Sexual violence against a child in the social service workers’ views. A commentary to the studies

For the full and harmonious development of their personality children should grow up in a family environment in an atmosphere of happiness, love and understanding. In many families, children are not provided with fundamental rights and fulfillment of their needs: safety, love, acceptance, and respect. Their sense of dignity collapses, they are prohibited from revealing emotions and thoughts. All this triggers a sense of shame, anger and fear, which are often passed on to the child's functioning in different environments. The phenomenon of violence against children in the family-care deprivation, negligence of their emotionality as well as of bringing up, physical and mental harm, beatings, abuse, and sexual abuse are not uncommon. The issue of various types of child abuse, its recognition, intervention as well as prevention, and helping those children is a concern and a great challenge not only for teachers, educators, psychologists, therapists, but for the whole society, too. In the first part of the considerations theoretical framework for difficult issues posed by sexual violence against children has been presented. An attempt at defining the problem has been presented: a form of sexual abuse, signals that may indicate that the child was the object of sexual violence and direct and long-term consequences of sexual violence against a child. In the second part, in a form of commentary the results of the author's own research regarding the various categories of respondents, who are employees of the social services on sexual violence against a child have been thoroughly analyzed.
The placement of Romanian child protection system into the European countries framework
Romania is between the first five countries with the highest rate of institutionalization. It seems that this form of care is the most prevalent in Eastern Europe. Authors conclude that those countries that spend less on community health and social services are more likely to have higher proportions of institutionalized children UNICEF social monitor, as cited in Browne, Hamilton-Giachritsis, Johnson, & Ostergren 2006). Vaida (2013) emphasizes more than 50 years of research which provide convincing evidence that the type of institutional care provided in western countries has a detrimental effect on cognition, behavioral, emotional on social development of young children. He describes also that are some poverty stricken countries (like those from Africa) where children in institutionalization care have better chances of cognitive development, when the children were encouraged to participate along with the staff in the decisions that influenced them in the institutions. The data linkage between sectors such education, health and social services are used to provide comprehensive estimates of the location, nature and prevalence of maltreatment children (Buckley, 2012). The present review follows a large diversity of studies, but most of them are from the sociology field. It deals with some of the fundamental issues concerning child protection system in Romania. The purpose of the present review is to describe the actual problems of Romanian system, and which are the ways of social interventions and care of vulnerable children, into the European Countries framework. Each chapter is dedicated to s specific issue; we present the framework of child protection system into the European countries, after that we analyze a short history of Romanian system in child protection, and try to define this issue. In the second part of the present review we describe, analyze and compare some strategies, and social interventions applied in freight and Romanian child protection system.

Our study aims to analyze the relationships between intervention and prevention in a child protection system which is considered to be new (the fundamental and secondary legislation that supports it is effective as of January 1st 2005) and its reconsideration from the perspective of the child’s resilience (assisted or unassisted). The study highlights the fact that the current system of child protection in Romania contains within itself the premises of continuation of maltreatment of the child on whom a measure of special protection has been adopted. At the moment, this system does not have the resources to allow an approach centred on the resources belonging to the individual and to the community in order to overcome the traumatising events, without highlighting through the re-traumatizing experience created by separating the child in difficulty from the hostile environment.
FAMILY VIOLENCE -THEORETICAL AND PRACTICAL ASPECTS
Romania's integration into the European Union caused a growing preoccupation with the protection of fundamental human rights whereas the fight against family violence became a central topic of the national policy. In this context, both the legislation and strategies adopted in the field have been modified in order to prevent and fight against this serious phenomenon. At both national and local levels, efforts have been made to conceive a series of instruments considered as absolutely necessary for the evaluation of this phenomenon and for the opportune intervention in due time, in order to guarantee better ways of protecting the most vulnerable categories, namely women and children. At the same time, there have been various efforts to incorporate the national legislation within the limits established by the international law in the field and to make the working methods used in the case of family violence meet the current European standards. The emphasis is laid on both the teamwork of the professionals who try to identify, take over and deal with the cases of family violence, but also on all the activities for preventing family violence. The fight against family violence represents also a fight for the protection of children and human rights as they are established in the UN Convention on the rights of the child, the Universal Declaration of Human Rights and the EU Charter of Fundamental Rights.

Child maltreatment is a phenomenon which has a high impact on child health, causing serious disruptions in the development of the child and, in some extreme cases, their death. Thereby, cooperation and coordination among services and professionals is a crucial factor affecting the effective assistance of children who have been victims or witnesses of violence. However, the intervention in cases of child maltreatment is a complex issue that faces specific difficulties in every step of the intervention process which also may depend on each country’s features and its protection system. Historically, the views of lawyers and social workers in the application of socio-legal protection of children in the Czech Republic often fail to understand the best interests of the child (the best interests of the child under the UN Convention on the Rights of the Child). In 90´s we can see in practice the direction of implementation of the basic principles of the Convention into individual decisions of social workers. Emphasizing the principle of proportionality between the various rights of the child should lead to the recognition of the child as the holder of the rights, not as the object of care and protection. However, in the late modern era, we have seen a certain shift. Instead of reflecting on the subjective conviction of the creator of what is best for the child; rather, decisions that consist not of ignorance of the content of these fundamental rights and freedoms, but of determining the values of the decision maker. Therefore, this should lead us to a deeper reflection on how workers in social and legal protection institutions understand the issue of the best interests of the child and to further discuss its implementation. The research part of the article focuses, through qualitative interviews, on uncovering how social workers in child protection in the Czech Republic think about the best interest of the child and their impact on practice, and these results relate to the perspective of lawyers extracted from legal acts, regulations, and judgments.

Preventing child abuse and neglect in Romania

In this paper we analyze the phenomenon of abuse and neglect in Romania in order to reduce the incidence of this phenomenon. This paper addresses issues regarding: the description of child abuse, types of child abuse (e.g.: physical abuse; sexual abuse; emotional / psychological abuse and child neglect), particularities of children abuse in Romania, and some therapeutic models used in treating the effects of child abuse.
The condition of children under Romania’s Child Protection System (2018)

On paper, Romania’s Child Protection System offers a child temporary intervention until they are reintegrated into their biological family, or placed in an adoptive family. In reality, this “temporary intervention” usually lasts until they become an adult. For these children, who cannot be reintegrated into their biological family, their path to adoption is made especially difficult by exaggerated laws, described in this report. In recent years some of Romania’s adoption laws have been improved; but these improvements are usually ignored at the local level and we suspect that priority may be given to keeping children in the system based on the miniscule rate of adoptability for institutionalized children (only 1.5%).
