in society.It is vital that prevention against layoffs be made to reduce Indonesia’s unemployment rate, there is also the right of the workers to make the best contributions to boost productivity and turnover to the company. The government is expected to provide better jobs as well as relevant competency programs for reducing Indonesia’s unemployment rates.

Untuk memahami aspek-aspek empiris dari proses atau mekanisme penyelesaian perselisihan perburuhan dalam kenyataan di lapangan, Perlindungan hukum terhadap hak-hak pekerja/buruh yang terkena PHK dengan alasan tutupnya perusahan, diatur dalam Pasal 150 sampai dengan Pasal 172. Pasal 154 ayat (1) UUK yang menyebutkan bahwa pengusaha diwajibkan untuk memberikan uang pesangon dan atau sejumlah uang penghargaan (uang jasa) dan juga wajib memberikan uang penggantian hak-hak pekerja/buruh. AbstractThe writing of this article refers to a normative juridical research method using the Law approach, Conceptual Approach, and Court Decisions which are linked to several National Laws such as Law Number 13 of 2013, Law Number 21 of 2000, and Law Number 2 of 2004. This study aims to determine the legal protections for workers who have been terminated on the basis of association as well as legal remedies that can be taken by workers who have terminated their employment on the grounds of association. Termination of employment on the grounds of association is an industrial relations dispute which cannot be carried out automatically according to Law No. 13 of 2003. Termination of employment is indeed used as a tool to cut the operational costs of a company and also has a positive impact on companies, but not for workers where they lose their jobs which they use as a source of income for everyday life. Basically, the working relationship between contract workers and companies based on PKWT ends in accordance with the agreed contract period. However, it is not uncommon to terminate employment before the contract period ends, as happened to Company X contract workers in Bandung who were employed on a 1-year contract, but while the contract was still in progress, termination of employment occurred. The purpose of this study is to determine the termination of employment before the contract period ends for contract workers and the legal protection of the rights of contract workers who are affected by termination of employment before the contract period ends. The research method used is normative juridical. The research specification used is descriptive analysis. The data collection method used was a literature study and to fulfill the required data, an interview session was conducted with related parties and an analysis was carried out using a qualitative juridical analysis method. Based on the research results, it can be seen that the termination of employment before the contract period ends for Company X contract workers in Bandung. occurred not in accordance with the provisions of Law No. 13 of 2003 concerning Manpower because its implementation is unclear which has implications for the unclear normative rights of contract workers who are affected by termination of employment before the contract period ends which is regulated in the provisions of Article 62 of Law no. 13 of 2003 concerning Manpower.
