Legal positivism is one of the schools of legal philosophy that has a dogmatic paradigm, the fundamental principle in positivism is the principle of legality. In addition, the characteristics of positivism are legal unification, the meaning of a law is the spirit to make one law, the state of positivism law is also influenced by legal universalism, and the law is considered relevant in any part of the world. Law as control should regard the reality, values and factors that determine every society's behaviour or action. Prison of Legal Positivism Paradigm and Corruption Eradication in Indonesia

The never-terminated corruption is believed to be caused by incomprehensively legal enforcement. A sentence verdict for corruptor that is never frightening them is one of the examples. Consequently, blame is put to a judge who plays important role in the sentence decision. However, what is actually lying behind legal enforcement by judges causing never-terminated corruption? Undeniably, the answer is rooted in legal positivism paradigm that is prisoning the judges. Act or entire ordinance is thought as a body containing complete laws, so that a judge is responsible only for application the acts mechanically and linearly in settling problems of society including corruption case according to what is said by the law. In this case, the legal positivism paradigm puts a judge as 'prisoner' of acts, and there is no room for court to be an institution encouraging development of society. Verdicts of judges are not considered having great contribution to the change of Indonesian people yet, even the reformation era at present. Moreover, the judges who are still implementing positivistic way of thought views that legal problems of society can still be settled as in stable normal condition. Consequently, legal paradigm experiences stagnation and put legal positivism as a paradigm that is never experiencing what Kuhn says as 'anomaly'. In other words, the paradigm of legal positivism still stands in a normal science from one generation to the next in legal practices. Incorrectness of way of thought about naïve reality is tried to dismantle by using progressive legal approach. Judges are encouraged to transform themselves to do a rule breaking bravely that needed prophetic intelligence (PI). The prophetic intelligence guides and provides holistic braveness to perform progressively breaking the prison of positivism paradigm.
The Position of Judges in the Indonesian Legal Idea

Background. Judges are state judicial officials authorized by law to adjudicate. The role of judges is very important in the judicial order in Indonesia. Purpose. As we know, the Indonesian government system adheres to the trias politica, namely the legislative body as the legislator in this case the DPR, the executive body, namely the government and its cabinet and finally the judicial body, namely the judiciary. Method. The writing of this article cannot be separated from the name of the research method, because in scientific writing the method is a necessity which is the perfect and effective condition of a research result Results. In addition to the government system, the Indonesian legal system is known to follow the European-Continental legal system where the law will be based on the law or what is known as "law in book". Legal issues that are increasingly complex corner the enforcers of justice (read judges) are hit by many problems that are often not found in the law. Judges who must decide based on the law and on the other hand they cannot be absent from their profession in adjudicating, however they must decide for the sake of justice and human truth. Conclusion. In this article, the author seeks to explain the position of judges in finding law by writing articles using a qualitative and normative (doctrinal) approach as a type of research.

Indonesian judges of Religious Court in deciding child custody cases have different legal reasoning. Some preferred to use juridical reasoning and others use progressive and sociological reasoning. This different legal reasoning causes various insights in the meaning of justice for child custody. This study aims to analyze the positivistic and progressive Islamic legal thought in judges' decisions of child custody cases. This is normative legal research with statutory and case approaches. The legal material is six judges' decisions and is supported by books, scientific article, statutes, and interview. Then, it is analyzed by content analysis. The result states that judges who use textual reasoning tend to decide that child custody is the mothers right, referring textually to an article 105 of the Islamic Law Compilation. Indonesia as a rule of law country, of course, is very very interested in these legal theories so that they can be applied in efforts to foster and establish or develop national law that cannot be removed from the living cultural values and soul of the Indonesian nation, the purpose of this research is to find out the development of legal theory which is the central point of substance quality in each phase of the development of legal theory and which legal theory is influential and suitable for adoption for the development of national law in the future. This type of research, this type of research, this paper is normative research in which the method or steps used to obtain data originate from the data collection used in this research is to collect data documents, as well as legal literature books. Some of these data documents include; article-articles or news from the mass media related to the legal phenomena that are the subject of discussion. The results of the analysis obtained are classical legal theory, showing that the quality of substance which is the central point of legal theory in each phase of its development, basically pivots on one thing, namely "human relations and law". This means that the more the basis of a theory shifts to the "regulation" factor, the legal theory responds to law as a closed formal legalistic unit. Conversely, the more it shifts to the "human" factor, the more open the theory of law is and touches the social mosaic of humanity.

The state of law is the concept of a state based on applicable law. In the development of the state, there are two concepts of state of law used by countries in the world, namely rechtstaat and rule of law. These two concepts also inspired the Indonesian state of law but were not followed absolutely. Indonesia is still building a legal system with a culture of society. Therefore, this study aims to describe the development of the state of law in Indonesia. This study uses a normative juridical method by using secondary data and is narrated with scientific logic.
