Legal Aspect of Plastic Waste Management in Indonesia and Malaysia: Addressing Marine Plastic Debris

Marine plastic debris is a common issue faced by the entire international community, with some countries finding it exceptionally difficult to address and combat the issue, including Indonesia and Malaysia. The two neighboring countries are ranked as the largest contributors of plastic waste in the ocean. Unmanaged plastic waste that will ultimately end up in waters and seas has become a major issue that Indonesia and Malaysia must deal with, and a firm legal approach holds a key role for both countries in solving the issue. This paper is devoted to normatively analyzing the various legal approaches that are/can be used by Indonesia and Malaysia, and to identify the problems related to such approaches. This article applies normative legal research, in which various legal instruments and other secondary legal materials are descriptively analyzed to unravel the legal issues. Plastic waste is one of the world’s most pressing human health and environmental concerns. Plastic constitutes the third highest waste source globally, with the total volume of plastic waste growing in-line with increases in the global population and per capita consumption. Malaysia is tracking global trends in both the overall generation of plastic waste and the consumption of single-use plastics and since 2017 has been the world’s largest importer of plastic waste. These elements create a number of major challenges for the country’s waste management system. The ever-increasing domestic consumption of plastic products and materials has forced Indonesia to propel forward the means and approaches in dealing with their disposals. Despite the presence of numerous legal instruments serving as basis justifying actions to deal with plastic waste, Indonesia is still nowhere near success in tackling the issue of mismanagement. This article is devoted to normatively analyze various legal approaches used to govern plastic waste management Indonesia, and to unravel issues related to such approaches. It is carried out using normative-legal research methods in which various legal instruments and other secondary legal materials are analyzed descriptively to point out the emerging legal issues. Legal and Social Issues in the Development of Waste Management in Malaysia
Throughout man's history, waste disposal has put great stress in maintaining a clean and healthy green environment. The tremendous increasing amount of solid waste becomes a major challenge for the people and the government in analyzing the national legislations and the international policy framework for an effective control and enforcement measures in handling the waste management. Failure of a state to implement the effective rules, regulations and social policies will lead to numerous environmental hazards. The objective of this paper is to analyze the national legislations and policies in developing the methods necessary to formulate waste management plans in Malaysia. The Solid Waste and Public Cleaning Management (Act 672) came into effect in 2011 and then proceeded by awareness programs to educate people on the 3R concept – reduce, reuse and recycle. This paper attempts to discuss some practical methods introduced by the government, like the so-called " waste-separation scheme " which was implemented in September 2012. This scheme is in accordance with the government declaration of educating the people about going green. At the end, we make some recommendations in reducing the current negative social impact of environmental changes due to an increasing quantity of waste disposal.

The focus of this study is to analyze the level of knowledge, awareness, and attitude toward plastic waste and to distinguish the key drivers that encourage the households in Kuala Lumpur, Malaysia, to participate in BNo plastic campaign,^This study used the logistic regression model to explain the factors that may affect the willingness to participate (WTP) of households in the campaign. In this study, it is found that 35 % of households are willing to participate in the campaign. The results of the study also indicate that people who are more informed and more convinced of their knowledge have a more positive attitude toward recycling than their counterparts do. Furthermore, this study provides additional evidence of the level and classification of importance of motivating factors for plastic recycling, using the modified average and coefficient of variation of the models. From the analysis, the factor Bhelps reduce landfill use^is found as the most important factor and the factor of Braising money for charityî s found as the least important factor that motivates households to participate in recycling. Plastic waste management is currently a major problem in several countries, especially in Indonesia. Because plastic waste cannot be decomposed. In South Kalimantan which is a wetland area, plastic waste is a serious problem that must be handled by the local government, due to the nature of wetlands that have a high water content or are inundated by water, either permanently or seasonally. The Non-decomposition of plastic waste will destroy wetlands. The specific objectives to be achieved are: (1) The legal policies that local governments take manage plastic waste in South Kalimantan. Marine plastic litter is one of the major problems that undermine the Indonesian Government’s vision for making the sea as the future for the Indonesian nation. Marine areas of Indonesia are endangered by the massive plastic pollution, which is causing serious marine environmental problems. Indonesia is referred to as the biggest source of plastic waste in Southeast Asia and second biggest in the world. Indonesia government through Presidential Decree No. 7/2017 has established National Plan of Action (NPOA) on Marine Plastic Debris Management to strengthen the Indonesian commitment in reducing marine plastic litter.
